" ORDINANCE NO. 72S AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA CHANGING THE SETBACK LINES ON PORTIONS OF SANTA ANITA AVENUE, A PUBLIC STREET IN THE CITY OF ARCADIA. THE CITY COUNCIL OF THE CITY OF ARCnDIA, CALIF'ORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Pursuant to the provisions of Resolution of Intent- ion No. 178a, and after a public hearing thereon, the City Counci~ of the City of Arcadia does hereby determine that the public peace, h health, safety, interest and public welfare require, and it is here- by ordered, that the setback lines previously established on portions of Santa Anita Avenue, a public street in the City of Arcadia, be changed and re-established as hereinafter designated. SECTION 2. That it shall be unlawful for any person, firm or corporation to eI'ect, construct or locate any building or other structure upon the following described parcels of land fronting on Santa Anita Avenue, being a public street in the City of Arcadia, to wit: Lots 48, 49, 50, 51 and 52 of Haven Tract, as shown on map recorded in Book 13, pages 22 and 23 of Maps, records of Los Angeles County, unless the said building or other structure shall be set back to a line which is distant fifteen (15) feet easterly and parallel vdth the easterly boundary of said Santa Anita Avenue. SECTION 3. That all other portions of Ordinances in conflict herewith be, and the same are hereby, repealed; that this repealing clause is not intended to affect any other Ordinance or portion of Ordinance in the City of Arcadia not in conflict with this Ordinance. SECTION 4. That any person, firm or corporation violating any of the provision:3 of this Ordinance shall be deemed guilty of a mis- demeanor and upon conviction thereof shall be punishable by a fine not exceeding Five Hundred Dollars ($500.00), or by imprisonment in the City Jail of said City of Arcadia, or in the County Jail of the County of Los Angeles, State of California, at the discretion of the -1- 'NOs<EG (/-("./ 7.::<?,;5' Committing Magistrate, for a period not exceeding six (6) months, or by both fine and imprisonment; and each such person, firm or cor- poration shall be deemed guilty of a separate offense for each day during any portion of which the violation of or failure, neglect or refusal to comply with, any of the provisions of this Ordinance is' committed, continued or permitted. SECTION 5. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof :3hall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia, and thirty days: from and after the final passage thereof said Ordinance shall take effect and be in force.
