HomeMy WebLinkAbout0730 . .",1 1,- \' ORDINANCE NO. 730 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, CHANGING THE SETBACK LINES ON PORTIONS OF HUNTINGTON DRIVE, A PUBLIC STRE~T IN THE CITY OF ARCADIA. THE CITY COUNCIL OF THE CITY OF ARChDIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Pursuant to Resolution No. 1794, and after a public hearing thereon, the City Council of the City of Arcadia does hereby determine that the public peace, healtp, safety, interest and public welfare require, and it is hereby ordered, that the setback lines pre- viously established at thirty-five (35) feet on portions of Huntington Drive, a public street in the City of Arcadia be changed and re-estab- lished as hereinafter des igna ted. SECT:ON 2. That it shall be unlawful for any person, firm or corporation to erect, construct or locate any building or other structure upon the following described parcels of landfrontine on Hun- - tington Drive, being a public street in the City of Arcadia, towit: Lots 1, 2, and 3, of Tract No. 6985, as shown on map recorded in Book 106, at Page 53 of Maps, records of Los Angeles County, unless the saic building or other structure shall be set back to a line which is distar.t fifteen (15) feet southerly and parallel with the southerly boundary of said Huntington Drive. SECTION 3. That all other portions of Ordinances in conflict herewith be, and the same are hereby repealed; that this repealing clause is not intended to affect any other Ordinance or portion of Ordi- nance in the City of Arcadia not in conflict with this Ordinance. SECTI.:m 4. That any person, firm or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a mis- demeanor and upon conviction thereof shal1be punishable ~y a fine not exceeding Five Hundred Dollars ($500.00), or by imprisonment in the City Jail of said City of Arcadia, or in the County Jail of the County of Los Angeles, State of California, at the discretion of the Committing Magistrate, for a period not exceeding six (6) months, or by both suc~ fine and imprisonment; and each such person, firm or corporation g~~ ,... ac"/7J'O shall be deemed guilty of a separate offense for each day during any portion of which the viQlation of or failure, neglect or refusal to comply with, any of the provisions of this Ordinance is committed, con- tinued or permitted. SECTION 5. The City Clerk shall certify to the adoption 0 f this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia, and thirty days from and after the final passage thereof said Ordinance shall take effect and be in force.
