HomeMy WebLinkAbout0680 -"'/ '/ ORDINANCE NO. 680; AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA MdENDING ORDINANCE NO. 614 OF SAID CITY ESTABLISHING CERTAIN REGULATIONS WITHIN SAID CITY WITH REFERENCE TO THE DISSEMINATION OF WRITTEN OR PRINTED MATTER RELATING TO HORSE RACES AND OTHER CONTESTS. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS~ SECTION ):.:. That Section 3 of Ordinance No. 614 of the' City of Arcadia entitled "An Ordinance of the City of Arcadia, California, establishing certain regulations within said city with reference to the dissemination of written or printed matter relating to horse races and other contestsfl, adopted Decemben.3, 1946, be and the same is hereby amended to read as follows: "SECTION 3. Any person, firm or corporation desiring a license as an f1Approved Information Licensefl hereunder shall file, in duplicate, an application therefor with the City Clerk of the City of Arcadia, which shall contain the following in- formation:: . (1) Name Of/APPlicant, or the names of all of the copartners or principal officers thereof of a co-partnership or corporation. (2) His Local business address:. (3) His permanent address'. (4)' The name of the printed or written matter he intends: to distribute in the City. (5) The color thereof. (6) A statement as to Whether or not he or any partner of: officer of appl1,cant has ever been convicted of a felony and if l' he was ever so convicted, the designation of the felony, place of conviction, term for which convicted, length of time, and place at Which, if any, the sentence was served. (7) The number of persons he intends to employ in distribut- ing and/or selling such materials. Said application shall be signed and sworn to by the ap- pli~~nt or a partner or officer thereof before an officer . m\l\;l(~D ~d. 6PO authorized to administer oaths. To each of said applications: shall be attached the following: (a) Two copies of a recent photograph of applicant or affiant on white paper, size ll" by ll". (b)' Specimen copy of proposed material, showing nature of information intended to be included in said material. Said application shall be considered by the City Council at its next regular meeting after the filing thereof, or at any subsequent meeting to which the Council may continue the same, and it shall be discretionary with the Council to grant or refuse to grant such license. Before receiving any license as an "Approved Information Licensee" hereunder, in the event such application is approved, the licensee shall pay to the City of Arcadia a license fee of $600.00, which shall be valid for the ninety day period, including and succeeding the day of issuance thereof. Such license, if !ssued, shall entitle such "Approved Information Licensee" to make sales of such materials and items produlled, given away or offered by such licensee only, through and by means of applicant and not to exceed six salesmen or individuals at anyone time, provided however, that such materials and items be printed and published only under the name and in the distinctive form, wording, color and size stated in the application for each license and the issuance of a license to an "Approved Information Licensee" shall authorize such licensee to distribute, as contem~iated in this Ordinance, only one form of information sheet or material. Each and every such salesman must at all times carry with him or her a certificate signed by such "Approved Information Licensee", certifying that such employee is such duly authorized salesman. No salesman shall be permitted to sell or distribute any of said materials until after a ce:r'tified copy of such certificate of authority has been filed in the office of the Chief of Police of said City -2- (/~/ tPo of Arcadia. SECTION 2. That a new section to be known and designated as "Section 3A" shall be and the same is hereby added to said Ordinance No. Ei14 of the City of Arcadia, and which said new Section 3A shall read as follows: "SECTION 3A. Upon written application filed with the City Clerk requesting such extension (accompanied by the required extension fee) the City Council of said city may in its discretion grant an extension or the ninety day periods referred to in Section 3 of this Ordinance ror either~ (a)\ An additional thirty day period immediately 1'01- losing said ninety day period;: or (b) An additional sixty day period immediately fol- lowing said ninety day Jperiod;: provided that if said Council grants such thirty day extension a~,additional permit fee in the sum of Two Hundred ($200.00)) Dollars must be paid by permittee for such thirty day extension; and ir said Council grants such sixty day extension an additional permit fee in the amount of Four Hundred ($400.00)) Dollars; must be paid by permittee for such sixty day extension. No extension shall be valid unless and until such additional ree is paid. SECTION 3. That said Ordinance No. 614 shall be and the same is hereby amended as hereinabove in Section 2 of this ordinance set forth. SECTION 4,~ The City Clerk shall certHy to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the pnssage thereof, shall cause the same to be pub- lished once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation in the City of Arcadia, and thirty (30) days rrom and after the final passage thereof said Ordinance -3- ,,,t>~E1l O.--<-d, t.hJ shall take effect and be in force.
