THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS" FOLLOWS:: SECTION 1. For the purpose of this Ordinance, a privat~patrol is hereby defined to be any person, firm, corporation, or association of persons operating, maintaining or carrying on the business or occupation of night watchman, night watch service, or agency, private policeman, police patrol service or any other occupation the purpose of which is to afford additional police, guard or fire protection, in addition to that furnished by the City, for hire or reward. SECTION 2. It shall be unlawful for any person, firm, cor- poration or assoc.iation of persons either as owner, manager, employee, or otherwise, to solicit~or, manage, conduct, carryon or assist in the solicitation for, management, conducting or carrying on of the business of a private patrol without having obtained a written permit, from the Chief of Police of the City of Arcadia, which ,permit shall be subject to the approval in writing of the City Council of the City of Arcadia, and without paying the license fee hereinafter required. Permits tQ manage, conduct or carryon any such occupation may be issued by said Chief of Police, subject to the approval of the City Council aforesaid, upon the written application of any person for himself or on behalf of any firm, corporation or association of persons. Said Chief of Police must first satisfy himself that the management, conduct or carrying on of said private patrol will comport with the public welfare and for this purpose may consider any facts or evidence bearing on the moral fitness, ability, qualifications and character of any person or persons who will be in charge of, manage, conduct, or carryon said private patrol, and may require the sub- mission of any facts or evidence tending to enlighten him in this; ;;..~\I 7// ",,,'0 O,tcf. b 77 ' resp ect. ~t~tfi)1"~ \'I " \\\). ~~". SECTION 3. Upon the approval of such application by the City Council the applicant shall present same to the City Clerk ac- companied by a bond, with a good, sufficient and reliable suret;y; satisfactory to the Council, in the penal sum of Five Thousand, Dollars' ($5,000.00) which bond shall inure to the benefit of any person, firm or corporation who may suffer loss or damage by reason of any act of applicant, and upon the payment by the applicant o~' a license fee of $50.00, a license shall be issued to the applicant by the City CleI'k for such period of time not exceeding one year as' the Council may fix. When the Chief of Police shall have issued any permit under the t)../t ;...."" ~ f~ terms of this a.il,,~le!\, the same may be revoked at any time thereafter by said Chief of' Police, with the approval of the City Council, 1ft' said Chief of Police becomes satisfied that the management, conducting or carrying on of such private patrol does not or will not comport with the public welfare, or that said privat~patrol has been con- ducted in an illegal or improper manner. Said Chief of Rolice may make rules, subject to the approval in writing of the City Council, may revoke or suspend permits issued for the management, conducting or carrying on of any such occupations when the manager or person or persons in charge thereof violates or permits any infraction of any such rules, or any law of the United States, or of the State of California, or any ordinance of the City of Arcadia;: provided, how- ever, that no permit issued under authority of this section for the management, COnducting or carrying on of any such private patrol and no license issued under the authority of Section 3 hereof shall be revoked unless a hearing and notice thereof be given the permittee and licensee, provided further, that any such permit may be temporar- ily suspended by a written order signed by the Chief of Police, a copy of which order shall be transmitted to the City Council within twenty-four hours after its issuance. Such suspension shall continue -2- od 67:/ 9"~. \~ .. until the next meeting thereafter of the City Council. The City Council may continue such temporary suspension in effect pending consideration thereof. SECTION 4. LICENSE FEE AND CERTIFICATE. (a) Every person firm, corporation or association of persons who shall propose to, engage in the business of a private patrol as defined in Section 1 hereof, shall pEly an annual license fee of Fifty ($50.00,)i dollars, before epgaging in such business. (b) Any 1i.cense required under the terms of this ordinance shall be evidenced by a license issued by the City Clerk upon, and, not before the payment to the said City Clerk of said license fee. (c) Every license issued hereunder shall specify the name of the person, firm, corporation or associatton of persons to whom or to which issued, the business or occupation for which issued, its date of issuance, the date of its expiration and such other matters and things as may be herein expressly required. (d) No license shall be issued to any person, firm, corporation or association of persons for the managing, conducting, carrying on or solicitation :Cor, assisting in the managing, conducting or carrying on of or solicitation for the business of private patrols, until a permit in writing therefor, as provided for in this ordinance, shall have been issued by the Chief of Police of the City of Arcadia, and approved by the City Council, and then filed in the office of the City Clerk. (e) Such 1i,cense shall be conspicuously displayed in or at the place of business of the licensee except that in all instances in which a license i,s issued for the carrying on of any business conducted personally the license therefor and permit shall be carried upon the person of the individual operating thereunder and it shall be unlawful for any person conducting any such business to fail, refuse or neglect to carry such license or permit or to fail, refuse or neglect to ex- hibit the same upon demand of any police officer. Whenever any permit and license provided for herein shall have been revoked, notice of such revocation must be forthwith filed by the Ch:Lef of Police with the City Clerk of the City oft' Arcadia, and after such notice of revocation has been filed, the City Clerk shall not issue any further license to any person, firm, cor- poration or association of persons, whose permit and license has been so revoked until a new permit and license shall have been granted tm such person, firm, corporation or association of persons. SECTION 6., PENALTY. Any person, firm, corporation or association of persons, whether acting as principal, agent, officer, clerk or employee, who or Which shall violate any provision of this ordinance f shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not more than Five Hundred ($500'.00') Dollars, or by imprisonment in the City Jail, or in the County Jail, at the discretion of the committing magistrate, for a period not exceeding six (6) months, or by both such fine and imprisonment. SECTION ~. The engaging in, carrying on, or conducting of any business ~rovided for herein for which a license and permit is required, without having procured such license and permit therefor, shall con- stitute a distinct and separate offense for each and every day that', such business is engaged in, carried on, or conducted. SECTION 8. The City Clerk shall certify to the adoption of this Ordinance, and shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation published and circulated in said City of Arcadia, and thirty days (30) from and after the final passage hereof, the same shall take effect and be in force.
