Petition of Amy D. Phillips having been filed in the office of the PlanninG Commission of the City of Arcadia, pur- suant to the provisions of Ordinance No. 439 of said City, adopted June 28, 1940, asking that an exception be made affecting the prop- erty described in said petition, and setting forth the specific reasons tnerefor and the circumstances in connection therewith, and recommendation having been made by the Planning Commission to this Council, and a full investigation and consideration of the REPEALED ORO. t-11l...t;!! facts having been made by this Council pertinant to this petition; this Council determines that there are exceptional or extraordinary circumstances or conditions applicable to the property involved and ...,,\....~~~, to the intended uses thereof that do not generally apply to the ~...~ ","oP Q~~' property or clasi3es of uses in the same zone or district in which said property is located, and will not be inconsistent with the general purposes of Ordinance. No. 439, and that said property should be exceptod from the provisions of the zone created by said Ordinance No. 439 affecting said property, but only so far as here- inafter set forth; and the requirements of said Ordinance No. 439 pertaining to the consent of adjacent property owners having been complied wi th; This Council, therefore, excepts from the provisions ,of the respective zone of Ordinance No. 439 of the City of Arcadia, the property hereinafter described, but only insofar as such exception is necesse.ry to permit the following described property, to Wi't: A part of Lots 5 and 8, Block 84, Santa Anita Tract, as shown on W'lALED 080. 'J, S-'YI map recorded in Book 34, Pages 41 and ll:2, Miscellaneous Records, described as follows: Beginning at the intersection of the Northerly line of the right of way of the Southern Pacific Railroad with the westerly I/[fEALfo f'!ID. N".5"11 -1- IUI"\~"""'" O-tC'/' 57/ line of Fifth Avenue; thence westerly along the northerly line of said right of way 150 feet; thence northerly parallel with the westerly line of Fifth Avenue 200 feet; thence easterly parallel with said right of way 150 feet to the westerly line of Fifth Avenue; thence southerly thereon 200 feet to the place of beginning, to be used for the purpose of conducting a general contracting business thereon, including the erection, occupancy and use of an office building. This exception is granted upon the following conditions: (a) That no building permit be granted for the construction, alteration or erection of any building upon said property unless ~h,e plans and specifications be first submitted to the Building Inspect~ of the City of Arcadia, and that said plans and specifications and said building shall in all particulars comply with the building Ordinance and sro~itary regulations of the City of Arcadia. (b) That said property shall not at any time be used for any purpose or purposes not allowed in Zone R-l of the City of Arcadia, except as provided in this Ordinance. (c) That no machinery, tractors or similar equipment used REI'EAlE05l nRO. No tl in the general contracting business shall be stored on said property. ,\,\.I>\.\.~ 5'" ~~ "'0' I:l~O' (d) That in case any of the provisions of this Ordinance are violated, thll property above described shall revert to Zone R-1 as defined in Ordinance No. 439, and the rights and pr:hvileges herein granted shall terminate and cease, in the event that any such violation ill not terminated within th1!rty days, or such further time as the City Council may decide that the ovrrrers of said property, in the exercise of due diligence, require to correct such violation after the owners of said property have been given written notice by the City Council of such violation. SECTION 2.. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general cir- -2- c::J/l-~/. ,~:7Y culation, published and circulated in the City of Arcadia, and thirty (30) daYfl from and after the final passage thereof said Ordinance shall take effect and be in force.
