HomeMy WebLinkAbout0798 .,,\ -/' I' ORDINANCE NO. 798. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, CHANGING THE. SETBACK LINES ON PORTIONS OF DUARTE ROAD, A PUBLIC STREET IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Pursuant to the prOVisions of Resolution of Intention No. 1974 and after a public hearing thereon, the City Council of the City of Arcadia does hereby determine that the public peace, health, safety, interest and public welfare require, and it is hereby ordered, that the setback lines previously esta- blished on the following described portions of Duarte Road, a public street in the City of Arcadia, to wit: Along the South side of Duarte Road, distant fifty (50) feet Southerly from and parallel with the center line of said Duarte Road, between, and extending over and upon the Westerly 20.5 feet only of the Easterly 101.5 feet of ]~t I, Tract No. 6925, as per map recorded in Book 74, Page 79 of Maps, records in the Office of the County Recorder of Los Angeles County, heretofore est~blished '. by the provisions of Ordinance No. 676 of the City of Arcadia, adopted December 21, 1947, be and the same are hereby eliminated. SECTION 2. That all other portions of Ordinances in conflict herewith be, and the same are hereby repealed; that the repealing clause is not intended to affect any other Ordinance or portion of Ord.inance in the City of Arcadia not in conflict with this Ordinance. SECTION 3. That any person, firm or corporation violat- ing any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not exceeding Five Hundred Dollars ($500.00), or by 1. :j.~V ,~'ij<;; t/J 77,F , imprisonment in the City Jail of said City of Arcadia, or in the County jail of the County of Los Angeles, State of California. at the discretion of the Committing Magistrate, for a period not ex- ceeding six (13) months, or by both such fine and imprisonment; and each such person, firm or corporation shall be deemed guilty of a separate offense for each day during any portion of which the violation of, or failure, neglect or refusa~ to comply with, any of the provi- sions of this Ordinance is committed, continued or permitted. SECTION 4. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof shall cause the same to be published once in the Arcadia Bulletin. a newspaper of general circulation, published and circulated in t he City of Arcadia, and thirty days from and af- ter the final passage thereof said Ordinance shall take effect and be in force. I HEHEBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 7th day of March. 1950, by the affirmative vote of at least three Councilmen, to wit: AYES: CouncilmenBouoher, Klomp, Nugent, Russell and Sullivan NOES: None ABSENT: None SIGNED AND APPROVED THIS City Clerk of the City of rcadia.
