ORDINANCE NO. 705
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA
ESTABLISHING SET BACK LINES ON PORTIONS OF BALDWIN AVENUE,
FAIRVImV AVENUE AND ARCADIA AVENUE, BEING PUBLIC STREETS
IN T HE CITY OF ARCADIA.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1. Pursuant to Resolution of Intention No. 1751, and
after a public hearing pursuant to the provisions of said Resolution
of Intention, the City Council of the City of Arcadia, does hereby
determine that the public peace, health, safety, interest and
welfare require, and it is hereby ordered, that set back lines be
established On portions of Baldwin Avenue, Fairview Avenue and
Arcadia Avenue, being public streets in the said City of Arcadia,
as hereinafter designated.
SECTION 2. That it shall be unlawful for any person, firm or
corporation to erect, construct or locate any building or other
structure upon any lot or land fronting on the westerly side of
Baldwin Avenue from a point distant 238.34 feet northerly from the
northerly line of Duarte Road to the northerly line of the abandoned
Southern Pacific Railroad right of way in said City unless such
building or other structure be set back to a line which is distant
twenty (20) feet westerly from and parallel with the westerly line
of Baldwin Avenue.
SECTION 3. That it shall be unlawful for any person, firm or
corporation to erect, construct or locate any building or other
structure upon any lot or land fronting on the easterly side of
Baldwin AvenUe i~om a point distant 235.92 feet northerly from the
northerly line of Duarte Road to the northerly line of the abandoned
Southern Pacific Railroad right of way in said City unless such
building or othElr structure be set back to a line which is distant
fifteen (15) feElt easterly frop an! parallel with the easterly line
of Baldwin Avenue.

SECTION o. That it shall be unlawfUl for any person firm or
corporation to e:rect, construct or locate any building or other
structure upon any lot or land fronting on the southerly side of
Fairview Avenue from a point distant 100 feet westerly from the
westerly line of Baldwin Avenue to a point distant 100 feet easterly
fJ:'om the easterly line of Baldwin Avenue unless such building or
other structure be set back to a line which is distant ten (10) feet
southerly from and parallel with the southerly line of Fairview
Avenue.
SECTION 6. That it shall be unlawful for any person, firm or
corporation to erect, construct or locate any building or other
structure upon any lot or land fronting on Arcadia Avenue from the
westerly line of Baldwin Avenue to points distant 100 feet westerly
therefrom unless such building or other structure be set back to a
line which is distant either ten (10) feet northerly from and
parallel with the northerly line of Arcadia Avenue or distant tBn (10)
feet southerly from and parallel with the southerly line of Arcadia
Avenue.
SECTION 7. That all other portions of Ordinances in conflict
herewith be and the same are hereby repealed; that this repealing
clause is not intended to affect any other Ordinance or portion of
Ordinance in the City of Ardadia not in conflict with this Ordinance.
SECTION 8. That any person, firm or corporation violating any
of the provisions of this Ordinance shall be deemed guilty of a
misdemeanor and upon conviction thereof shall be punishable by a

fine not exceeding Five Hundred ($500.00) Dollars, or by imprison-
ment in the City Jail of said City of Arcadia, or in the County Jai~
of said County of Los Angeles, state of California, at the discretion
of the Committing Magistrate, for a period not exceeding Six (6)
months, or by both such fine and imprisonment; and each such person,
firm or corporation shall be deemed guilty of a separate offense for
each day during any portion of which the violation of or failure,
neglect or refusal to comply with any of the provisions of this Or-
dinance is committed, continued or permitted.
SECTION 9. The City Clerk shall certify to the adoption of
this Ordinance and prior to the expiration of fifteen (15) days from
the passage thereof, shall cause the same to be published once in the
Arcadia Tribune and Arcadia News, a newspaper of general circulation,
published and circulated in the City of Arcadia, and thirty (30) days
from and after the final passage thereof said Ordinance shall take
effect and be in force.
I HEREBY CERTIFY that the foregoing Ordinance was adopted at
a regular meeting of the City Council of the City of Arcadia, held
on the 4th day of May, 1948, by the affirmative vote of at least
three Councilmen, to-wit:
