HomeMy WebLinkAbout0697 .... ..,. \ . ORDINANCE NO. 697 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA AMENDING SECTIONS 7 AND 8 OF ORDINANCE NO. 439 OF SAID CITY, ADOPTED JUNE 28, 1940. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 7 of Ordinance No. 439 of the City of Arcadia entitled "An Ordinance of the City Council. of the City of Arcadia, establishing in said City of Arcadia, zones or districts and regulating therein the use of property, height of buildings BOd requiring open spaces for light and ventilation; to regulate and restrict the location of trades and industries and t he location of buildings designed for specified uses; providing for the enforcement and prescribing penalties for the violation thereof. "" adopted June 28, 1940, be and the same is hereby amended to read as follows;: "SECTION 7. ZONE C-l RESTRICTED BUSINESS DISTRICT. Except as otherwise provided herein no building, structure, im- provement, lot or premises shall be used and no building, structure or improvement shall be erected, constructed, established, altered or enlarged in Zone C-l which is designed, arranged or intended to be occupied or used for any purpose other than the following: (a) Any use permitted in Zones R-1A, R-l, R-2, R-3. (b) Automobile parking lots for use in connection with busines~ where no charge is made for parking, banks, barber shops, beauty parlors, baseball parks, dress-making, embroidery and millinery shops, ice cream parlors, retail bakery stores, retail grocery stores, delica- tessen stores, fruit stores, retail meat markets, dressed poultry (pro~ vided, that no live poultry shall be kept or maintained on the prem- ises), drug stores, hardware stores for new hardware only, notions stores, stationery stores, candy a~d confectionery stores, candy making, , < dry goods stores, wearing apparel stores, flower shops and sales rooms, jewelry and watch repair, book stores, rental libraries, laundry agencies, retail cleaning and dyeing (provided the business is limited -1- ",,<.0 ,,,,0'" C&t:"/6;/7 to retail cleaning, pressing, repairing and dyeing), professional and business offices, artists' studios, music studios or consell"Vatories, tailor shops, shoe repair shops, sign painting shops, bootblack stands, commercial garages, gasoline service stations, automobile tire repair and s ales shops (provided there is no rebuilding, retreading or manu- facturing of tires,) real estate brokers offices, insurance agents, cafes or restaurants in the event that no dancing, theatrical per- formance or any entertainment of any nature be maintained, conducted or permitted the,rein or in connection therewith, tea room, retaiJL furniture stores, (provided that no less than eighty (80) per cent of the stock in the store or on the premises shall be new and unused furniture). Second hand furniture stores will not be permitted in Zone C-l. Any other similar enterprises or businesses v.h ich, in the opinion of the Planning Commission as evidenced by a resolution adopted by the Planning Commission 8nd approved by order entered in the minutes or resolution of the City Council, are not more obnoxiou$ or detrimental to the particular community than the enterprises' or businesses enumerated under sub-section (a) and (b) of Section Seven (7) . The conditions under which the above specified stores, shops or businesses are permitted to be established and conducted in Zone C-~, are as follows: That any and all of the permitted stores, shops or businesses shall be entirely located and conducted within buildings;, sheds, tents and temporary structures shall not be considered buildings within the meaning of this Section. II SECTION 2;. That Section 8 of Ordinance No. 439 of the City of Arcadia entitled "An Ordinance of the City Council of the City of Arcadia, establishing in said City of Arcadia, zones or districts and regulating therein the use of property~ height of buildings and re- quiring open spaces for light and ventilation; to regulate and res- trict the location of trades and industries and the location of -2- t/AC'J. 697 buildings designed for specified use3; providing for~he enforcement and prescribing penalties for the violation thereof.", adopted June 28, 1940, be and the same is hereby amended to read as follows: "SECTION 8: ZONE C-2 UNLIMITED BUSINESS DISTRICT. Except as otherwise provided herein, no building, structure, im- provement, lot or premises shall be used and no building, structure or improvement shall be erected, constructed, established, altered or en- larged in Zone C-2 which is designed, arranged or intended to be oc- cupied or used for any purpose other than the following: (a) Any use permitted in Zones R-1A, R-l, R-2, R-3 and C-~. (b) stores or shops for t he conduct of a retail or wholesale bakery, clothing, wearing apparel, shoe, drug, grocery, Imquor, wine, beer, furniture, hardware, dry goods or department stores. (c) Photograph galleries, dancing schools or academies, paint stores (provided paint is not mixed on the premises), paper hanging and decorating stores, upholstering shops, plumbing shops, electrica1 fixtures stores and light repair shops, refrigerator stores and repair shops, gas appliances and fixtures stores, radio sales and repair stores, objects of art and antiques, building and loan offices, res,- taurants and cafes with or without entertainment, theatres, motion picture theatres, comfort stations, battery repair and service em- ployment agencie:3, collec tion agencies, telegraph offices, newspap er printing plants, newspaper and magazine offices, job printing, news stands, bootblack stands, taxi cab service, dog hospital, cat hospital, flower and plant nurseries, horse harness shops and sales rooms, art galleries, awning and canvas stores, cafeterias, kodak developing shops, stage and bus passenger stations, milroad and interurban passenger and freight stations, trade schools and physical culture schools, bottling works for soft dI'inks. (d) Automobile sales rooms, used automobile sales lots, automobile parking lots, new automobile parts stores, automobile wash or automo- bile laundries. Any other similar enterprises or businesses which, in the opinion -3- C2t(;/ b? 7 of the Planning Commission as evidenced by a resolution adopted by the Planning Commission and approved by order entered in t he min- utes or resolution of the City Council, are not more obnoxious or detrimental to the particular community than the enterprises or businesses enumerated under Section Eight (8) herein. Provided, however, that no junk or automobile wrecking yard or establishment Rhall be used or maintained in Zone C-2. SECTION 3. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, 'shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia, and thirty (30) days from and 'after the final passage thereof said Ordinance shall take effect and be in force. I HEREBY CEHTIFY that the foregoing Ordinance was a dopted at a regular meeting of the City Council of the City of Arcadia, held on the 16th day of March, 1948, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen, Adcock, Leeper, Nugent, Ormsby and Russell NOES: None ABSENT: None SIGNED and ~ e L?~ Ci ty erk of the City 0 7: adia.
