ORDINANCE NO. 771
AN ORDINM~CE OF THE CITY OF ARCADIA, CALIFORNIA, REGULATING
THE OPERATION OF SELF-SERVICE AUTOMOBILE FILLING STATIONS,
PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING
ORDINANCE NO. 757 OF THE CITY OF ARCADIA, ADOPTED MARCH 1, 1949.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES
ORDAIN AS FOLLOWS:
SECTION 1. That the operators or person or persons in charge of any
and all Self-Service Automobile Filling Stations within the City limits
of the City of Arcadia must comply with and conform to the following
rules, regulations and requirements:
1. All gas lines to be ~quipped with automatic safety
nozzles, provided that no latching or other device shall be attached
or used which will permit fully automatic filling without manuel control.
2. A sign containing the words "STOP Y01JR MOTOR- NO
SMOKING" shall be displayed in a conspicuous place at each pump island
so that it can be seen from either approach. Sign shall have a white
background and red letters three (3) inches in height. This shall be
strictly enforced. Service shall be refused and pump shutoff when per-
sons do not follow instructions.
3. Each pump island shall be equipped with manually
operated shut-off switch or lever.
4. One C02 extinguisher of at least five (5) pound
size to be placed on each island. One C02 extinguisher of at least
fifteen (15) pound size to be located as required by the Fire Dep!I'tment.
DU-GAS extinguishers may be substituted for all C02 extinguishers.
5. Water lines of at least one (1) inch size, properl:!"
equipped with adequate fixed fog nozzles to be provided and so located
that complete coverage of the entire premises can be had. Such hose
lines and nozzles to be used for first aid fire equipment only.
6. All electrical fixtures, installed by the owner or
operator, within ten (10) feet of any pump or vent pipe to be vapor or
explosion proof, and/or approved by the National Board of Fire Under-
writers or other recognized testing laboratory.
7. Telephone facilities shall be provided on premises.

8. No buildings to be located within twenty-five
(25) feet of any pump unless such building is of non-combustible materia.
9. All buildings or structures shall comply with the
Building Code or applicable ordinances and laws.
10. Control !Doom shall be centrally located and ele-
vated sufficiently so that operator will have a clear and unobstructed
view of all islands. "Control Room" means a room where electric switchell
controlling the operation of t he station and the pumps are located.
11. There shall be not less than one attendant on dUty
whenever nine pum.ps or a lesser number theTeof are open to the public, and
not less than two attendants on duty when more than nine pumps are avail..
able and open to the public. All attendants to be thoroughly instructed
in the use of extinguishers and water in case of fire, and to be in-
structed in prohibiting and preventing patrons from smoking around the
pumps. Service shall be refused and pump shut off when any person does
not follow instructions.
12. There shall be at least one male attendant on duty
at all times during which the station is open to the public.
13. No open-flame device shall be located or perm.itted
within twenty-five (25) feet o~ any pump, except that electric heaters
may be installed, if location is approved by the Fire Prevention Bureau.
No heater shall be installed less than two (2) feet above the floor of
controllroom. orgrade.
14. No coin operated gasoline dispensing machine to be
permitted on premises.
15. Mops or rags used for cleaning purposes to be
stored or maintained at least twenty-five (25) feet from every pump.
16. All waste material andr ubbish to be placed and kept;
in an all-metal or metal lined container to be equipped with self-closing
toP. All such waste material and rubbish to be kept in such container
until it is disposed of or removed from the premises.

The wheels of skates or other'artificial or
mechanical means of locomotion shall be of non-ferrous metal or non-
arcing metal.
18. There shall be no filling of automobile gasoline
tanks, or the operation of any gasoline dispensing pumps while the under-
ground storage tanks are being filled, unless an approved type of vapor
proof connection be provided between underground tank and filling truck.
Nor will there be permitted any smoking, or any flame, or any spark-pro-
ducing device or apparatus within twenty-five (25) feet of any tank
truck unloading into the underground tanks.
~ All gasoline or oils spilled on the ground shall
be cJe aned up immediately.
2:~ Each dispensing unit shall be provided with an
automatic lOCking device that prevents the re-use of such unit after tlle
hose has been replaced until such unit has been manually unlocked by
means of a detachable key or similar mechanism, provided that a computing
pump that automatically prevents re-use until the re-set handle is
operated may be used, if the re-set handle is detached and is used onl~r
by the attendant to start the pump prior to each use by a customer.
SECTION 2. PENALTIES. Any person violating any of the provisions
of this Ordinance shall be deemed guilty of a misdemeanor, and upon
convictions thereof shall be punished by a fine not to exceed $500.00,
and in case said fine be not paid, the said person may be imprisoned in
the City Jailor in the County Jail, at the discretion of the committing
magistrate, for a period not exceeding six (6) months, or by both such
fine and imprmsonment; and each such person, his principal, agent, or
otherwise, shall be deemed guilty of a separate offense for each day
during any portion of which the violation of, failure, neglect, or refusal
~o comply with any of the provisions of this Ordinance is committed,
continued or permitted by such person.
SECTION 3. That Ordinance No. 757 of the Ci~y of Arcadia, enti~led,
"An Ordinance of the City Council of the City of Arcadia, Amending Ordi,-
nance No. 323 of the City of Arcadia, by adding
a new section thereto,

to be kno\'m as and numbered 43A", adopted March 1, 1949, be and the
same is hereby repealed.
SECTION 4. The City Clerk shall certify to the adoption of this
Ordinance, and Shall cause the same to be published once in the Arcadia
Tribune and Arcadia News, a newspaper of general circulation pUblished
and circulated in said City of Arcadia, and thereupon and thereafter,
the same shall take effect and be in force.
I HEREBY CERTIFY that the foregoing Ordinance was adopbmd at a
regular meeting of the City Council of the City of Arcadia, held on
the 21st day of June, 1949, by the affirmative vote of at least four
Counc ilmen, towi t:
