ORDINANCE NO. 619
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA
MAKING A CONDITIONAL VARIANCE TO CERTAIN PROVISIONS OF
ORDINANCE NO. 439 OF SAID CITY OF ARCADIA, AS AMENDED,
PURSUANT TO SECT ION 25 THEREOF.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,
DOES ORDAIN AS FOLLOWS:

SECTION 1. A petition signed by Elmer C. Peterson
and James Lynott having been filed.with the City Planning
Commission, pursuant to Section 25 of Ordinance No. 439,
entitled "An Ordinance of the City Council of the City of
Arcadia, establishing in said City of Arcadia, ZRes or
districts and regulating therein the use of property,
height of buildings and requiring open spaces for light and
ventilation; to regulate and restrict the location of trades
and industries and the location of buildings designed for

specified uses; providing for the enforcement and prescrib-
ing penalties for the violation thereof", asking that exception
be made affecting the property described in said petition and
setting forth the specific reasons therefor and the circumstances
in connection therewith, and reco~endation having been made by
the Planning Commission to this Council, and a full investigation
and consideration of the facts having been made by this Council
pertinent to such petition: this Council determines that there
are exceptional or extraordinary circumstances or conditions ap-
plicable to the property involved and to the intended use thereof
that do not generally apply to the property or classes of uses
in the same zone or district .in which said property is located,
and will not be inconsistent with the general purposes of
Ordinance No. 439, as amended;
This Council therefore grants a Conditional variance from
the provisions of said Ordinance No. 439, as amended, but only
so far as such variance is necessary to permit the following

described real property, to wit:
A part of Lot 6, Tract No. 949, as shown on
map recorded in Book 17, page 13 of Maps,
Records of Los Angeles County, described
as follows:
Beginning at the intersection' of the East
line of said Lot 6 with the North line of
Huntington Drive: thence North 205812511

East 216.12 feet; thence North 87001'35"
West 140 feet to the true point of begin-
ning; thence continuing North 87001'35"
West 120 feet; thence North 205812511 East
2l6.l3 feet; thence South 87001135" East
120 feet; thence South 2058'25" West 216.13
feet to the true point of beginning.
to be used for the construction, maintenance and operation of
an apartment building containing twenty units with attached
garages, in conjunction with the remainder of Lot 6 for which
a variance was granted under the provisions of Ordinance No.
376 of the City of Arcadia.
This conditional variance is granted upon the following
terms and conditions:
(1) That the above described property forms part of Lot 6
having been previously re-zoned under the provisions of Ordinance
No. 376 of the City of Arcadia; that the entire Lot 6 aforesaid
will be used for the construction, maintenance and operation of
an apartment building containing twenty units with attached
garages as described in the aforesaid Petition, and for such
other purposes as are permitted by the ',zone or dist~ict in which

the property is situated, and for no other purpose or purposes.

(2) That upon any violation of any of the provisions of
this Ordinance the uses herein permitted shall cease and ter-
minate and the property above described shall revert to an~

become a part of the zone in which the said property is now
situated.
SECTION 2. The City Clerk shall certify to the adoption
of this Ordinance and prior to the expiration of fifteen (15)
days from the passage thereof, shall cause the same to be
published once in the Arcadia Tribune and news, a newspaper of
general circulation, published and circulated in the City of
Arcadia, and thirty (30) days from and after the final
passage thereof said ordinance shall take effect and be in
force.
I HEREBY CERTIFY that the foregoing Ordinance was adopted
at a regular meeting of the City Council of the City of Arcadia,
held on the 7th day of January, 1947, by the affirmative vote
of at least three Councilmen, to wit:
