ORDINANCE NO. 731 ' ":\ 1-;: c \" AN ORDINANCE OF THE CITY OF ARCADIA A1lliNDING NO. 497 (THE LICENSE ORDINANCE) OF SAID CITY ING SECTION 28 THEREOF. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: \ - SECTION I. That Section 28 of Ordinance No. 497 of the City of Arcadia, er,titled "An Ordinance of the City Council of the City of Arcadia, Providing for Licensing and Regulating the Carrying on of Certain Business, Professions, Trades, Callings and Occupations Within Said City of Arcadia and Repealing Ordinances Nos. 232, 245, 268, 403 and 429." adopted on the 17th day of November, 1942, be and the same j.s hereby amended to read as follows: SECTION 28. PEDDLING m~D SOLICITING CERTAIN TYPES OF ShL~S. ,J~~~~131 1. (a) Every person selling, offering for sale, or soliciting o~~. for the sale of, by means of peddlers, any sheet, dodger, handbill, circular, letter, booklet, or any other printed, typewritten, mimeo- graphed or wr~tten matter of any kind, pertaining to any horse race, choice of a horse or horses, recommending any horse or horses, or giving or conveying any information about any horse, horse race or contest of endurance or speed between horses or beasts, and whether at a fixed place of business ~ithin said city or otherwise, shall pay a license fee of Six Hundred ($600.00) Dollars per ninety day period; provided however, that the provisions of this subdivision (1) of this Section shall not prohibit, or require a license, or the payment of a fee, for the s ale, distribution or delivery of news- papers of gener~l circulation, as defined by Section 4460 and 4462 of the Political Code of the State of California, nor shall said provisions apply within any racing enclosure duly licensed by the State of California, to conduct horse racing under and in accordance with the laws of said State relating to such matters; nor to sales of such materials or items made by a merchant duly licensed by the City of Arcadia, provided such sales are made only inside a building '!o,.<"'~ I\~ '\ 't-(S~ ".. \ r:J~<i>' -l- ~EPE:\:.ED (j 31 m\D,I-O. (b) That any person licensed under the provisions of this Section (1) shall be entitled to sell, solicit for the sale of, or offer for sale, said materials through not more than six (6) persons during any da:l'; provided however, that no person shall be entitled to act for and on behalf of such licensee until such licensee has filed with the Chief of Police of the City of Arcadia, the name, address and photograph of the person so authorized to act. (c) No person shall, in the selling, soliciting for sale, or offering for sale of said materials, interfere with or cause interference with the normal flow of traffic upon the public streets of Arcadia. por the purpose of preventing congestion in traffic upon the public streets of the City of Arcadia, the location occupied by any person in the conduct of such business shall be subject to the ap- proval of the Chief of Police of the City of Arcadia. M. of said day. 2. Upon written application filed with the City Clerk request- ing such extension (accompanied by the required extension fee) the City Council of said city may in its discretion grant an extension of the ninety day periods referred to herein for either: (a) An additional thirty day period immediately following said ninety day pe~iod; or (b) An additional sixty day period immediately following said ninety day pe~iod; provided that if said Council grants such thirty day extension an additional tpeJ?mit fee in the sum of Two Hundred ($200.00) Dollars must be paid by permittee for such thirty day extension; and if ,~~ 113 f\ 'I;.'{/'" \~O' \ \ "'~~. -2- tv.t.""~ 131 \); II \\0' II" . r;hd 70/ said Council grants such sixty day extension an additional permit fee in the amount of Four Hundred (~400.00) Dollars must be paid by permittee for such sixty day extension. No extension shall be valid unless and until such additional fee is paid. 3. Every person, not having a fixed place of business in the city, who tra'i1els from place to place, or house to house, and makes demons tra tion;3 of, or solicits, takes orders or canvasses for the sale of, or wJl0 sells any goods, wares, merchandise, subscriptions to periodicals or magazines or things or articles of value of any nature, kind or description (not hereinabove mentioned in subdivision (1) of this S.~ction) shall pay a license fee of Ten (~10.00) Dollars per month. SECTION :2. That Ordinance No. 534 of the City of Arcadia, f"'p I,e, 1,'/"1) ~~?:JI Lt, 7~1 adopted November 28, 1944, be and the same is hereby repealed. ~<t,'" <s<.J' ~o' (\ \"~\)'1 j I SECTION :5. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general cir- culation, published and circulated in the City of Arcadia~ and thirty (30) days from and after the final passage thereof said Ordinance sllall take effect and be in force.
