AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, CHANGING THE SETBACK LINES ON PORTIONS OF BALDWIN AVENUE, A PUBLIC STREET IN THE CITY OF ARCADIA. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. pursuant to Resolution No. 1531, and after a public hearing thereon, the City Council of the City of Arcadia does hereby determine that the public peace, health, safety, interest and' public welfare require, and it is hereby ordered, that the setback lines be changed on portions of Baldwin Avenue, a public street in the City of Arcadia, as hereinafter designated. SECTION 2. That it shall be unlawful for any person, firm or corporation to erect, construct or locate any building or other structure upon that certain parcel of land fronting on the westerly side of Baldwin Avenue, being a public street in the City of Arcadia, between, and extending from, a line parallel with and distant one hundred seventy feet (1701) north (measured at right angles~ from the northerly line of Fairview Avenue, and the northerly line of the aban- doned Southern Pacific Railroad right of way, unless the same shall be set back to a line which is distant twenty feet (201) westerly from and! parallel with the westerly boundary of said Baldwin Avenue. SECTION 3. That all other portions of Ordinances in con- flict herewith be, and the same are hereby, repealed; that this repealing clause is not intended to affect any other Ordinance or portion of Ordinance in the City of Arcadia not in conflict with this Ordinance. SECTION 4. That any person, firm or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be puniShable by a fine not exceeding Three Hundred Dollars ($300.00), or by imprisonment in the City Jail of said City of Arcadia, or in the County Jail of the ItlOo.'<i> t:JJ.6/6 County of Los Angeles, State of California, at the discretion' of the Committing Magistrate, fora period not exceeding three (3) months, or by both fine, and imprisonment; and each such person, firm or corporation shall be deemed guilty of a separate offense for each day during any portion of which the violation of, or failure, neglect or refusal to comply with, any of the provisions of this Ordinance is committed, con~ tinued or permitted. SECTION 5. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereoff shall cause the same to be published once in the Arcadia Tribune and Arcadia News" a newspaper of general circulation, published and cir~ culated in the City of Arcadia, and thirty days from and after the final passage thereof said Ordinance shall take effect andl be in force.
