Subject: Agreement Revision - Arboretum - City of Arcadia
The City Council adopted Resolution No. 3962 on October 3, 1967 approving an
Agreement between the State Department of Beaches and Parks, the Los Angeles County
and State Arboretum and the City of Arcadia, whereby the City of Arcadia would con-
struct a roadway within the Arboretum in lieu of payment for right-of-way required
for the Baldwin Avenue extension.
The Arboretum staff had concluded that sufficient benefit would not be derived
from the roadway construction to justify this project as called for by the existing
Agreement. The City Council, on an informal basis, indicated that revision of this
Agreement would be allowed to permit certain landscape work in lieu of roadway con-
struction in order to expedite the completion of the Santa Fe Depot restoration proj-
ect, as requested by the Arboretum.
The attached revised Agreement therefore calls for completion of certain land-
scape work not to exceed the amount contained in the cost estimate attached thereto.
The right-of-way acquired by the City was appraised at $34,500, and further by virtue
of work done in conformance with previous Agreement in preparation of roadway plans
and specifications, the City has incurred certain costs and inasmuch as that sum plus
the anticipated cost of the landscaping exceeds the amount of the appraisal, Dr.
William S. Stewart , Director of the Arboretum, has submitted the attached letter
guaranteeing that certain costs will be held within acceptable limits in order that
the total cost to the City not eceed the oriS.LIAL$34,500. The work done under this
Agreement is to be funded from prxesently allocated State Gas Tax Funds, and therefore
cannot exceed the amount of the original appraisal unless these funds are supplemented
by funds derived from a source other than gasoline taxes.
It is therefore recommended that the City Council approve subject Agreement and
authorize the Mayor to execute same in a form approved by the City Attorney.

Dear Mr. Cozad:
This will confirm the conversation I had this
morning with you and Mr. Chester Howard. At that time,
I assured you that in connection with the Santa Fe
Depot site development and landscaping, the Arboretum
would make every effort to aid the City of Arcadia
by supplying plant materials. i feel very sure that
using 'frees and shrubs from our nursery facilities,
Item 9 in the proposed contract agreement estimate can
. be held to the original estimate of $1 ,990 rather than
the $3,000 as now indicated.

further information on this matter.

AGREEMENT

2 THIS AGREEMENT, made and entered into this day of
3 , 1969, by and between the STATE of CALIFORNIA, acting through
4 the Department of Parks and Recreation, hereinafter called "STATE", and the
5 City of Arcadia, a Municipal Corporation, hereinafter called "CITY".
6 W I T N E S S E T H :
7 WHEREAS, STATE and CITY have entered into an agreement dated the
e 26th day of October, 1967, wherein the CITY agreed to construct a road facility
4 and appurtenant works described in Paragraph I of said agreement; and
10 WHEREAS, STATE desires to have CITY perform other work in lieu
11 thereof; and
12 WHEREAS, CITY is willing to perform the other work in lieu thereof;
13 NOW, THEREFORE, the parties hereto do covenant and agree as follows:
14 I. That Paragraph I of said agreement dated October 26, 1967 is hereby
15 deleted and there is substituted therefor the following: "CITY agrees to remov
16 existing plantingg, fencing, paving and irrigation system, and to install
17 landscape and sprinkler facilities and fence, all in accordance with the plans
18 and specifications attached hereto as Exhibit A, dated February 10, 1969, which
19 exhibit is incorporated herein for all purposes, and as further set forth in
20 the estimate of cost attached hereto as Exhibit C, dated February 10, 1969,

which exhibit is incorporated herein for all purposes. All costs for labor,
22 equipment and materials and any other costs are to be borne by the CITY, with
23 no cost or expense to the STATE; however, the cost shall not exceed the total
24 estimated costs as shown on Exhibit C."
25 2. That Exhibit A attached to said agreement dated October 26, 1967
26 is hereby deleted and there is substituted therefor the Exhibit A attached
27 I hereto, dated February 10, 1969.
