AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ARCADIA, CALIFORNIA, PROVIDING
FOR PAY1ffiNT OF TAXES FOR ADMISSION TO
PLACES AT WHICH HORSE RACING OR HARNESS
IICRGE RACING MEETINGS ARE HELD.
THE COUNCIL OF THE CITY OF ARCADIA DOES
ORDAIN AS FOLLOWS~

SECTION 1. There shall be levied, assessed, collected and
paid, a tax of five cents ($.05) for each charge of forty cents
($.4-0) or more paid for admission Of one person for one meeting,
to any place at which.horse racing meetings, or harness horse
racing meetings, are held or conduc~ed within this city, includ-

ing admission by season ticket or subscription. In the case of
admission by season ticket or sUbscription, said tax shall be

charged
levied, assessed, collected and paid, based on t he price so
for admission of one person to one meeting, and said tax
of five cents ($.05) shall be multiplied by the number of meetings
to which the holder or owner of such season ticket or subscription '
is entitled to attend by reason of such season ticket or sub-
scription, and shall be paid at the time of the payment for such
season ticket, or subscriptio~ by:the purchaser thereof.
In the case of persons (except bona fide employees of the
person, firm, corporation or association conducting such meeting),
admitted free, or at reduced rates, to such places, at which horse
racing meetings or harness horse racing meetings are held or con-
ducted within this City, at any time when, and under circumstances
under which, an admission charge is made to other persons, an
equivalent tax shall be collected, based on the price so charged to
other persons for the same or similar accomodations to be paid by
the persons so admitted.
SECTION 2. The tax imposed under Section 1 hereof, shall be

be collected by the person, firm, corporation or association charg-
ing for such admission.

On Tuesday of each week during the time during which such
horse racing meetings or harness racing meetings are held or
conducted, such person, firm, corporation or association shall
render an accounting or statement of all persons (except bona
fide employees of such person, firm, corporation or association)
admitted to such place during the week preceding such accounting,

the city treasurer of said City of Arcadia, and shall then pay

to him all amounts so collected as taxes hereunder.
Within Ten days after the conclusion of such horse racing
meeting or harness racing meeting, such person, firm, corporation
or association shall render an accounting or statement of all
persons (except bona fide employees of such person, firml
association or corporation) admitted ~6 such place during the
entire time during which such meeting was held or conducted,
and at such time shall file such accounting or statement with
the city treasurer of said City of Arcadia, and shall pay to him
all amounts collected during the time during which such meeting
was conducted, and previously unpaid to him.
~~~~~1k ~ SECTION 3. The term "admissionll as used herein means the
~~~ight to enter each day a place where horse racing meetings or

~.~ - harness racing meetings are held or conducted, and includes,
but is not limited to, seats, tables and standing room, reserved
and not reserved.
SECTION 4. A failure on the part of such person, firm or
corporation hereinbefore mentioned to pay the entire amount of
\~t~tU~~~ taxes due hereunder within the aforesaid period of Ten days after

the conclusion of any such horse racing meeting or harness racing
meeting shall,automatically cause the 'amount of such taxes then
unpaid forthwith to become delinquent and the city treasurer of
said City of Arcadia shall thereupon add and collect a penalty
of Five per cent (5%) of the taxes so delinquent.
SECTION 5. Any person, firm or corporation responsible for the

violation of any of the provisions,: of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction thereof shall
be punished by a fine of not less than five dollars ($5.00) or
more than Five Hundred Dollars ($500.00) or by imnrisbnment in',the'
city or county jail for a period of not more than six (6) months,
or by both such fine and imprisonment. Every such person, firm
or corporation continuing, committing or permitting any violation
of any provision of this ordinance shall be deemed guilty of a
separate offense for each and every day of the violation of this
ordinance.

SECTION 6. The conviction and punishment of any person,
firm or corporation for violation of any provision of this
ordinance shall not excuse or exempt such person, firm or cor-
poration from the payment of any license due or unpaid at the
time of such conviction, and nothi~g herein shall prevent a
criminal prosecution of any violation of any provision of this
ordinance.
SECTION 7. The amount of any tax and penalty imposed by
this ordinance shall be deemed a debt to the City of Arcadia,
and any person, firm or corporation conducting any such horse
racing or harness racing meeting in violation of any of the
provisions of this ordinance shall be liable to an action in
the name of said city in any court of competent jurisdiction
for the amount of taxes and penalties imposed and an attachment

shall issue on a verified complaint without any bond or affidavit
given in behalf of plaintiff.
SECTION 8. The City Clerk shall certify to the adoption
of this Ordinance and prior to the expiration of fifteen (15)

days from the passage thereof, shall cause the same to be pub-
lished once in the Arcadia Tribune and Arcadia NeVIs, a newspaper
of general circulation, published and circulated in the City of

Arcadia, and thirty (30) days from and after the final passage
thereof said Ordinance shall take effect and be in force.
I HEREBY CERTIFY that the foregoing Ordinance was adopted
at a regular meeting of the City Council of the City of Arcadia,
