ORDINANCE NO. 704
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, ~~KING A CONDITIONAL VARIANCE TO CERTAIN
PROVISIONS OF ORDINANCE NO. 439 OF SAID CITY OF ARCADIA,
ADOPTED JUNE 28, 1940.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS
FOLLOWS:
SECTION 1. Petition of WILBUR SMITH and LORRAINE B. SMITH
having been filed in the office of the Planning Commission of the

City of Arcadia, pursuant to the provisions of Ordinance No. 439
of said City, ad.opted June 28, 1940, asking that an exception be
made affecting the property described in said petition, and setting
forth the specific reasons therefor and the circumstances in con-
nection therewit.h, and recommendation having been made by said
Planning Commission to this Council and a full investigation and
consideration of the facts having been made by this Council
determines that there are exceptional or extraordinary circum-
stances or conditions applicable to the property involved and to
the intended USE'S theref that do not generally apply to the property
or classes of uses in the same zone or district in which said
property is located, and will not be inconsistent with the general,
purposes of said Ordinance No. 439, and that said property should
be excepted from the provisions of the ID ne created by said Or-
dinance No. 439 affecting said property, but only so far as herein-
after set forth;: and the requirements of said Ordinance No. 439,
pertaining to tlle consent of adjacent property owners having been
complied with;
This Councll, therefore, excepts from the provisions of the
respective zone of Ordinance No. 439 of the City of Arcadia the
propert;y- hereinnfter described, but only insofar as such exception
if necessary to permit the maintenance, and operation on the
following described property, to-wit:
The North one hundred fifty (150) feet of the Eas t ninety

or owners of said properties have been given written notice by said

and fifty-four one hundredths (90.54) feet of Lot six (6),
Tract No. 4090, as shown on Map recorded in Book 43, Page
47 of Maps, in the office of the County Recorder of said

This exception is granted upon the following conditions:
(a) That no building permit be granted for the erection or
construction of any of said buildings upon said properties unless
the plans and sFecifications be first submitted to the Building
Inspector of the City of Arcadia, and that said plans and
specifications a.nd said buildings shall in all particulars comply
with the building ordinances and sanitary regulations of the City
of Arcadia;
(b) That all the rights and privileges granted by this
Ordinance are accepted by the persons affected thereby upon the
express condition that this Ordinance granting the privileges
herein specified. shall terminate, cease and have no further effect
on and after May 20, 1953.
(c) That said properties shall not at any time be used for
any purpose or purposes not allowed in Zone R-2 of the City of
Arcadia, except as provided in this Ordinance;
(e) That in case any of the provisions of this Ordinance
are violated, tJ::,e properties above described shall revert to
Zone R-2 as defined in Ordinance No. 439, and the rights and
privileges herei,n granted shall cease and terminate in the event
that any such violation be not terminated within thirty days or
such further time as the City Council may decide that the owner

The City Clerk of said City shall certify to the
adoption of this; Ordinance and shall cause the same to be published

published and circulate1:r. 3aid city of Arcadia and hereby desig-
nated for that purpose, and thirty days from and after the passage
thereof the samo shall be in full force and effect.
I HEREBY CERTIFY that the foregoing Ordinance was adopted
at a regular meetine of the City Council of the City of Arcadia,
held on the 4th day of May, 1948, by the affirmative vote of at
least three Councilmen, to-wit:
AYES: Councilmen, Boucher, Ewing, Klomp, Nugent and Russell
