AN ORDnlANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA REGULATING THE SLAUGHTERING OF RABBITS, POULTRY AND D01ffiSTIC FOV~S IN THE CITY OF ARCADIA, AND FIXING PENALTIES FOR THE VIOLATION THEREOF. THE CI~~ COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: SECTION 1. The term "slaughter house", herein referred to, shall be a business where anyone slaughters more than three (3) fowls and/or three rabbits per day for other than personal use. The word "person" when used in this ordinance shall include an individual, firm or corporation, or any association of one or more persons, and the singular number shall include the plural and the plural the singular. SECTION 2. It shall be unlawfUl for any person to construct, operate, or mai.ntain a slaughter house in the City of Arcadia except within a buildi.ng whi3h shall be constructed and maintained in accordance with the following regulations: (a) All floors shall be of material impervious to water; (b) The floor in the slaughtering room shall be constructed so as to slope to a floor drain and this floor drain shall be connected to a sanitary sewer, cesspool or septic tank; (c) The walls and ceiling of the slaughtering room shall be constructed of smooth surfaced cement plaster at least three eighths (3/8) of an inch thick, or other material satisfactory to the Health Officer, which can withstand severe and repeated cleansing; (d) The walls in the holding room or rooms for live poultry, fowls or rabbits shall be constructed of smooth surfaced cement plaster at least three-eighths (3/8) of an inch thick, or other material satisfactory to the Health Officer, which can withstand severe and repeated cleansing to a height of not less than six (6) feet from the floor; (e) All edges at the junction of the floors and 1" ,~? ad 7~/ walls in slaughtering and holding rooms shall be covered or rounded to facilitate cleaning; (f) All rooms shall be well lighted and ventilated; (g) ,1\11 equipment shall be constructed of metal, except cutting blocks; (h) ~o poultry or rabbits shall be permitted to run at large; (i) 'rhe entire premises of all slaughter houses shall be kept in a clean and sanitary condition at all times and the proper disposal of all waste shall be maintained. SECTION 3. The owner, operator or manager of any existing slaughter house shall within thirty (30) days following the effective date of this ordinance file with the City Clerk an application to continue to conduct the same, upon a form approved by the City Council, giving the name of the owner or owners, manager or managers thereof, the location, and such other information as the City Council may require for the administration of this ordinance. SECTION 4. The application shall include a signed statement that such applicant will observe the rules and regulations of this ordinance and will, within a reasonable time, not to exceed one (1) month, make any and all changes in construction that are required by this ordinance. SECTION 5. Following receipt of the application, the Health Officer shall mE.ke or cause to be made an inspection of the premises and if the provisions of this ordinance have been complied with, he shall certify that fact to the applicant and to the City Clerk who shall issue a permit to operate. SECTICN 6. Any person intending to operate a slaughter house which is not in existence on the effective date of this ordinance, shall before opening or operating such establishment make application to the City Clerk upon a form provided by such City Clerk, giving the names of the owner or owners, manager or managers thereof, the location, and -2- UAc/ 7~;? such other information as the City Council may require for the administration of this ordinance. The application shall include a signed statement that such applicant will observe the rules and regulations of this ordinance. Following receipt of application the Health Offi<:er shall make or cause to be made an inspec tion of the premises and if the provisions of this ordinance and all other pertinent laws ~nd/or ordinances have been complied with he shall certify that fact to the applicant and to the City Clerk who shall issue a permit t,o operate. SECTION 7. Every application for a permit provided for under Sections 3 and 6 hereof shall be accompanied by a fee of Ten Dollars ($10.00) to cover the cost of investigation. No permit to operate shall issue until this fee is paid. SECTION 8. Every permit provided for, under the provisions of this ordinance, shall at all times be prominently displayed in the place of business for which it was issued. SECTION 9. No permit to operate, as provided under Section 6 shall be issued until all the provisions of this ordinance, as well as all other ordinances of the City of Arcadia and all laws of the State of California relating to construction and equipment of, and pertaining to, slaughter houses have been complied with. No permit issued under the:le provisions shall be transferable. SECTION 10. If it is determined by the Health Officer fol- lowing any investigation or inspection of a slaughter house that the operator, owner or manager has not complied with the rules and regulations of this ordinance, particularly the health and sanitary rules and regulations, the City Council may immediately suspend and pick up the permit issued to operate. The City Council shall grant the owner or operator a reasonable specified time in which to correct the conditions which are in violation of this ordinance and if the corrections are not made to the satisfaction of the City Council within -3- (/A..c-/ 7 x:';7 the specified tim.e, the City COWlcil shall revoke the operator's permit. SECTION 11. The o\'mer, operator or m.anager of any slaughter house for which the permit to operate has been suspended shall be required to corre,ct completely the conditions on which the City COWlcil based the suspens,ion of the permit. In applying for a reinstatement of this permit, his application shall include a signed statement that the conditions complained of by the Health Officer have been completely corrected. In case a permit has been revoked, it may not be reinstated; and any applicatlon for a new permit shall be made as provided in Section 6. SECTION 12. Every person keeping, maintaining or being in charge of any slE..ughter house shall keep the same in a clean and wholesome conditlon. SECTION~ Any person who shall violate any of the provisions of this ordinance" or who shall fail, refuse or neglect to comply with any of the requirements of this ordinance, shall be guilty of a mis- demeanor and upon conviction thereof shall be pWlished by a fine of not more than Three HWldred Dollars ($300.00) or by imprisonment in the City Jailor in the Los Angeles COWlty Jail, at the discretion of the committing magist.rate, for a period of not exceeding three ()) months, or by both such fine and imprisonment. SECTION 14. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be publiShed once in the Arcadia TribWle and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia, and thirty days from and after the final passage thereof said Ordinance shall tw{e effect and be in force.
