ORDINANCE NO. 72a
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, tlAKING A PERMANENT EXCEPTION TO CERT~IN
PROVISIONS OF ORDINANCE NO. 439 OF SAID CITY OF ARCADIA,
ADOPTED JUNE 28, 1940.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS
FOLLO\"lS:
SECTION 1. Petition of J. A. KRA~~, having been filed in the
office of the Planning Commission of the City of Arcadia, pursuant
to the provisions of Ordinance No. 439, of said City, adopted June
28, 1940, asking that an exception be made affecting the property
described in said petition, and settine forth the specific reasons
therefor and the circumstances in connection therewith, and recom-
mendation having been made by the Planning Commission to this Counci~,
and a full investigation and consideration of the facts having been
made by this Council pertinent to this petition; this Council deter-
mines that there are exceptional or extraordinary circumstances or
conditions applicable to the property involved and to the intended
uses thereof t hat do not generally apply to the property or classes
of uses in the same zone or district in which said property is located,
and will not be inconsistent with the generallpurposes of Ordinance
No. 439, and that said property should be excepted from the provisions
of the rone created by said Ordinance No. 439, affecting said property,
but only so far as hereinafter set forth; and the requirements of said
Ordinance No. 439 pertaining to the consent of adjacent property
owners having been complied with;
This Council, therefore, excepts from the provisions of the
respective zone of Ordinance No. 439 of the City of Arcadia, the
property hereinafter described, but only insofar as such exception
is necessary to permit the construction and maintaining on the follow-
ing described property, to-wit:
A portion of lot 3, Tract No. 949, as shown on map recorded
in Book 17. page 13 of !iaps, records of Los Anceles County..

described as follows:
Beginning at a point in the North line of Huntington Drive
(80 feet wide) distant 402.2 feet West from t he West line
of Santa Anita Avenue; thence North 285 feet; thence West
to the East line of Morlan Place; thence South thereon to
a point distant 125 feet North from the North line of Hunt-
ington Driv,e;; thence East 60 feet; thence South 125 feet;
thence East 70.8 feet to the point of beginning.
of a storage warehouse, similar in construction and appearance to
the building shown in the photograpp attached and forming part of
the aforesaid petition.
This exception is granted upon ~he following conditions:
(a) That no building permit be granted for the construction
or erection of any building upon said property unless the plans and
specifications be first submitted to the Building Inspector of the
City of Arcadia, and that said plans and specifications and said
building shall in all particulars comply with the building ordinance
and sanitary regulations of the City of Arcadia.
(b) That said property shall not at any time be used for any
purpose or purposes not allowed in Zone C-2 of the City of Arcadia,
except as provided in this Ordinance.
(c) That in case any of the provisions of this Ordinance are
violated, the property above described shall revert to Zone C-2 as
defined in Ordinance No. 439, and the rights and privileges herein
Branted shall terminate and cease, in the event that any such
violation is not terminated within thirty days, or such further time
as the City Coun,~il may decide that the owner ,of said property, in
the exercise of due diligence, requires to correct such violation
after the owner of said property has been given written notice by
the city Council of such violation.
(d) That the entire ground level frontage on Huntington Drive
to a reasonable depth shall be devoted to retail business as provided

in Zone C-2.
(e) That all loading and unloading and ather operations shall
be conducted exclusively at the rear of the building.
SECTION 2. The City Clerk shall certify to the adoption of
this Ordinance and prior to the expiration of fifteen (15) days,
from the passage thereof, shall cause the same to be published
once in the Arcadia Tribune and Arcadia News, a newspaper of
gener>al circula,tion, published and circulated in the City of Arcadia,
and thirty (30) days from and after the final~assage thereof said
Ordinance shall take effect and be in force.
I HEREBY CERTIFY that the foregoing Ordinance was adopted at
a regular meeting of the City Council of the City of Arcadia, held
on the 20th day of July, 1948, by the affirmative vote of at least
three Councilmen, to wit:
