AN ORDINANCE OF THE CITY COUNCIL OF THE CI~Y OF ARCADIA, CilLIFORNIA, rAKING A CONDITIOl'!AL VARIANCE TO CERTAIN PROVISIONS OF ORDINANCE NO. 439 OF SAID CITY OF ARCADIA, AS A~~IfDED, PUR- SUANT TO SECTION 25 THEREOF. THE CITY COTT]\TCIL OF THE CITY OF ARCADIA, C_-iLIFORIHA DOES ORDAIN AS FOLLOryS: ' SECTION 1. A petition signed by Rancho Santa Anita, Inc. having been filed with the City Planning Commission, pursuant to Section 25 of Orc.inance No. 439, entitled IlAn Ordinance of the City Council of the City of Arcadia, establishing in said City of Arcadia, zones or districts and regulating therein the use of property, height of buildings and requiring open spaces for light and ventilation; to regulate and restrict the location of trades and industries and the location of buildings designed for specified uses; providing for the enforcement and prescrib- " ing penalties for the violation thereof", asking that exception be made affecting the property described in said petition and setting forth the specific reasons therefor and the circumstances in connection therewith, and recommendation having been made by the Planning Co~mission to this Council, and a full investigation and consideration of the facts having been made by this Council pertinent to such petition: this Council determines that there are exceptional or extraordinary circumstances or conditions ap- plicable to the property involved and to the intended use thereof that do not generally apply to the property or classes of uses in the same zo ne or district in which said property is located, and will not be inconsistent with the general purposes of Ordinance No. 439, as amended; This Council therefore grants a Conditional variance from the provisions of said Ordinance No. 439, as amended, but only so far as such variance is necessary to permit the following \\w0'li'O ace! A/O ~ described real propertYi to wit: That portion of Lot 5 of Tract No. 949, in the City of Arcadia, County of Los Angeles, State of California, as shown on map recorded in Book 17, Page 13 of Maps, Records of said County, described as follows: Beginning at the 1Joint in the Southeasterly line of Huntington Drive as described in Deed to the City of Arcadia, recorded in Book 9396 Page 145 of Official Records of said County, said point being the most Westerly corner of that parcel of land conveyed to the Los Angeles Turf Club, Inc. and described as Parcel 2 in Deed recorded in Book 12619, Page 275 of official records of said County; thence South 380 33' West 1065 feet along the Southeasterly line of said Huntington Drive; thence South 510 27' East 500 feet more or less to the inter- section of the curved Southeasterly line of said Lot 5; thence Northeasterly along the South- easterly line of said Lot 5 to the most Southerly corner of the hereinbefore mentioned Parcel 2 conveyed to Los Angeles Turf Club, Inc.; thence North 510 27' West 30 feet to an angle point in said Parcel 2; thence North 380 33' East 150 feet to an angle point in said Parcel 2; thence North 510 27' West 480 feet to the point of beginning. to be used for the purpose of conducting and maintaining a golf driving range and the following uses in connection therewith; Sale of Golf equipment; giving of golf lessons; -2- ad i/t!! erection and use of a small building for storage of equip- ment, and golf balls, sale of soft drinks and sandvliches including other edibles customarily sold over a lunch counter; the erection and use of flood lights in connection with the golf driving range; installation of partitions for control of flight of golf ball. This conditional variance is granted upon the following terms and conditions: 1. That the property be used for the purpose of con- ducting a golf driving range and related uses as hereinbefore enumerated and described, and for such other purposes as is permitted by the zne or district in which the property is now situated, and for no other purpose or purposes. 2. That the rights and privileges granted by this Ordinance are accepted by the persons affected thereby UDon the express condition that this Ordinance granting the privil- eges herein specified shall terminate, cease and have no further effect after three (3) years from the effective date of this Ordinance. 3. That upon any violation of any of the provisions of this Ordinance, the uses herein p~rmitted shall cease and terminate and the property above described shall revert to and become a part of the zone in which the property is now situated. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Tribune and News, a newspaper of general circulation, published and circulated in the City -3- ~ul. 6/0 of ArcaQia, and thirty (30) days from and after the final passage thereof said ordinance shall take effect and be in force.
