I.:AKING A CO:WI'IIOHL VARIANCE TO CERTAIN PROVISIONS OF
ORDINANCE ~O. 439 OF SAID CITY OF ARCADIA, AS A~~}~ED,

DOES ORDAI~ AS FOLLOWS:
SECTION l. A petition signed by ~. S. Snauldin~ and
Marian I. SDauldin~ having been filed ~ith the City Planning
Commission, pursuant to Section 2? of Ordinance No. 439,

entitled "An Ordinance of the City Council of the City of
Arcadia, est~blishin~ in said City of Arcadia, zones or
districts and re~ulating therein the use of property,
height of buildings an0 requiring open spaces for lieht and
,
ventilation; to regulate and restrict the location of trades
and industries and the location of builQings designed for
specified uses; providing for the enforcement and prescrib-
ing llenalties for the vj,olation thereof", asking that exception
be made affecting the property described in said lletition and
,
setting forth the specific reasons therefor and the cir8umstances
in connection therev1i.th, and recommendation l1aving bpen rrade by
the Plannin~ COll'J1'ission to this CounCil, and a fall i'westieation
and consideration of the facts havin~ been made by this Council
pertinent to such petition: this Council determines that there
are eX8eptional or extraor0inary r.irc1.1illstancps or com'litions ap-
plicable to the property involved and. to the intended use thereof
that do not ~enerally apply to the property or classes of uses
in the same zone or district in which said Droperty is located,
and I'Jill not be incons is tent VIi th the general Durposes of
Ord inance No. 4-39, as amended;
This Council therefore ~rants a Conditional variance from
the provisions of said Ordinance No.,439, as amended, but only
so far as such variance is necessary to permit the following

described real property, to wit:
Part of lot 68, Santa Anita Colony, as shown on map,
recorded in Book 42, page 87, Miscellaneous Records
of Los Angeles County, beginning at the intersection
of the East line of El Mon~e Avenue with the North
line of Live Oak Avenue i' thence East on said North
line 200 feet; thence North parallel with El Monte
Avenue lOl.24 feet; thence West parallel with Live
Oak Avenue 200 feet; thence South on the East line
of El Monte Avenue 101. 24 feet to beginning.
to be used forfue erection of a two~family or duplex dwell-
ing at and upon the Westerly portion of approximately one
hundred ten feet (1101) of the above described real property
and for the maintenance and operation of a real-estate
business in and upon the easterly one hundred feet (lOO')
approximately of said real property.
This conditional variance is granted upon the following
terms and conditions:
(1)

That the westerly portion'of approximately one
hundred ten feet (1101) of said property be used for the
erection of a two-family or duplex dwelling and the remaining
one hundred feet (100') approximately of said property be
used for a residence and the maintenance and operation of a
real-estate and insurance business therein, and for such other
purposes as are permitted by the zone or district in which the
property is situated, and for no other purpose or purposes.
(2) That said two-family or duplex dwelling shall have
a minimum floor area of eighteen hundred square feet.
(3) That upon any violation of any of the provisions
of this Ordinance the uses herein permitted shall cease and
terminate and the property above described shall revert to

and beco~e a part of the zone in ~hich the said property is
now situated.
SECTro~ 2. The City Clerk shall certify to the adoption
of this Ordinance and prior to the expiration of fifteen (5)
days from the passage thereof, shall cause the same to be
Duolished once in the Arcadia Tribune and neTIs, a newspaper of
general circulation, nublished ~nd circulated in the City of
Arcadia, and thirty (30) days from and after the final
passage thereof said ordinance shall take effect and be in
force.
I HEREEY CfRTIFY that the foregoing Ordinance Vias adopted
at a regular meetin~ of the City Council of the City of Arcaria,
held on the 7th day of January, 1947, by the affimative vote
of at least three Councilrr:en, to ~it:
