ORDINANCE NO. 665
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
- CALIFORNIA, MAKING A PERMKNENT EXCEPTION TOCERTAIN PRO-
VISIONS OF ORDINANCE NO. 439 6F SAID CITY OF ARCADIA,
ADOPTED JUNE 28 , 1940.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS
FOLLOWS:
SECTION 1. Petition of Martha Kohl and Lois G. Lobb, having
been filed in the office of the Planning Commission of the City
of Arcadia, pursuant to the provisiOns of Ordinance No. 439, of said
City, adopted June 28,1940, asking that an exception be made
affecting the property described in said petition, and setting forth
the specific reasons therefor and the circumstances in connection
thereWith, and recommendation having'been made by the Planning Commission
to this Council, and a full investigation and consideration of the
facts having been aade by this Council pertinent to this petition;
this Council determines that there are excepticnal or extraordinary
circumstances or conditions applicable to the property involved and
to the intended uses thereof that do not generally apply to the property
or classes of U:les in the same zone or district in which said property
is located, and will not be inconsistent with the general purposes
of Ordinance No.. 439, and that said property should be excepted from
the provisions ()f the zone created by said Ordinance No. 439, affecting
said property, but only so far as hereinafter set forth; and the
requirements of said Ordinance No. 439 pertaining to the consent of

This Council, therefore, e~epts from the provisions of the

respective zone of Ordinance No. 439 of the City of Arcadia, the
property hereinafter described, but only insofar as such exception
is necessary to permit the maintaining on the follOWing described
property, towit:

Lot 1, Tract No. 5220, as shown on map recorded in Book
Pa@le 2 of 1laps, records of Los Angeles Count~ State of
California, except the west 75 feet thereof'l

the office of a physician and surgeon, together with the usual
accessories necessary and incidental to the use of the main
building located on the same lot or parcel of land, including a
private ga:rage.
This exception is granted upon the following conditions:
(a) That no building permit be granted for the construction
or erection of any building upon~id property unless the plans and
specificatioml be first submitted to the Building Inspector of the
City of Arcadia, and that said plans and specifications and said
building shall in all particulars comply with the building ordinance
and sanita:ry regulations of the City of Arcadia.
(b) That said property shall not at any time be used for any
purpose or purposes not allowed in Zone R-2 of the City of Arcadia,
except as provided in this Ordinance.
(c) That in case any of the provisions of this Ordinqnce are
violated, the property above described shall revert to Zone R-2
as defined in Ordinance No. 439, and the rights and privileges
herein granted shall terminate and cease, in the event that any
such violation is not terminated within thirty days, or such further
time as the City Council may decide that the o,vner of said property,
in the exercisE! of due diligence, requires to correct such violation
after the owner' of said property has been given written notice by the
City Council of' such violation.
SECTION 2. The City Clerk shall certify to the adoption of this
Ordinance and prior to the expiration of fifteen (15) days from the
passAge thereof, shall cause the same to be published once in the
Arcadia Tribune and Arcadia News, a newspaper of general circulation,
published and circulated in the City of Arcadia, and thirty (30) days
from and after the final passage thereof said Ordinance shall take
effect and be in force.

I HEREBY CERTIFY that the foregoing Ordinance was adopted
at a regulal' meeting of the City Council of the City of Arcadia,
held on the 2nd day of September, 1947, by the affirmative vote
of at least three Councilmen, towit:
AYES: Councilmen, Adcock, Leeper, Ormsby and Russell
NOES: None
ABSENT: Councilman Nugent
