ORDINANCE .NO. 63l AK ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA CHANGING THE SETBACK LIh~S ON PORTIONS OF ~AL}ruT AV'NUE, A PUBLIC STREET IN THE CITY OF ARCADIA. THE CITY COUNC IL OF THE CITY OF ARCAD lA, CAL IFORNIA, DOES ORDAIN AS FOLLOWS~ SECTION 1. Pursuant to Resolution No. l555, and after a public hearing thereon, the City Council of the City of Arcadia does hereby detprmine that the public peace, health, safety, interest and public welfare require, and it is hereby ordered, that the setback lines previously established at forty feet (40') on portions of Walnut Avenue, a ,public street in the City of Arcaoia be changed and re-established as hereinafter designated. SECTION 2. That it shall be unlawful for any person, firm or corporation to erect, construct or locate any building or other structure upon the following described parcel of land fronting on Walnut AVenue, being a public street in the City of Arcadia, to wit: The East 55 feet of Lot l, Tract No. 9282, as shown on Map recorded in Book. 125, Page 6 of Maps, records of Los Angeles ~ounty, unless the said building or other structure shall be set back to a line which is distant thirty feet southerly and parallei with the southerly boundary of said Walnut Avenue. SECTION 3. That all other portions of Ordinances in con- fl1ct herewith be, and the same are hereby, repealed; that this repealing clause is not intended to affect any other Ordinance or portion of Ordinance in the City of Arcadia not in conflict with this Ordinance. SECTION 4. That any De~son, firm or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not exceeding Three Hundred Dollars ($300.00), or by I~ oJ. 6<3/ I imprisonment in the City Jail of said City of Arcadia, or in the County Jail of the County of Los 'Angeles, State of Calif- ornia, at the discrection of the Committing Magistrate, for a period not exceeding three (3)' month~', or by both fine and imprisonment; and each such oerson, firm or corporation shall I' be deemed ~uilty of a separate offense for each day during any oortion of which the violation of, or failure, neglect or refusal to corr.ply vlith, any of the provisions of this Ordinance is comwitted, continued or nermitted. SECTION 5. The City Clerk shall certify to the adoption of this Ordinance and prior to the exoiration of fifteen (l5) days from the passage thereof shall cause the same to be p1.1blished once in the Arcania Tribune, and Arcadia News, a newspaper of general circulation, oublished and circulated in the Ci.ty of Arcad ia, and thirty days from and after the final passage thereof said Ordinance shall take effect and be in force.
