HomeMy WebLinkAbout0778 ORDINANCE NO. 778 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, PROHIBITING ALL OWNERS AND OCCUPANTS OF LOTS AND PREMISES WITHIN SAID CITY FROM OBSTRUCTING THE STREETS, PARKWAYS, AND SIDEWALKS, OR OBSTRUCTING THE FREE PASSAGE OF PEDESTRIANS AND VEHICLES UPON AND ALONG SUCH STREETS, PARK- WAYS AND SIDDVALKS IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: SECTION 1. That it shall be the duty of every person owning, leasing, occupying, or having charge or control 0 f any lot or premises wi thin the City. of Arcadia to keep or maintain any tree, bush, shrub or v&getation growing upon any such lot or premises abutting any street, parkway or sidewalk so t hat the limbs, twigs, leaves or parts of such tree, bush, shrub or vegetation shall not interfere with or ob- struct the free passage of pedestrians or vehicles along or upon said streets, parkways or sidewalks. Trees or bushes greater than fifteen feet in height growing in or upon any premises, parkway or sidewalk shall be deemed to interfere with and obstruct the free passage of pedestrians or vehicles upon said streets, parkways or sidewalks within the meaning of this Section unless the lower limbs, twigs, or leaves of such trees or bushes are kept removed at all times so as to have a clearance of eight feet above th~. surface of such streets, parkways or sidewalks. SECTION 2. That it shall be the duty of every person, owning, leasing, occupying, or having charge or control of any lot or premises, within the City of Arcadia, to keep or maintain any bush, shrub or vege- tation, but not incblding trees, growing upon any such lot or premises which is or are situated at the intersection of streets so that the limbs, twigs, leaves or parts of such bush, shrub or vegetation except trees within a distance of twenty-five (25) feet of such intersection shall not exceed a height of three (3) feet. SECTION ~. No person, having charge or control of any lot or pre- mises within the City of Arcadia, either as owner, lessee, tenant, builder, contr~ctor, house-mover or otherwise, shall construct, de- -1- / fi}-<'<> CAd. 77Y''''<> posit, keep or maintain any structure, building, or any obstacle of any nature whatsoever, in or upon any street, parkway or sidewalk abutting on or adjacent to such lot or premises or which will inter- fere with the free passage of pedestrians or vehicles along such street, parkwa:\r or sidewalk. SECTION 4. No person having charge or control of any lot, building or premises shall clean or sweep any dirt, rubbish, or refuse, from any sidewalk into the street, between the hours of 6:00 A. M., and 6:00 P. M.; provided, that nothing contained in this Section shall prevent such person from cleaning or sweeping any dirt, rubbish, or re- fuse from any sidewalk and disposing of the same on or in said lot, building or premises, where such disposition does not create a nuisance and is not prohibited by any other law or orldinance. SECTION 5. No person having ch~~ge or control of any lot, build- ing or premises shall wash, scrub or otherwise clean the exterior por- tionof any building, structure or premises, except windows, between tae hours of 6:00 A. M., and 6:00 P. M., whenever such lot, building or pr>e- mises fronts on or the property upon which the same is constructed or erected is adjacent to any of the following described streets: Huntington Drive between Michillinda Avenue and Fifth Avenue, Baldwin Avenue between Huntington Drive and Naomi Avenue, First Avenue between California Street and Newman Avenue, Foothill Boulevard between Tindalo Road and Fifth Avenue, Duarte Road between Sunset Boulevard and Second Avenue, Santa Anita Avenue between Colorado Boulevard and California Street, Las Tunas Drive between El Monte Avenue and Live Oak Avenue. SECTION 6. That any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not exceeding three hundred ($300.00) Dollars or by imprisonment in the City Jail 0 f said City of Arcadia, or in the County Jail 0 f the County of Los Angeles, at the discretion of the committing magistrate, for a period not exceeding three (3) months, or by both such fine and imprisonment. -2- rJA.cl7Z!?' - SECTION 5. f.he City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Bulletin, a newspaper of general circulation pUblished and circulated in the City of Arcadia, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force.
