ORDINANCE NO. 780 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, CHANGING THE SETBACK LINES ON A PORTION OF SECOND AVE1WE, A BUBLIC STREET IN THE CITY OF ARCADIA. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Pursuant to Resolution No. 1881, and after a public hearing thereon, the .City Council of the City of Arcadia does hereby determine that the public peace, health, safety, interest and public welfare require, and it is hereby ordered, that the setback lines pre- viously established on a portion of Second Avenue, a public street in the City of Arcadia be changed and re-established as hereinafter desig- nated. SECTION 2. That it shall be unlawful for any person, firm or cor- poration to erect, construct or locate any building or other structure upon the following described parcel of land fronting on Second Avenue, being a publi c street in the City of Arcadia, towit: The north 94 feet of the East 80.92 feet of the South one~half of Lot 47, Arcadia Acreage Tract, County of Los Angelos, State of California, as per map recorded in Book 10, Page 18 o~Maps, in the office of the County Recorder of Los Angeles County, unless tl1e said building or other structure shall be set back to a line which is distant twenty-seven (27) feet westerly from and parall€,l with the Westerly boundary of said Second Avenue. SECTION 3. That llll other portions of Ordinances in conflict herewith, be, and the same are hereby, repealed; that this repealing clause is not intended to affect any other Ordinance or portion ctr Ordinance in the City of Arcadia not in conflict with this Ordinance. SEC%ION 4. That any person, firm or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not exceeding Five hundred dollars ($500.00), or by imprisonment in the City Jail of said City of Arcadia, or in the County Jail of the -1- County of Los Angeles /2 f TPO ".<a. VA-of. ,,'0-- state of California, at the discretion of the Committing Magistrate, for a period not exceeding six (6) months, or by both fine and imprisonment; and each such person, firm or corporation shall be deemed guilty of a separate offense for each day during any portion of which the violation of or failure, neglect or refusal to comply with, any oft the provisions of this Ordinance is committed, continued or permitted. SECTION 5. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof shall cause the same to be published once in the Arcadia Bulletin, a newspaper of general circulation, published and circuBted in the City of Arcadia, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. I HEREBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 16th day of August, 1949, by the affirmative vote of at least three Councilmen, towit: AYES . .
