OF' CALIFORNIA, j,IAKIHG A PER!.IANENT EXCEPTION TO CER- TAIN PRCVISIons OF ORDIKANCE NO. 439 OF SAID CITY OF ARCADIA ADOPTED JUNE 28, 1940. THE CITY COUNCIL OF THE: CITY OF ARCADIA, STATE OF CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Petition of John D, Myers and F. S. Myers, havirg been filed in the office of the Planning Commission of the City of Arcadia, pursuant to the provisions of Ordinance No. 439 of said City,adopted June 28, 1940, requesting that a permanent exception be made to the provisions of Zone R-l now affecting the property described in said petition, and setting forth the specific reasons therefor and the circumstances in connection therewith, and report having been made by said Planning Commission to this Council, and a full investigation and consideratirn of the facts having been made by this Coun(:il per tinent to this peti ti!l:l; ,this Council determine s that there are exceptional or extraordinary circumstances or con- ditions applicable to the property involved and to the intended uses thereof that do not generally apply to the property or classes of uses in the same :i\one or district in which said property is located, and will not be inconsistent with the general purposes of said Ordinance No. 439 affeeting said propert;y, and that said property should be excepted from the provisions of the zone created by said property, but only in so far as hereinafter set forth; and the requirements of said Ordi:::lance No. 439 pertaining to the consent d: owners of pro- perty adjacent to the property herein described having been complied with: This Council, therefore, excepts from the provisions of Zone R-l ,c of Ordinance No. 439 of the Citj Council of the City of Arcadia, the property hereinafter described, but only in so far as such exception is necessary to permit the following described property, towit: That ce~tain real property in the City of Arcadia, County of Los Angeles, State of California, more particularly described as Lots 3 to 18 inclusive, of Tract No. 14172, as recorded in Book 331, -1- od'727Y at pages 30 and 31 of Maps, in the County Recorder's Office of said County, to be used and occupied for the following purposes, towit: For the construction, maintenance, use, alteration, repair and/or enlargement of not more than one single family dwelling, together with the usual accessories necessary or incidental to the use 0 f such dwelling, on any building si te contained wi thin the boundaries of any portion of such lot or adjoining lots of Petitioners' property des,:ribed herein, subject, however, to the following con- di tions : (a)' Each such dwelling shall have not less than 800 square feet in area; (b) Each such building site shall contain not less than 5,000 square feet in area; (c) Each such building site shall have a width of not :.ess than 68 feet measured along the front building line of such building site. SECTION 2. This exception is granted upon the following condi- tions: (a) That all improvements permitted or required by this ordinance shall be constructed substantially in accordance with the plot now on file in the office of the Planning Commission of the City of Arcadia, and provided further that the construction of all such improvements shall be commenced wi thin three months from the effective da';e of this ordinance, and shall be completed substantially in accordance with the plan forming part of aforesaid petition within one year from the effective date thereof, delays caused by acts of God and circumstances or conditions not under the control of pe- titioners, excepted. (b) That no building permit be granted for the construction of or erection of any building upon s aid property unless the plans and specifications be first submitted to the Building Inspector of the City of Arcadia, and that said plans and specifications and said building or buildings shall in all particulars comply wi th the building -2- dx-ci. 7 t/ f> ordinances and sanitary regulaDions of the City of Arcadia. (c) Th~t said property shall not at any time be used for any purpose or purposes not specified in this ordinance. (d) That in the event any of the provisions of this ordinance are violated, the property above described shall revert to Zone R-l as defined in Ordinance No. 439, as amended, and the rights and pri- vileges herein granted shall terminate and cease in the event any such violation is not terminated within thirty days or such further time as the City Council may decide that the owner of s aid property, in the exercise of due diligence, requires to correct such violation, after the o\mer of said property has been given written notice by the City Council of such violation. SECTION 3. The City ~lerk of said City shall certify to the adJption of this ordinance and prior to the expiration of fifteen (15) daJs from the passage thereof shall cause the same to be published once an the Arcadia Tribune and Arcadia News, a weekly newspaper of General circulation, published and circulated in the City of Arcadia, and hereby designated for that purpose, and thirty days from and after the passage thereof, the same shall be in full force and effect.
