ORDDIAlfCE NO. 576.
AN ORDIHA;;CE OF THE CITY COUNCIL OF THE CI'J.'Y or ARCADIA
CI~~GING T;m SETEACK LINE ON A PORTION OF THIRD AVENUE, A PUBLIC
STREET IN TIill CITY OF ARCADIA.

SECTION 1.
Pursuant to Resolution No. 1439, and after a
public hearing thereon, the City Council of the City of Arcadia
does hereby determine that the public peace, health, safety,
interest and public welfare require, and it is hereby ordered that
the setback line be chanGed on a portion of Third Avenue, a public
street in the City of Arcadia, as hereinafter designated.
SECTION 2. That it shall be unlawful for any person, firm
or corporation to erect, construct or 10 'ate any buildin3 or other
structure upon any parcel of land fronting on the easterly side of
Third Avenue measured from the southerly property line of Genoa Street
to the northerly property line of Duarte Road, both being public
streets in the City of Arcadia, unless the Sffil~ be set back to a
line TIhich is distant twenty five (25') feet easterly from and
parallel with the easterly boundary line of Third Avenue.
SECTION 3. That all other portions of Ordinances in con-
flict hereuith be and the sane are hereby repealed; that this
repealin.; clause :is not intended to alfect any other Ordinance or
portion of Ordin~1ce in the City of Arcadia not in conflict with
this Ordinance.
SECTION 4. . That any person, firm or cor;oration Violating any
of the provisions of this Ordinance shall be Jeemed ~uilty of a
misdemeanor and upon conviction thereof shall be punishable by a
fine not exceeding Three Hundred ($300.00) Dollars, or by
1:rnprisonment in the City Jail of said City of Arcadia, or in the
County Jail of sa~.d County of Los An3eles, State of California, at
the discretion of the Committin3 Ua:;istrate, for a period not
exceeding three (~i) months, or by both such fine and imprisonment;
and each such person, firra or corporation sQall be deemed 3uilty

of a separate offense for each day durinG any portion of \7hich the
vio la tion of or failure, neglector refusal to comply I'li th any of
the provisions of this Ordinance is cOnl'11i tted, continued or
permitted.
SECTION 5. The City Clerk shall certify to the adoption
of this Ordinance and prior to the expiration of fifteen (15)
days from the passage t~ereof, shall cause the same to be published
once in the Arcadia Tribune and Arcadia Ne~s, a ne~spaper of
seneral circulation, published and circulated in the City of Arcadia,
and thirty days from and after the final passage thereof said
Ordinance shall take effect and be in force.
I hereby certify that the foregoin3 Ordinance vas adopted
at a rer;ular lLleeting of the City Council of the City of Arcadia,
held on the 5th day of February, 1946, by the affirmative vote of
at least three Councilmen, to wit:
