HomeMy WebLinkAbout0641 . @ I{',I ORDINANCE NO. 641. AN ORDINANCE OF THE CITY com~CIL OF THE CITY OF ARCADIA APPROVING ~HEA~ION OF CERTAIN TERRITORY DESIGNATED AS "WEST ARCADIA Aj~NEX". THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: ' SECTION 1. l>V"rlEREAS, pursuant to the "Annexation of Unin- I habited Territory Act of 1939", the verified petition of Benjamin Clayton and Julia S. Clayton was filed with the City Council re- questing the annexation to the City of A.rcadia.,' State of Calif- 0rnia, of that certain uninhabited territory contiguous to the City of Arcadia designated as "West Arcadia Annex" and herein- after more particularly described; and 1~1HEREAS, at a regular meeting of thf,! City Council held on the 18th day of February, 1947, Resolution No. 1588 was adopted by said Council giving notice of and fixing the l8th day of fuarch, 1947, at $:00 o'clock P.M. in the Council Chamber in the City Hall of the City of Arcadia, as the day, hour and place when and where any and all persons owning real property within such territory so proposed to be annexed, and having any objections to the proposed annexation, might appear .before the City Council of the City of Arcadia and show cause why such territory should not be So annexed; and iffiEREAS, a copy of said resolution was published in the City of Arcadia at the times and in the manner reQuired by Section 5 of said "Annexation of Uninhabited Territory Act of 1939"; and V~ffiREAS, no Dersons owning real property within said ter- ritory proposed to be annexed to the City of Arcadia~peared before said City Council at the hour of 8:00 o'clock P.M. on the l8th day of March, 1947, who had any objections whatsoever to the annexation of said uninhabited territory to the City of Arcadia; and I'TtlEREAS, on h;arch 28, 1947, there was filed with the City Clerk the written consent of the petitioners Benjamin Clayton ~ C/Lc-f. (. 5J/ , and Julia S. Clayton, wherein consent was given that the said property, after its annexation to the City of Arcadia, may be taxed equally with the proverty within the City of Arcadia to pay the bonded indebtedness of the city outstanding on the date of such annexation for 1946 Sewer Bonds heretofore authorized and issued by the City of Arcadia, or any indebtedness there- tofore authorized and to be represented by bonds of the City of Arca01a thereafter to be issued, and \1REREAS, all ~roceedings have been. in conformity with law: NOW, THEREFORE, the annexation of that certain uninhabited territory contiguous to the City of Arcadia, in the County of Los Angeles, State of California, designated as "West Arcadia Annex", as hereinafter more particularly described, hereby is approved, and that said prooerty, after its annexation to the City of Arcadia, shall be taxed equally with the property within the City of Arcadia to Day the bonded indebtedness of the City " outstanding on the date of such annexat~on for 1946 Sewer Bonds heretofore authorized and issued by the ~ity of Arcadia, or any indebtedness theretofore author'ized arid to be represented by bonds of the City of Arcadia thereafter to be issued. Said property is bounded on the east by certain property in the City of Arcadia adjoining Baldwin,Avenue and on the north by certain Droperty in The City of Arcadia adjoining Duarte Road, in the County of Los Angeles, State of California, more particularly described as follows: Lots Five (5), Six (6), Seven (7), Ten (10) T~irteen (l3), Fourteen (l4), Fifteen (15), Sixteen (l6), Seven- teen (17), Eighteen (18), Nineteen (19), Twenty (20) and Twenty-One (2l), of Tract 6925, as per map recorded in Book 74, Page 79 of Maps, in the office of the County Recorder of Los Angeles County, al).d,the East ll5 feet of Lot Four (4) of Santa Anita Land Company's Pumping Plant No.1 Tract, as per map recorded in Book 10, Pa~e 183 of MaDS, in the office of the County Recorder of Los Angeles County. SECTION 2. The City Clerk shall certify to the adoption -2- aL?1. 6';// of this Ordinance and prior to the expir8tion of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcaoia Tribune and News, a newspaper of Reneral circulation, published and r.irculated in the City of Arcao ia, am'! thirty (30) days from and after the final <, passage thereof said Ordinance shall take effect and be in force. I HEREBY r.ERTIFY that the foregoing Ordinance was adopted at a regular meeting of the City. Council of ,the City of Arcadia, held on the 15th day of April, 1947, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Adcock, Leeper, Ormsby and Russell NOES: None ABSENT: Councilman Nugent City Clerk " ~.
