SUBJECT: Approval of City of Arcadia - APRA Letter of Agreement
In 1991, City representatives and the Arcadia Police Relief Association (APRA)
successfully negotiated a multi-year memorandum of understanding (MOU). A
provision of the MOU prohibits any vacation accumulated beyond the amount
accumulable in a two year period, from being carried forward beyond December 31st
of each year. Any excess accumulated vacation over this limit must be forfeited.
On May 1, 1993, Donald Wilsterman, a 36-year veteran of the Arcadia Police
Department is scheduled to retire. In light of his pending retirement, Officer
Wilsterman has requested that an exception be made to the MOU so that he may
carry forward an amount of vacation leave beyond that accumulable in a two year
period (see attached memorandum). Unless Officer Wilsterman submits a request for
vacation leave before the end of the year, he will have 59 days of accumulated
vacation on December 31, 1992. This is 15 days beyond his maximum allowable
accumulation of 44 days.
Considering Officer Wilsterman's years of service to the community, the City of
Arcadia and the APRA met and agreed to waive the appropriate vacation leave
provision of the MOU. The APRA fully acknowledged that this is a one time
occurrence, that no precedent or vested rights are established, and that a custom and
practice are not established by this action. A signed letter of agreement is attached
for your consideration.
Recommendation
It is recommended that the City Council approve the Letter of Agreement between the
City of Arcadia and t e Arcadia Police Relief Association waiving a vacation leave
accumulation provisi.` of ,e MOU, for a retiring Police Officer.

After more than 36 years of police service, Police Officer Donald Wilsterman is
scheduled to retire in late spring 1993. Officer Wilsterman has requested that
subsection 2. of Section D. Vacation Leave, Article XIV in the Memorandum of
Understanding (MOU) between the City of Arcadia and the Arcadia Police Relief
Association be waived so that he may carry forward his earned vacation to his
retirement date.
Considering Officer Wilsterman's years of service to the community, the City of
Arcadia and the Arcadia Police Relief Association agree to waive subsection 2. of
Section D. Vacation Leave, Article XIV of the current MOU. The Arcadia Police Relief
Association acknowledges that this is a one time occurrence, that no precedent or
vested rights are established as a result of this action. Further this action does not
constitute a custom and practice of the City of Arcadia.

SUBJECT : Accumulated Vacation Days
Sir :
I have accumulated an excessive amount of vacation days, total of
56 . As required in Article XIV, Section D-2 , Pg. 19 , all
vacation over a 52 pay period basis shall not be carried forward
and shall be forfeited .
I would like to ask for an exception to this Article as I plan to
retire in early May of 1993 after race track season . This would
give me approximately 66 days on the books .
Your consideration in this matter would be greatly appreciated .
