THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOVlS: . SECTION l. That Section 7 of Ordinance No. 439 of the City of Arcadia entitled "An Ordinance of the City Council of the City of Arcadia, establishing in said City of Arca~ia, zones or districts and regulating therein the use of property, height of buildings and recuiring open spaces for light and ventilation; to regulate and restrict the location of trades and industries and the location of buildings designed for specified uses; providing for the enforcement and prescribing penalties for the violation thereof.lI, adopted June 28, 1940, be and the same is hereby amended to read as follows: SECTION 7: ZONE C-l RESTRICTED FUSINESS DISTRICT - Except as otherwise provided herein no buildin~, structure, iu'provement, lot or premises shall be used and no build ing, structure or imnrovement shall be erected, ~onstructed, es- tablished, altered or enlarged in Zone C-l which is designed, arranged or intended to be occupied or used for any purpose other than the follo~ing: (a) Any use perrr.itted in Zones R-l-A, R-l, R-2, R-3. (b) Artists' studios, automobile parking lots for use in connection with business where no charge is made for parking, automobile tire repair and sales shops (provided there is no rebuilding, retreading or ~anufacturing of tires), banks, barber shops, baseball parks, beauty parlors, book stores, boot- black stands, cafes or restaurants in the event that no dancing, theatrical performance or any entertainment of any nature be maintained, conducted or permitted therein or in connection INDCXIiD auf t9"'Y therewith, candy and confectionery stores, candy making, delicatessen stores, dress-making, dr~g stores, dry-~ood stores, embroidery and millinery shops, flower shops and sales rooms, flo".'er and nlant nurseries, fruit stores, gasoline service stations, hardware stores, for new hard- ware only, ice-cream narlors, insurance agents, jewelry and watch repair, laundry agencies, music studios or con- servatories, notions stores, paint stores (provided paint is not mixed on the nremises~ dressed,poultry (provided that no live Doultry shall be kept or. maintained on the premises), professional and business offices, real estate brokers offices, rental libraries, retail bakery stores, retail cleaning and dyeing (provided the business is limited to retail cleaning, Dres Sln~ ,'repairing and dye- "- ing), retail furniture stores (provided that no less than eighty per cent of the stock in the store or on the premises shall be new and unused furniture), retail meat markets, \. shoe repair shops, stationery stores, tailor shops, tea room, wearing apnarel stores. Second hand furniture stores , will not be permitted in Zone C-l. Any other similar enterprises or businesses which in the opinion of the Plan- ning Commission as evidenced by a resolution adopted by the Planning Commission and approved by order entered in the minutes or resolution of the City Coun~il, are not more ob- noxious or detrimental to the particular community than the enterprises or businesses enumerated under sub-section (a) and (b) of Section Seven (7). The conditions under which the above specified stores, shops or businesses are permitted to be established and con- ducted in Zone C-l, are as follows: That any and all of the permitted stores, shops or -2- cld 6Lf( businesses shall be entirely located and conducted within buildings; sheds, tents and temporary structures shall hot be considered buildings within the meaning of this Section. SECTION 2. That Section 8 of Ordinance No. 439 of the City of Arcadia entitled "An Ordinance of the City Council of the City of Arcadia, establishing in said City of Arcadia, zones or districts and regulating therein the use of property, height of buildings and requiring ope,n spaces for light and ventilation; to regulate and restrict, the location of trades and industries 'and the location of b~ildings designed for I, specified uses; providing for the enforcement and prescrib- ing penalties for the violation thereof.", adopted June 28, 1940, be and the same is hereby amended to read as follows: SECT ION 8: ZONE C-2 UNLD'ITED BUS INESS DISTRICT - Except as otherwise nrovided her~in, no bUilding, structure, improvement, lot or premisEs shall be used and no building, structure or improvement shall be erected, constructed, es- tablished, altered or enlarged in Zone C-2 which is designed arranged or intended to be occupied or used for any purpose other than the following: (a) Any use permitted in Zones R-I-A, R-l, R-2, R-3 and C-l. (b) Stores or shops for the conduct of a retail or wholesale bakery, clothing, wearing ~pDarel, shoe, drug, grocer, liquor, wine, beer, furniture, hardware, dry goods or department stores. (c) Photograph galleries, dancing schools or academies, paper hanging and decorating stores, upholstering shops, plumb- ing shops, electrical fixtures stores and light repair shops, , refrigerator stores and re~air shops, gas appliances and -3- OJ.6yiy' fixtures stores, radio sales and repair stores, objects of art , and antiques, building and loan offices, restaurants and cafes with or without entertainment, theatres, motion picture theatres, comfort stations, battery r~pair and service, em- ployment agencies, collection agencies, telegraph offices, newspaper printing plants, newspaper and magazine offices, job printing, news stands, bootblack stands, taxi cab service, dog hospital, cat hospital, horse harness shops and sales roows, art galleries, awning and canvas stores, cafeterias, kodak developing shops, telephone exchange, sign painting shops, stage and bus passenger stations, railroad and interurban pas- senger and freight stations, trade schools and physical culture schools, bottling v10rks for soft drinks. (d) Automobile sales rooms, used'automobile sales lots, automobile parking lots, new automobile parts stores, auto- mobile wash or automobile laundries. Any other similar enterprises or businesses which, in the opinion of the Planning Co~~ission as evidenced by a resolution adopted by the Planning Commission and approved by order entered in the minutes or resolution of the City Council, are not more obnoxious or detrimental to the particular community than the enterprises or businesses enumerated under Section Eight (8) herein. Provided, however, that no junk or automobile wreclting yard , I or establishment shall be used or maintained in Zone C-2. SECTION 3. The City Clerk shall certify to the adontion of this Ordinance and prior to theexpira tion of fifteen (1')) days from the passage thereof, shall cause the same to be " published once in the Arcadia Tribune arid Arcadia News, a -4- dd 6~<j newspaper of general circulation, nublished. and circulated in the City of Arcadia, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. I HEREBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 6th day of May, 1947, by the affirmative vote of at least three Councilmen, to-wit: AYES: Councilmen, Adcock, Leeper, Nugent, Ormsby and Russell NOES: None ABSENT: None City Clerk of the City of SIGNED and ApoROVED this '6th day of May, 1947.
