HomeMy WebLinkAbout0652 ~ ORDINANCE NO.. 652 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OR ARCADIA MAKING A PERMANENT EXCEPl'ION TO CERTAIN PROVISIONS OF ORDINANCE NO. 439 OF SAID CITY OF ARCADIA, ADOPl'ED JUNE 28, 1940. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: SECTION 1. Petition of J. N. Girid1ian, having been filed in the office of the Planning Commission of the City of Arcadia, pur- suant to the provisions of Ordinance No. 439 of said City, adopted June 28, 1940, asking that an exception be made affecting the pro- perty described in said petition, and setting forth the specific reasons therefor and the circumstances in connection therewith, and recommendation having been made by said Planning Commission to this Council and a full investigation and consideration of the facts having been made by this Council determines that there are exceptional or extraordinary circumstances or conditions applicable to the pro- perty involved a.nd to t he intended uses thereof that do not generally apply to the property or classes of uses in the same zone or district in which said property is located, and will not be inconsistent with the general purposes of said Ordinance No. 439, and that said property should be excepted from the provisions of the zone created by said Ordinance No. 439 affecting said property, but only so far as here- inafter set forth j and the requirements of said Ordinance No. 439 pertaining to the consent of adjacent property owners having complied wi th ~ This Council, therefore, excepts from the provisions of the respective zone of Ordinance No. 439 of the City of Arcadia the property hereinafter described, but only insofar as such exception is necessary to permit the construction maintenance and operation on the following described property, to wit: Lots 1, 2, 3, 4 and 5 of Tract 13487, in the City of Arcadia, County of Los Angeles, state of California, as shown on ma~ \+~#' 0-cl. 66'2.- recorded in Book 272, Pages 14 and 15 of Maps, in the office of the County Recorder of said County: of a Nursery, together with the necessary glass houses, business offices, growing rooms and other improvements incident to the raising of orchids, other tropical and semi-tropical and varied plants, trees, flowers, bulbs, shrubs and seedlings. These exceptions are granted upon the following conditions: (a) That no bUilding permit be granted for the erection or construction of any of said buildings upon said properties unless the plans and specifications be first submitted to the Building Inspector of the City of Arcadia, and that said plans and spec- ifications and said buildings shall in all particulars comply with the bUilding ordinances and sanitary regulations of the City of Arcadia; (b) That adequate provision for the parking of automobiles be made upon the above-described property and that no parking of auto- mobiles be pernitted upon that porti@n of Lot 1 aforesaid fronting on Colorado street. (c) That said properties shall not at any time be used for any purpose or purposes not allowed in Zone R-l of the City of Arcadia, except as provi.ded in this Ordinance; (d) That in case any of the provisions of this Ordinance are violated, the properties above described shall revert to Zone R-l as defined in Ordinance No. 439, and the rights and privileges herein granted shall cease and terminate in the event that any such viola- tion be not terminated within thirty days or such further time as the City Council may decide that the owner or owners of said pro- perties, in the exercise of due diligence, requires to correct such violation after the owner or owners of said properties have been given written notice by said City Council of such violation. SECTION 2. The City Clerk of said City shall certify to the adoption of this Ordinance and shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a weekly newspaper published and circulated in said City of Arcadia and hereby desig- nated for that purpose, and thirty days from and after the passage -2- ~c-!. 66';IL.- thereof, the same shall be in full force and effect.
