AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA
MAKING A CO~IDITIONAL VARIANCE TO CERTAIN PROVISIONS OF ORDINANCE
NO. 439 OF SAID CITY OF ARCADIA, AS AMENDED, PURSUANT TO SECTION
25 THEREOF.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,
DOES ORDAIN AS FOLLOWS:
SECTION l"s.
A petition signed by FRANK B. MCINTOSH AND
1vcrIME M. MCINTOSH, having been filed with the City Planning
Commission, pursuant to Section 25 of Ordinance No. 439
entitled "An Ordinance of the City Council of the City of
Arcadia, establishing in said City of Arcadia, zones or
districts and regulating therein the use of property, height
of buildings and requiring open spaces for light and ventilation;
to regu~ate and restrict the location of trades and industries
and the location of buildings designed for specified uses;
providing for the enforcement and prescribing penalties for the
violation thereof", asking that exception be made affecting the
property descri"bed in said petition and setting forth the
specific reasons therefor and the circumstances in connection
therewith, and recommendation having been made by the Planning
Commission to this Council, and a full investigation and con-
sideration of the facts having been made by this Council per-
tinent to such petition; this Council determines that there
are exceptional or extraordinary circumstances or conditions
applicable to the property involved and to the intended use
thereof that do not generally apply to the property or classes
of uses in the E:ame zone or district in which said property is
located, and will not be inconsistent with the general purposes
of Ordinance No. 439, as amended:
This Council therefore grants a Conditional variance from
the p-yovisions of said Ordinance No. 439, as amended, but only
so far as such v"ariance is necessary to permit the following

described real property, to wit:
That part of Lot 35 in Tract No. 3430 commencing at
the Southwest corner of said Lot 35, thence North
860 10' 10~ East 159.20 feet thence North to a line
parallel with and distant North at right angles
55 feet from South line of said lot, thence South
860 10' 10" West to East line of Baldwin Avenue,
thence Southwest to beginning as shown on Map
recorded in Book 42, page 32 of Maps, records in
the office of the County Recorder of Los Angeles
County.
to be used for the purpose of conducting and maintaining a
small Hobby Shop for the selling of model railroad equipment,
model airplanes and other hobby materials, as well as small
repairing.
This conditional variance is granted upon the following
terms and conditions:
(1) That the property be used for the purpose of
conducting and maintaining a small Hobby Shop for the selling
of model railroad equipment, model airplanes and other hobby
materials, as well as small repairing, upon the rear portion

of such property only, and for such other purposes as are
permitted by the zone or district in which the property is
now situated, and for no other purpose or purposes.
(2) That no merchandise or personal property of
any kind he displayed upon the front of the property.
(3) That no sign larger than 3 feet by 3 feet in
size be erected, used or maintained on said property.
(4) That upon any violation of any of the
provisions of this Ordinance the uses herein permitted shall
cease.
SECTION 2. The City Clerk shall certify to the
adoption of this Ordinance and prior to the expiration of
fifteen (15) days from the passage thereof, shall cause the
same to be published once in the Arcadia Tribune and News,

a newspaper of general circulation, published and circulated
in the City of Arcadia, and thirty (30) days from and after
the final passage thereof said Ordinance shall take effect
and be in force.
I HEREBY CERTIFY that the foregoing Ordinance was
adopted at a regular meeting of the City Council of the
City of Arcadia, held on the 15th day of July, 1947, by
the affirmative vote of at least three Councilmen, to-wit:
