Arcadia City Council Chambers The Planning Commission of the City of Arcadia met in regular session on Tuesday, October 11, 2011, at 7:00 p.m., in the Council Chambers of the City of Arcadia, at 240 W. Huntington Drive with Chairman Baerg presiding. PLEDGE OF ALLEGIANCE Chairman Baerg led the Pledge of Allegiance. ROLL CALL: PRESENT: Commissioners Baderian, Beranek, Chiao, PerriIle, and Baerg ABSENT: None OTHERS ATTENDING Deputy Development Services Director /City Engineer, Phil Wray Community Development Administrator, Jim Kasama Economic Development Manager, Jerry Schwartz Assistant Planner, Tim Schwehr Assistant Planner, Nick Baldwin Senior Administrative Assistant, Billie Tone SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS There were none. TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO ADDRESS THE PLANNING COMMISSION ON NON - PUBLIC HEARING MATTERS — Five - minute time limit per person There were none. PUBLIC HEARINGS 1. CONDITIONAL USE PERMIT NO. CUP 11 -12 121 Alice St and 700 S. First Ave. Mr. Jerold Hazerot on behalf of the Arcadia Presbyterian Church The applicant is requesting a Conditional Use Permit to allow the existing church to expand its uses to include a 150 - student music school to be operated in existing classrooms at 121 Alice Street and to change the use of a counseling center to a single - family residence at 700 S. First Avenue. RECOMMENDATION: Conditional Approval Assistant Planner, Nick Baldwin, presented the staff report. Commissioner Baderian asked if an additional Conditional Use Permit would be required if the Church decides to include a battered women's shelter at this site. Mr. Baldwin explained that the shelter was mentioned only as an example of the type of service that could be offered but the church has no current plans to open a shelter at this time. However, Mr. Kasama explained that a battered women's shelter would be regulated by the State and therefore, a Conditional Use Permit would not be required. Commissioner Baderian asked if approval of CUP 11 -12 would constitute approval of this type of use from the City and Mr. Kasama said that it would. Commissioner Baderian also asked if the facility meets all handicapped accessibility requirements and Mr. Kasama explained that handicapped accessibility is regulated through the plan check and permitting process. The Public Hearing was opened. Chairman Baerg asked if anyone would like to speak in favor of this project. Mr. Jerold Hazerot represented the church and offered to answer any questions the Commissioners had on the project. He explained that the main objective of the project is to establish a music school on campus for the church members and any others who may be interested. He noted that the church has the space for this type of use and that they feel a music school would be a welcome addition to the community and at the same time would provide an opportunity for outreach into the community. Mr. Hazerot mentioned that the church already has a State - regulated Child Development Center and that they have a well - established history of compliance with all State and local regulations. Commissioner Beranek asked Mr. Hazerot if he had reviewed the staff report and was in agreement with all recommendations. Mr.Hazerot answered afirmatively. Chairman Baerg asked if anyone wanted to speak in opposition to this project. There were none. MOTION It was moved by Commissioner Pamlle, seconded by Commissioner Beranek to close the Public Hearing. Without objection the motion was approved. MOTION It was moved by Commissioner Beranek, seconded by Commissioner Perri Ile to approve Conditional Use Permit No. CUP 11 -12 subject to the conditions in the staff report. ROLL CALL AYES: Commissioners Baderian, Beranek, Chiao, Pamlle and Baerg NOES: None A Resolution reflecting the decision of the Planning Commission will be presented for adoption at the next Commission meeting. First Ave. Arcadia Redevelopment Agency The applicant is requesting a Conditional Use Permit to allow a 786 square -foot personal service use (hair salon). RECOMMENDATION: Conditional Approval Assistant Planner, Tim Schwehr, presented the staff report. The Public Hearing was opened. Chairman Baerg asked if anyone would like to speak in favor of this project. Ms. Donna Bland, owner of the hair salon, offered to answer any questions the Commissioners had on the project. Chairman Baerg asked if anyone wanted to speak in opposition to this project. There were none. MOTION It was moved by Commissioner Baderian, seconded by Commissioner Chiao to close the Public Hearing. Without objection the motion was approved. MOTION It was moved by Commissioner Baderian, seconded by Commissioner Parrille to approve Conditional Use Permit No. CUP 11 -15 subject to the conditions in the staff report. MINUTES OF SEPTEMBER 13, 2011 RECOMMENDATION: Approve MOTION It was moved by Commissioner Beranek, seconded by Commissioner Baderian, to approve the minutes of September 13, 2011, as submitted. MODIFICATION COMMITTEE AGENDA Chairman Baerg reported that the Modification Committee reviewed three items this morning including a parking modification for a chiropractic office at Arcadia Landmark and a modification for a home addition. These two items were approved but the third item, for removal of two healthy oak trees, was referred to the Planning Commission. MATTERS FROM STAFF & UPCOMING AGENDA ITEMS Mr. Kasama said that the oak tree removal permit that was referred by the Modification Committee and two Resolutions from this meeting will be scheduled for the next meeting. He asked if all the Commissioners expect to be present for the November 22 meeting which is two days before Thanksgiving. All the commissioners said they expect to be present.
