HomeMy WebLinkAbout0693 "v 1- 1/ ORDINANCE NO. 693 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA AMENDING SECTIONS 9 AND 10 OF ORDINANCE NO. 439 OF SAID CITY, ADOPTED JUNE 28, 1940. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 9 of Ordinance No. 439 of the City of Arcadia entitled "An Ordinance of the City Council of the City of Arcadia, establhhing in said City of Arcadia, zones or districts and regulating therein the use of property, height of buildings and requiring open spaces for light and ventilation; to regulate and restrict the location of trades and industries and the location of buildings designed for specified uses; providing for the enforce- ment and prescribing penalties for t he violation thereof.", adopted June 28, 1940, be and the same is hereby amended to read as follows: "SECTION 9. ZONE M-l FACTORY AND MANUFACTURING DISTRICT. Except as otherwise provided herein no building, structure, im- provement, lot or premises shall be used and no building, structure or improvement shall be erected, constructed, established, altered or enlarged in Zone M-l which is designed, arranged or intended to be occupied or used for any purpose other than the following: (a) Any use permitted in Zones R-l-A, R-2, R-3, C-~ and C-2. (b) Cabinet making, Carpenter shop, Black~mith shop, Tinsmith, Roofing, Furniture or upholstery shop, Ice manufacturing plant, Au- tomobile tire re-treading and rebuilding, Sash and door manufacturing, Lumber storage yards for new lumber, Lumber sales yards for new lumber and new building materials, Storage warehouse, Machine shop~' MetaJ!. working shop, Stone or monument works, Glove, Shoe, Novelty or Toy manufacturing; Paper or strawboard manufacturing from waste paper stock or pulp board; Stone, Marble or granite grinding, Dressing or cutting, Wool cleaning, Weaving and dyeing; Riding academies and boarding stables for horses, Horse corrals, Horse exercise and train- ing for racing or for. any other purpose, Horse sales lots and stables, ""nQl.<'O ad 593' Steam laundrieSl. (c) Any other similar enterprises or businesses which, in the opinion of the Planning Commission as evidenced by a resolution adopted by the Planning Commission and approved by order entered in the minute9 or resolution of the City Council, are not more obnoxious or detrimental to the particular community than the enterprises or businesses enume:rated under Section Nine (9) herein. (d) Provided, however, that no business, enterprise, or use shall be permitted in said Zone M-l which produces, causes or emits an~ dust, gas, smoke, noise, fumes, odors or vibrations which are or may be detrimental to the other property in the neighborhood or to the welfare of the occupants thereof." SECTION 2. That Section 10 of Ordinance No. 439 of the City of Arcadia entitled "An Ordinance of the City Council of the City of Ar- cadia, establishing in said City of Arcadia, zones or districts and regulating there:l,n the use of property, height of buildings and requiring open spaces for light and ventilation; to regulate and restrict the loca,tion of trades and industries and the location of buildings designed for specified uses; providing for the enforcement and prescribing penalties for the violation thereof.", adopted June 28, 1940, be and the same is hereby amended to read as follows: "SECTION 10. ZONE M-a INDUSTRIAL DISTRICT'. Except as otherwise provided herein no building, structure, im- provement, lot or premises shall be used and no building, structure or improvement shall be erected,' constructed, established, altered or enlarged in Zone M-2 which is designed, arranged or intended to be occupied or used for any purpose other than the following: (a) Any use permitted in Zones R-l-A, R-l, R-2, B-3, C-l, C-2. and M-l. (b) Automob:l,le wrecking yard or establishment, House wrecking yard or establishment, Second hand and used lumber yard, Used Building -2- t//l-CL 693 ~, , o () 9;; n (0 '1 ' 00 1 j ~ materials, Junk yard, Rags storage or baling, Slaughter of fowls, Rabbits and game, Saw mills, Coal and wood sales place or establish- mente (c) Except as to the Businesses and enterprises prohibited in subsection (d) hereafter, general manufacturing and industria~ businesses: and enterprises may be conducted in Zone M-2. (d) The following businesses, enterprises and uses shall not be permitted in Zone M-2:: Manufacturing of ammonia, asphalt, brick, cement, grease, lamp black, lard, lime, paint, pickles, plaster of paris, sausage, soap, sauerkraut, tallow, tar or the byproducts thereof, tile, terra cotta, chewing tobacco; the storage of brick, petroleum or petroleum products except for fuel purposes in connection with a manufacturing use herein; gas storage, gasoline storage, slaughter of beef animals, railroad yard, round house, garbage incineration, electric power plant, iron foundry, scrap iron yard, chemical manufacturing, boiler works, creo- sote treatment 01' manufacturing, crematory, distillation of coal, wood or bones; glue manufacture; incineration or reduction of gar- bage, offal, dead animals or refuse, rawhides and skins, curing and tanning; rolling mill for grain, flour and feed manufacturing. (c) Any other similar enterprise, business or industry which, in the opinion of' the Planning Commission as evidenced by a resolution adopted by the Planning Commission and spproved by order entered in the minutes or resolution of the City Council is equally obnoxious or more obnoxious than the enterprises, businesses or industries above enumerated or is as detrimental to the particular community as the enterprises, businesses and industries above enumerated, are hereby prohibited in Zone M-2:. No building located in Zone M-2 shall exceed one hundred ten (110') feet in height." SECTION 3. 'rhe City Clerk shall certify to the adoption of this -3- tJ/U"L 6 ?\cT Ordinance md prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and ci:t'culated in the City of Arcadia, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. I HEREBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 3rd day of February, 1948, by the affirmative vote of at least three' Councilmen,' to wit: AYES: Couneilmen, Adcock, Leeper, Nugent, Ormsby and Russell NOES: None ABSENT: NOlle C~ty SIGNED and APPROVED this 3rd day of February, 1948.
