ORDINANCE NO. 559 ~ AN ORDINAnCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA APPROVING THE ANNEXATION TO THE CITY OF ARCADIA, STATE OF CALIFORNIA, OF CERTAIN UNINHABITED TERRITORY, PURSUANT TO THE PROVISIONS OF AN ACT OF THE LEGISLATURE OF THE STATE OF C1tLIFORNIA, ENTITLED "ANHEX- ATION OF UNINHABITED TERRITORY ACT OF 1939", STAT. 1939, CHAPTER 297. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: SECTION l.~ WHEREAS, on the 5th day of August, 1945, there was flled \'lith the Clty Council of the City of Arcadia the verified petition of First Church of Christ Scientist of South Santa Anita, a corporation, asking that certain uninhabited territory in the County of Los Angeles, State of California, be annexed to the City of Arcadia, State of' California, and WHEREAS, it appe ars from said petition that all of the land described in said petition, and more particularly described herein, and all of the assessed value of such territory according to the last preceding equalized assessment roll of the County of Los Angeles in which said territory is situated, is owned and represented by said petitioner, and \7HEREAS, at a regular meeting of the City Council held on the 7th day of August, 1945, a Resolution declaring its intention to annex said proper'ty to the City of Arcadia, and giving notice of such proposed annexati()O pursuant to the prOVisions of Section 3 of said Annexation of Uninhabited Territory Act of 1939, was adopted, and \7HEREAS, a copy of said resolution was published in the City of Arcadia at the tUles and in the manner required by Section 5 of said Annexation of Unirmabited Territory Act of 1939, and WHEREAS, sE~id resolution fixed the 4th day of September, 1945, at the hour of 8:00 o'clock, P.M., as the time and the Council Chamber in the City Court Room of the Police Station of the City of Arcadia as the place for the appearance of any and all persons o,ming any real property within said territory proposed to be annexed to the City of Arcadia, and having any objections to the proposed annexation, to show cause why said territory should not be so annexed to the City of Arcadia, and -1- i""r.;.X:~~j c~J. S~~7 ,ffiEREAS, no persons owning real property within said territory proposed'to be annexed to the City of Arcadia, or any other person whomsoever, appeared before said City Council at the hour of 8:00 o'clock, P.M. on the 4th day of September, 1945, who had any objections whatsoever to the annexation of said uninhabited territory to the City of Arcadia, and IYHEREAS, it appears to this City Council that the territory described in said petition for annexation of said territory to the City of Arcadia, and in said Resolution of the City Council declaring its intention to annex said uninhabited territory to the City of Arcadia, is uninhabited territory, and iiliEREAS, said territory is contiguous to the City of Arcadia, NO\1, THER~!;FORE, the annexation to the City of Arcadia of ~~lat certain uninhabited territory contiguous to the City of Arcadia having a frontage of approximately one hundred thirty (130) feet on the south side of Duarte Road and having a depth of approximately three hundred seventy one (371) feet, which said property is located approximately 809.75 feet west from the angle point in the boundary line of the City of Arcadia, at the southwest corner of the intersection of Baldwin Avenue and Duarte Road, and commonly known as First Church of Christ, Scientist, and more particularly described as follows: Parcel OnEI: The northerly twenty (20) feet of that portion of Lot 2 of the Santa Anita Land Company's Pumping Plant No.1, Tract, as per map recorded in Book 10, Page 183, of Maps, Records of said County, lying westerly of the southerly prolongation of the easterly line of Lot 1 of said Teact. Parcel Two: Lot One (1) of the Santa Anita Land Company's Pumping Plant No. 1 Tract, as per map recorded in Book 10, page 183 of Maps, in the office of the County Recorder of said County, be and the same is hereby approved. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance anj prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the -2- , /.' -'~.,-J9 O~(CI, ~ Q / Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. I hereby certify that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 18th day of September, 1945, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen, Adcock, Leeper, Nugent Ormsby and Russell NOES: None J..l~_~ - ~- citY Clerk. --- Signed and approved this J.lliill..day of september, 1945.
