SECTION 1. Petition of James A. Stoker having been filed in the
office of the Pl~nnin~ Commission of the City of Arcadia, pursuant to
the provisions of Ordinance No. 439 of said City, adopted June 28,
1940, askin~ that an exception be made affecting the property de-
scribed in said petition, and settinG forth the specific reasOns
therefor and the circumstances in connection there~ith, and recommend-
lltion bavin3 bee::l made by the Plannin~ Commission to this Council,
and a full investi~ation and consideration of the facts bavine been
made by tbis Cow:lcil pertinent to this petition; this Council deter-
mines that there are exceptional or extraordinary circumstances or
conditions applicable to the property involved and to the intended
uses thereof that do not ~enerally apply to tt.e property or classes
of uses in tbe same zone or district in ~hich said property is
located, and vlill not be inconsistent with the c;eneral purposes of
Ordinance No. 439, and that said property should be excepted from the
provisions of tho zone created by said Ordinance No. 439 affectinrs
said property, but only so far as hereinafter set forth; and the
requirements of flaid Ordinance No. 439 pertainin:; to the consent of
adjacent property o,mers havinG been complied ~ith;
This Council, therefore, excepts from the proviSions of tbe
respective zone cf Ordinance No. 439 of the City of Arcadia, the
property hereinafter described, but only insofar as such exception
is necessary to permit the follol'ling described property, to 17it:
Beginning at the southeast corner of Alice Street and
Santa Anita Avenue, thence east alon~ the south line
of Alice Street a distance of 150', thence south a distance
of 50', thence ~est a distance of 1501 to Santa Anita Avenue

thence north along the easterly line of Santa Anita Avenue
50' to the point of be-;innin;;, being Lot 1, Block 2, Tract

101, as per map recorded in Book 13, Pa~e 52 of ;,laps,
Records of Los Angeles County,
to be used for the sale of beer and vine under off-sale license
only.
This exception is granted upon the following conditions:
(a) That no building permit be ~ranted for the construction
or erection of any build~ng upon said property unless the plans and
specifications be first submitted to the Buildin~ Inspector of the
City of Arcadia, and that said plans and specifications and said
buildin~ shall in all particulars comply vith the building Ordinance
and sanitary regulations of the City of Arcadia.
(b) That said property shall not at any time be used for any
purpose or purposes not alloved in Zone C-l of the City of Arcadia,
except as provided in this Ordinance.
(c) That in case any of the provisions of this Ordinance
are violated, the property above described shall revert to Zone C-l
as defined in Ordinance No. 439, and the rights and privileges here-
in granted shall terminate and cease, in the event that any such
violation is not terminated within thirty days, or such further time
as the City Council may decide that the owners of said property, in
the exercise of due diligence, require to correct such violation
after the owners of said property have been given written notice by
the City Council of such violation.
SECTION 2. The City Clerk shall certify to the adoption of
this Ordinance and prior to the expiration of fifteen (15) days from
the passs.:!;e theroof, shall cause the same to be published once in
the Arcadia Trib,me and Arcadia News, a newspaper of general cir-
culation, published and circulated in the City of Arcadia, and
thirty (30) days from and after the final passage thereof said
Ordinance shall take effect and be in force.
I hereby certify that the foregoin3 Ordinance was adopted
a t a re~ular meeting of the Ci ty Council of the Ci ty of Arcadia,
held on the 6th day of November, 1945, by the affirmative vote of
