HETKE FOR RE-ZONING OF CERTAIN PROPERTY IN SAID CITY AND AMENDING ORDINANCE NO. 704 OF THE CITY OF AHCADIA, ADOPTED MAY 4, 1948. TIill CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA DOES ORDAIN A S FOLLOWS: SECTION 1. The petition of Louis M. Hetke having been filed in the Office of the Planning Commission of the City of Arcadia, pursuant to the provisions of Ordinance No. 760, of said City, adopted May 3, 1949, requesting a rezoning of the property described in said petition, and setting forth the specific reasons therefor and the circumstances in connection therewith, and recom- mendation having been made to this Council by said Planning Com- mission, aft'9r a public hearing as in said Ordinance No. 760 pro- vided, this Council hereby approves and adopts the recommendation of the said Planning Commission that the aforesaid petition be, and the same is hereby, denied. SECTION 2. A full investigation and reconsideration of the facts having been made, this Council finds and determines that ; practical difficulties, unnecessary hardships or results inconsist- ent with the general purpose of said Ordinance No. 760, require that the revision and extension of the uses prescribed in the. variance previously granted, and affecting the aforesaid property under the prOVisions of said Ordinance No. 704 of the City of Ar- cadia, entitled, "An Ordinance of the City Council of the City of Arcadia, California, making a conditional variance to certain pro- visions of Ordinance No. 439 of said City of Arcadia, adopted June 28, 1940," adopted May 4, 1948, to w it: that said ordinance be and the same is hereby amended by adding thereto a new paragraph to be known as and numbered Section lA amd t,q, read as follows: 1. ad pcJNomo "Section lA. In addition to the uses herein granted and to the foregoing conditions applicable thereto, the aforesaid property is hereby excepted from the provisions of the respective zone of Ordinance No. 760 of the City of Arcadia, but only in so far as such exception is necessary to permit such property to be used for business or profes- sional offices (but not including any retail or other sales) upon the following conditions in addition to the conditions enumerated in Section 1 hereof: (a) The uses herein granted shall be confined to the existing buildings on said property and no additions or alterations to such buildings shall be made; (b) Any changes, additions or extensions provided in this Section to the rights or privileges heretofore granted shall terminate, cease, and have no further effect on and after May 20th, 1953, as in this ordinance provided; (c) There shall be dedicated and grant- ed by petitioner to the City of Arcadia for a pub- lic alley or street, a strip of land twenty feet in width at the rear of said petitioner1s property.1I SECTION 3. That Ordinance No. 704 be amended as in Sec- tion 2 hereof set forth. SECTION 4. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) 2.
