TH}~ CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS~ SECTION 1. Petition of Buron Fitts, Marian Fitts and Rancho Santa Anita, Inc., a corporation, having been filed in the office of the Planning Commission of the City of Arcadia, pursuant to the provisions of Ordinance No. 439 of said City, adopted June 28, 1940, asking that an exception be made affect- ing the property described in said petition, and setting forth the specific reasons therefor and the circumstances in con- nection therewith, and recommendation having been made by said Planning Commission to this Co~~cil, and a full investigation and consideration of the facts having been made by this Council determines that there are exceptional or extraordinary circum- stances or conditions applicable to the property involved and to the intended uses thereof that do not generally apply to the property or classes of uses in the same zone or district i; in which said property is located, and will not be inconsistent with the general purposes of s~id Ordinance No. 439, and that said property should be excepted from the provisions of the zone created by said Ordinance No. 439 affecting said property, I..'\\'\)t~ ~ 11-' ~~~~.'\\~. but only so far as hereinafter set forth; and the requirements of said Ordinanc~ No. 439 pertaining to the consent of adjacent property owners having been complied, with; This Council, therefore, excepts from the provisions of , respective zone of Ordinance No. 439 of the City of Arcadia the the property hereinafter described, but only insofar as such , exception is necessary to permit the construction, maintenance and operation on the following described property, to wit~ ;NDr;x;D (/ /l-C~t, t 3't Lots Six (6), Seven (7), Eight (8) and Nine (9) of Tract No. 13487 in the City of Arcadia, County of Los Angeles, State of California, as shown on Map recorded in Book 272, Pages 14 and 15 of Maps in the office of the County Recorder of Los Angeles County, of residential bungalows, which said bungalows may be of one or two'uhits each, but not to exceed more than eight units in all on anyone of said four lots, together with garage or garages on each of said lots of sufficient capacity f,or the storage of not more than two automobiles by the occupant or occupants of each such unit. This Council further excepts from the provisions of the respective zone of Ordinance No. 439 of the City of Arcadia the property hereinafter described, but only insofar as such exception is necessary to permit the ,construction, maintenance and operation on the following described property, to wit: Lot Ten (10) of Tract No. 13487, in the City of Arcadia, County of Los Angeles, State of California, as shown on Map recorded in Book 272, Pages 14 and l5 of Maps in the office of the County Recorder of Los Angeles County, of a restaurant and cocktail lounge, which said restaurant and cocktail lounge shall be approximately sixty (60) feet by one hundred twenty-five (125) feet in area, and of a swimming pool, which said swimming pool shall be approximately twenty (20) feet by forty-five (45) feet in area, and of hotel bungalows of ten to twelve units in number, containing an average of nine hundred (900) to twelve hundred (1200) square feet in each unit, and of one family dwelling, and of garage or garages of suf- ficient capacity for the storage of two automobiles by the occupant or occupants of each unit of the said hotel bungalows. This Council.further excepts from the provisions of the respective zone of Ordinance No. 439 of the City of Arcadia, the property hereinafter described, but only insofar as such exception is necessary to permit the construction, maintenance and operation on the following described property, to wit: -2- (/fie!. 63'A That portion of Lot 1 of Tract 949, in the City of Arcadia, County of Los Angeles, state of California, as shown on map recorded in Book 17, Page 13 of Maps, in the office of the County Recorder of Los Angeles County, described as follows: Beginning at the most southerly corner of Lot 10 of Tract 13487 as shown on map recorded in Book 272, Pages l4 and 15 of Maps, Records of said County; thence North 3lo 13' 4511 East 93.97 feet to an angle point in the easterly boundary of said Tract; thence North 250 00' 44" East 112.07 feet to an aI:1gle point in the easterly boundary of said tract; thence North 600 57' 26" East 269.66 feet to an angle point in the boundary of said tract; thence south 90 32' 45" west 235.l0 feet; thence south lO 55' 55" West 165.05 feet to the intersection with the curved northerly line of Colorado Boulevard (80 feet in width) as the same is shown on map of said Tract No. l3487. (The radial line-to said point bears South 30 30' 5911 West); thence northwesterly along said curved northerly line along a curve concave to the northeast and having a radius of 676.83 feet, 301.82 feet to the point of beginning: of an automobile parking lot for t he parking of automobiles of guests of the aforesaid restaurant and bungalows constructed on all of the aforesaid properties. These exceptions are granted upon the following conditions: (a) That the hotel bungalows erected on Lot Ten (10) afore- said shall be constructed substantially in accordance with the sketch filed concurrently with the filing of the aforesaid Petition; (b) That no building permit be granted for the erection at con- struction of any of said buildings upon said properties unless the plans and specifications be first submitted to the Building Inspector of the City of Arcadia, and that said plans and specifications and said buildings shall in all particulars comply with the building ordinances and sanitary regulations of the City of Arcadia; (c) That Lot 10 of Tract 13487, aforesaid, shall not be used at any time for public parking of vehicles; (d) That in the preparation of the plans for the construction of said restaurant and cocktail lounge adequate provisions shall be made for the parking of vehicles to the end that parking on Colorado Boulevard or Colorado Street in said City of Arcadia will be avoided. -3- ad (. 'St (e) That said properties shall not at any time be used for any purpose or purposes not allowed in Zone R-l of the City of Arcadia, except as provided in this Ordinance; (f) That in case any of the provisions of this Ordinance are violated, the properties above described shall revert to Zone R-l as defined in Ordinance No. 439, and the rights and privilEges herein granted shall cease and terminate in the event that any such violation be not terminated within thirty days, or such further time as the City Council may decide that the owner or owners of said properties, in the exercise of due diligence, requires to correct such violation after the owner or owners of said properties have been given wtitten notice by said City Council of such violation. SECTION 2. The City Clerk of said City shall certify to the adoption of this Ordinance and shall cause the same to be pub- lished once in the Arcadia Tribune and Arcadia News, a weekly newspaper published and circulated in said City of Arcadia and ~' hereby designated for that purpose, and thirty days from and after the passage thereof, the same shall be in full force and effect.
