AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA
ESTABLISHING SET BACK LINES ON PORTIONS OF BALDW~N AVENIDE
AND DUARTE ROAD, BOTH BEING PUBLIC STREETS IN THE CITY,
OF ARCADIA.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS
FOLLOWS::
SECTION 1. Pursuant to Resolution of Intentio~ No. 1700, and!
after a public hoaring pursuant to the provisions of said Resolution
of Intention, tho City Council of the City of Arcadia does hereby
determine that the public peace, health, safety, interest and
welfare require, and it is hereby ordered, that set back lines be
established on pc)rtions of BaldWin Avenue and Duarte Road, both,
being public strElets in the said City of Arcadia, as hereinafter
designated.
SECTION 2. That it shall be unlawfu:l for any person, firm or
corporation to erect, construct or locate any bUilding or other'
structure upon any lot or land fronting on the westerly side o~
BaldWin Avenue, between the southerly boundary line of Duarte Road
and the northerly boundary line of Naomi Avenue (also a publiC street
in the City of Arcadia) unless such building or other structure: be
set back to a lin.e which is distant fifty (50) feet westerly from
and parallel with the center line of said Baldwin Avenue.
SECTION 3. That it shall be unlawfUl for any person, firm or
corporation to erect, construct or locate any building or other
structure upon any lot or land fronting on the southerly side o~
Duarte Road, from the westerly boundary line of Baldwin Avenue to)
a point 399.91 feet west of said westerly boundary line of BaldWin
Avenue, unless such building or structure be set back to a line'
Which is distant fifty (50) feet southerly from and parallel with
the center line of said Duarte Road.
SECTION 4. ~rhat all other portions of Ordinances in conflict
herewith be and the same are hereby repealed;: that this repealing:

clause is not intended to affect any other Ordinance or portion of Or-
dinance in the City of Arcadia not in conflict with this Ordinance.
SECTION 5. That any person, firm or corporation violating any
of the provisionll of this Ordinance shall be deemed guilty of a mis-
demeanor and upon conviction thereof shall be punishable by a fine
not exceeding Five Hundre& ($500.00) Dollars, or by imprisonment in
the City Jail of said City of Arcadia, or in the County Jail of saidl
Sounty of Los ~:eles, State of California, at the discretion of the
Committing Magistrate, for a period not exceeding Six (6)~ months, or
by both such fine and imprisonment; and each such person, firm or
corporation shall be deemed guilty of a separate offense for each
day during any portion of which the violation of or failure, neglect
or refusal to cOD~ly with any of the provisions of this Ordinance is
committed, continued or permitted.
SECTION 6. The City Clerk shall certify to the adoption o~'
this Ordinance and prior to the expiration of fifteen (15) days from
the passage thereof, shall cause the same to be published, once in
the Arcadia Tribune and Arcadia News, a newspaper of general cir-
culation, published and circulated in the City of Arcadia, and thirty
(30) days from and after the final passage thereof said Ordinsnce
shall take effect and be in force.
I HEREBY CERTIFY that the foregoing Ordinance was adopted at a
regular meeting of the City Council of the City of Arcadia, held on
the 21st day of October, 1947, by the affirmative vote of at least
three Councilmen, to wit::
