HomeMy WebLinkAbout0678 ;'\ \, ,0 ORDINANCE NO. 678, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, AMENDING ORDINANCE NO. 612 OF SAID CITY, PROVIDING FOR PAYMENT OF TAXES FOR ADMISSION TO PLACES AT WHICH HORSE RACING, OR HARNESS HORSE RACING, MEETINGS ARE HELD. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS:: SECTION 1. That Section 1 of Ordinance No. 612 of the City of Arcadia, entitled "An Ordinance of the City Couno~] of the City C)f Arcadia, California, providing tOI' payment of: taxes for admission to places at which horse racing or harness: horse racing meetings are held", adopted NovembeI' 19, 1946, be, and the same is hereby, amended to read as follows:: "SECTION 1. (a) There shall be levied, asessed, collected and paid, a tax ot ten cents ($.10); tor each charge of forty cents; ($.40) or more paidl for admission of one person for one meeting,' t~ any place at which horse racing meetings, OI' harness horse racing meetings, are held or conducted within v this city, including admission by season ticket OI' subscription. (b) In the case of persons (except bona fide employees of the person, firm cor- pOI'ation or association conducting such meeting, municipa,l officers on official business, OI' otheI' persons whose admission to such place$ is required for the performance of some duty to, or work for, such person, fiI'm corporation or association): admitted free, or at reduced rates, to such places, at which horse racing meetings or harness horse racing meetings are held or conducted within this city, at any time when, anCl unde:[' circumstances under which, an admis- sian charge is made to other persons, an ,.,..- ~9 a.d ~7Y equlvalent tax" shall be collected, based on the prlce so charged to other persons for the same or slml1ar accommodatlons to be pald by the persons so admitted." SECTION~ That sald Ordlnance No. 612 of the Clty of Aro's.dla be and the same ls hereby amended by adding,; thereto a new seatlon to be numbered Sectlon 2A whlch shall follow lmmediately after Sectlon 2 of sald Ordlnance and shall read_ as follows>: "SECTION 2A. It ls provlded, however, that wlth refer- ence to taxable admlsslons to such places, whlch~ are made upon season or other pass books entltllng the holder thereof to admlsslon on all or any of the days durlng whlch any meetlng ls held, such accountlng or statement shall be made as a part of, and at the same tlme that the last accountlng for such meet ls to be rendered and made, as herein- above set forth. Thls provls0 ls lnserted so that the tax' lmposed hereby may be determlned, computed and pald on the basis of the actual:, taxable admlsslons under such season or other pass: bOOks, rather than upon the potentlal rlghts of the holder thereof to admissions thereunder". SECTION ;~ The Clty Clerk shall certlfy to the adoptlon of this Ordinance and prior to the expiration of fifteen (15): days] from the pass!lge thereof, shall cause the same to be publlshed, once ln the AI'cadla Trlbune and Arcadla News, a newspaper of general clrculatlon ln the Clty of Arcadla, and thirty (30) days from and after the flneQ~assage thereof sald Ordlnance shall take effect -2- ~'()<,;/..' a-("'! tZY and be in force.
