ORDINANCE ~ O. 735
AN ORDINANCE OF THE CITY COUNCIL OF ThE CITY OF ARCADIA, STATE
OF CALIFORNIA, MAKING A PERMANENT EXCEPTION TO CERTAIN PROVISIONS OF
ORDINANCE NO. 439 OF SAID CITY OF ARCADIA ADOPTED JUNE 28, 1940.

Does ORDAIN AS FOLLOWS:

SECTION 1. Petition of Rancho Santa Anita, Inc., a corpora-
tion, having been filed in the Office of the Planning Commission of the
City of Arcadia, pursuant to the provisions of Ordinance No. 439 of
said City, adopted June 28, 1940, requesting that a permanent exception
be made to the provisions of Zone R-l now affecting the property des-
cr~bed in said petition, and setting forth the specific reasons there-
for and the circumstances in connection therewith, and recommendation
having been made by said Planning Commission to this Council, and a
full investigation and consideration of the facts having been made by
this Council pertinent to this petition; this Council determines that
there are exceptional or extraordinary circumstances or conditions
applicable to the property involved and to the intended uses thereof
that do not generally apply to the property or classes of uses in the
same zone or district in which said property is located, and will not
be inconsistent with the general purposes of said Ordinance No. 439
affecting said property, and that said property should be excepted
from the provisions of the zone created by said Ordinance No. 439
affecting said property, but only in ao far as hereinafter set forth;
and the requirements of said Ordinance No. 439 pertaining to the consent
of owners of prope:r'ty adjacent to the property herein described having
been complied with:
This Council, therefore, excepts from the provisions of Zone
R-l of Ordinance No. 439 of the City Council of. the City of Arcadia,
the property here~~after described, but only in so far as such excep-
tion is necessary to permit the following described property, to-wit:
That portion of Lot 1 of Tract No. 949 in the City of
Arcadia, County of Los Angeles, state of California, as shown
on map recordtld in Book 17, Page 13, of Maps, records of said
County, described as follows:

Beginning at a point in the Westerly line of Tract No.
14745 as shown on map recorded in Book 304, Pages 34 and 35
of Maps, recQrds of said County, distant South 00 471 43"
East, thereon, 17.98 feet from the Northwest corner of Lot
22 of said T:t'act No. 14745; thence South 00471 4311 East,
along the Westerly line of said Tract No. 14745 and the
Southerly prolongation thereof, 476.91 feet, to the inter-
section with a curve concave to the Southeast and having a
radius of 430.00 feet; thence Westerly along said curve,
100.99 feet, to the beginning of a reverse curve concave
to the Northeast and having a radius of 20.00 feet; thence
Northwesterly along said curve 31.09 feet, to its tangent
intersection with the Northeasterly line of Colorado Place
(80 feet in width), as it now exists; thence North 300 33'
1611 West, along the Northeasterly line of said Colorado Place
315.49 feet, to the beginning of a tangent curve concave to
the southeast and having a radius of 20.00 feet; thence North-
easterly along said curve 30.11 feet, to the beginning of a
reverse curve concave to the Northwest and having a radius
of 180.00 feet; thence Northeasterly along said curve 177.78
feet; thence North 00 47; 43" West, tangent to said last
mentioned curve 66.67 feet; thence North 890 121 17" East,
190.00 feet to the point of beginning.
to be used and occupied for the following purposes, to-wit:
(a) (1) For the construction of a two-story frame, stucco
and brick veneer building thereon, the first story to be 11,000 square
feet more or less in area, and the second story to be 1,700 square
feet more or less in area.
(2) For the maintenance, operation and use of the first
story of said building as a restaurant, cocktail lounge and coffee
shop.

(3) For the maintenance, operation and use of the second
story of said building of 24 feet by 70 feet, more or less in dimen-

sion, as a banque.t room.
(b) For the construction of one or more frame, stucco and
brick veneer building or buildings, aggregating 12,000 square feet
more or less in area, on petitioner's property, and the maintenance,
ope~ation and use of said building or buildings as an hotel containing
an office and lobby, together with guest rooms convertible into suites
of vllI'ious sizes.
(c) For the construction, maintenance and use of a swimming
pool for the convenience of guests of said hotel. Said pool sh~l be
22 feet by 40 feet more or less in dimension.
(d) For the construction, maintenance and use of automobile
parking space adjacent to said restaurant building, said space to be
42 feet by 300 feet more or less in dimension, and containing not less
than 12,500 square feet in area, to be made available for the parking
of automobiles by customers of said restaurant.
(e) For the construction, maintenance and use of automobile
parking space in the rear of said hotel, said space to be 25 feet by
225 feet more or less in dimension, lll1d containing not less than 5,600
square feet, and construction, maintenance and use of similar auto-
mobile parking space on said property east of hotel building 100 feet
by 100 feet more or less in dimension, and containing not less than
10,000 square feet in area, to be made available for parking of auto-
mobiles by guests of said hotel.
(f) The uses described herein are in addition to and shall
not be a limitation upon the uses heretofore allowed under the provisions
of Ordinance No. 439 of the City of Arcadia, adopted on June 28, 1940.
(g) The construction of a solid wall or fence not less than
six feet high on said property and along the easterly line thereof,
and the landscaping of said property adjacent to said fence or wall
by the planting of suitable plants or shrubs in order that said fence
or wall may serve as an effective barrier between said property of
Petitioner and other real property immediately to the east thereof.
SECTION 2. This exception is granted upon the following con-
ditions:

(a.) That all improvements permitted or required by this
ordinance shall be constructed substantially in accordance with the
general plan now on file in the office of the Planning Commission
of the City of Arcadia, and provided further that the construction of
all such improvements shall be commenced within three months from the
effective date of this ordinance, and shall be completed substantially
in accordance with the plan forming part of aforesaid petition within
two years from the effective date thereof, delays caused by acts of God
and circumstanfes or conditions not under the control of petitioner,
its grantees, lessees or assignees excepted.
(b) That no building permit be granted for the construction
or erection of any building upon said property unless the plans and
specifications be first submitted to the Building Inspector of the City
of Arcadia, and t:~at said plans and specifications and said building or
buildings shall in all particulars comply with the building ordinances
and sanitary regulations of the City of Arcadia.
(c) That said property shall not at any time be used for any
purpose or purposes not specified in this ordinance.
(d) That in the event any of the provisions of this ordinance
are violated, the property abovd described shall revert to Zone R-l, as
defined in Ordinance No. 439, and the rights and privileges herein granted
shall terminate aJ~d cease in the event any such violation is not ter-
minated within thirty days or such further time as the City Council may
decide that the owner of said property, in the exercise of due diligence,
requires to correet such violation, after the owner of said property has
been given writtell notice by the City Council of such violation.
SECTION 3. The City Clerk of said city shall certify to the
adoption of this ordinance and prior to the expiration of fifteen (15)
days from the passage thereof shall cause the same to be published once
in the ArcadiaTribune and ArcadiaNews, a weekly newspaper of general
circulation, published and circulated in the City of Arcadia, and here-
by designated for that purpose, and thirty days from and after the pas-
sage thereof, the same shall be in full force and effect.
