HomeMy WebLinkAbout0715 b....I..J-- ORDINANCE NO. 715 AN ORDINilN' CE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, CHANGING THE SETBACK LINES ON PORTIONS OF DUARTE ROAD, A PUBLIC STREET IN THE CITY OF ARCADIA. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Pursuant to Resolution No. 1766, and after a public hearing thereon" the City Council. of the City of Arcadia does hereby determine that the public peace, health, safety, interest and public welfare require" and it is hereby ordered, that the setback lines previously established at fifty (50') feet on portions of Duarte Road, a public Btreet in the City of Arcadia be changed and re- established as hereinafter designated. SECTION 2. That it shall be unlawful for any person, firm or corporation to orect, construct or locate any building or other struc- ture upon the follolving described parcel of land fronting on Duarte Road, being a ptililic street in the City of Arcadia, to wit: The east 90.54 feet of Lot 6, Tract No. 4090, as shown on map recorded in Book 43, page 47 of maps, records of Los Angeles COtlDty, unless the said building or other structure shall be set back to a line which is dlstant ten feet six inches (10'6") southerly and parallel with the southerly boundary of said Duarte Road. SECTION 3. That all other portions of Ordinances in conflict herewith be, and the same are hereby, repealed;. that this repealing clause is not intended to affect any other Ordinance or portion of Ordinance in the, City of Arcadia not in conflict with this Ordinance. SECTION 4. That any person, firm or corporation violating any of the provisior..s of this Ordinance shall be deemed guilty of a mis- demeanor and upon conviction thereof shall be punishable by a fine not exceeding Five Hundred Dollars ($500.00), or by imprisonment in the City Jail of' said City of Arcadia, or in the County Jail of the County of Los Angeles, State of California, at the discretion of the Committing Magistrate, for a period not exceeding six' (6) months, or by both fine and imprisonment; and each such person, firm or cor- poration shall be deemed guilty of a separate offense -1- for each day ,-" ~~ \~o'" ~/'/" '7//,- , during any port~lon of which the violation of or failure, neglect or refusal to comply with, any of the provisions of this Ordinance is committed, continued or permitted. SECTION 5. The City Clerk shall certify to the adoption of this' Ordinance and pI'ior to the expiration of fifteen (15) days from the passage thereof shall cause the same to be pUblished once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and c~lrculated in the City of Arcadia, and thirty days; from and after the finallpassage thereof said Ordinance shall take effect and be in force.
