HomeMy WebLinkAbout0738 . ..- \,; '0 ORDINANCE NO. 738 AN ORDINANCE OF THE CITY COU~CIL OF THE CITY OF ARCADIA, CLASS- IFYING CERTAIN REAL PROPERTY FOR ZONING PURPOSES AND ~STABLISH- ING SAID PROPERTY IN ZONE R-l AND ZONE R-3 OF SAID CITY AS DEFINED IN ORDINill~CE NO. 439 OF tHE CITY OF ARCADIA, ADOPTED JUNE 28, 1940, AND ~~KING A PERhlliNENT EXCEPTION TO CERTAIN PROVISIONS OF SAID ORDINANCE NO. 439. THE CITY COUNCIL OF THe CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS ?OLLO\'iS: SECTION 1. pursuant to the written request of the owners of the hereinafter des<:ribed real property, and upon the recommendation of the Planning Cotwission of the City of Arcadia, the portion of said real property not now 20 ned R-l and consis ting of a triangular parcel of land located approximately 100 feet south of Duarte Road beginning 125 feet east of' Santa Anita Avenue and continuing to a pOint 150 feet west of First Avenue, is hereby established as a district in Zone R-l under the provisions of Ordinance No. 439 of the City of Arcadia, adopted June 28, 1940, and from and after the effective date of this ordinance said real property shall become and be a portion of the district as herein indicated. Said real property is more particularly described as follows: A portion o~ Lot 2, Santa Anita Colony, as shown on map recorded in Book 42, page 87, miscellaneous records of Los Angeles county, described as follows: beginning North 00 22' 30" west 347 feet and North 890 37' 45" East 125 feet from the southwest corner of said Lot: Thence North 890 37' 45'" East 586.84 feet: Thence North 00 22.' 30" West 86.44 feet: Thence southwest to a point North 00 22' 30'" West 48.42 feet from beginning: Thence South 00 22' 30" East 48.42. feet to beginning, being a portion of Lots 2 to 11, inclusive of proposed Trace No. 13252. SECTION 2. pursuant to the written request of the owners of the hereinafter described real property, and upon the recommendation of the P~anning Commission of the City of Arcadia, said real property is -1- J 1ND!iXr!> /J' -/= ('/' hereby establish-3d as a district in Zone R-:5. under the provisions of Ordinance No. 439 of the City of Arcadia, adopted June 28, 1940, and from and after t~e effective date of this Ordinance said real prop- erty shall become and be a portion of the district as herein indicated. Said realLproperty is more particularly described as follows: Portions of Lot 2, Santa Anita Colony, as shown on map recorded in Book 42, page 87, Miscellaneous Records of Los Angeles, County, described as follows: p. - ~El no. l=i Beginning North 00 22.' 30"' wes t 185 feet and North 890 37' 45"' east 150 feet from the southwest corner of said lot: Thence North 890 37' 45'" East 561.84 feet: Thence North 00 22' 30"' west 137.69 feet; Thence South 890 37' 45" West 561.84 feet;; Thence South 00 22) 30.11: East 137.69 feet to beginning, being Lots 17 to 23 inclusive, of proposed Tract No. 13252. SECTION 3. Petition of ANNA M. REXINGER and INGEGERD ISAKSON, having been filed in the office of the Planning Commission of the City of Arcadia, pursuant to the provisions of Ordinance No. 439, of said City, adopted June 28, 1940, asking that an exception be made affect- ing the property described in said petition, and setting forth the specific reasons therefor and the circumstances in connection there- with, and reco~endation having been made by the Planning Commission to this Council, a nd a full investigation and consideration of the facts having been made by this Council pertinent to this petition;; this Council determines that there are exceptional or extraordinary circumstances or conditions applicable to the property involved and to the intended uses thereof that do not generally apply to the property or classes of uses in the same IDne or district in which said property is located, and uil1 not be inconsistent with the gen- erallpurposes of Ordinance No. 439, and that said property should be excepted from the provisions of the zone created by said Ordinance No. 439, affecting said property, but only so far as hereinafter set -2- /> '/-r:;>f/ forth; and the requirements of said Ordinance No. 439 pertaining to the consent of adjacent property owners having been complied with. This Council, therefore, excepts from the provisions of the respective zone of Ordinance No. 439 of the City of Arcadia, the p~operty hereinafter described, but only insofar as such exception i$ necessary to permit the maintaining on the following described p~operty, as reclassified and established herein in Zone R-l of said city, to wit: A portion of Lot 2, Santa Anita Colony, as shown on map recorded in Book 42, page 87, Miscellaneous Records of Los Angeles, County, described as follows: Beginning No:t'th 00 22' 30fT west 347.69 feet and North 890 37' 45tt :East 125 feet from the southwest corner of said lot: Thence North 890 37' 45'" East 586.84 feet: Thence North 00 22' 30" West 86.44 feet: Thence south- west to a point North 00 22' 30" 'ilest 48.42. feet from beginning: 'rhence South 00 22' 30'" East 48.42 feet to beginning, being a portion of lots 2 to 11, inclusive, of proposed 'rract No. 13252, of anopen area used for the parking of automobiles and available for pUblic or quasi-public use. This exception is granted upon the following conditions: (a) That no building permit be granted for the construction of erection of any b'.lilding upon said property unless the plans and specifications be first submitted to the Building Inspector of the City of Arcadia, and that said plans and specifications and said build- ing shall in all particulars comply with the building ordinance and sanitary regulations of the City of Arcadia. (b) That such parking area shall be paved with an asphaltic or concrete surfacing and shall have appropriate bumper guards where needed. Any lights used to illuminate said parking area shall be so arranged as to reflect the light away from adjoining premises in a residential zo nee (c) That said property shall not at any time be used for any -3- /7. ~/ ~'?.v purpose or purpo:3es not allowed in Zone R-l of the City of Arcadia, except as provid.3d in t his Ordinance. (d) That in case any of the provisions of this Ordinance are violated the property above described shall revert to Zone R-l as defined in Ordinance No. 439, and the rights and privileges herein granted shall terminate and cease in the event. that any such violation is not terminated Vii thin thirty days, or such further time as the City Council may decide that the owner of said property in the exercise of due diligence, requires to correct such violation after the owner of said property has been given written notice by the City Council of such violation. SECTION 4. The City Clerk shall certify to the adoption of this: Ordinance and prior to the exp ira tion of fifteen (15) days from t he passage thereof, shall cause the same to be pUblished once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. I HBREBY CEH'rIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 7th day of December, 1948, by the affirmative vote of at least three Councilmen, to wit: AYES; NOES; ABSENT: Councilmen, None None Boucher, C Nugent and RUBsell a SIGNED and APPROVED ATTEST; ia.
