AN ORDINANCE OF THE CiTY COUNC~L OF THE CITY OF ARCADIA

THE CITY COUNCIL OF TEE CITY OF ARCADIA DOES ORDAiN AS
FOL:L.O\:S:
SECTION 1. Petition of The Roman Catholic Archbishop of
Los Angeles, State of California, having been filed in the office
of the Planning Commission of the City of Arcadia, pursuant to
the provisions of Ordinance No. 439 of said City, adopted June
28, 1940, asking that an exception be made affecting the property
described in said petition, and setting forth the specific reasons
therefor and the circumstances in co~ection therewith, and
reco;nmendation having been made by the Planning Commission to this
Council, and a full investi3ation and consideration of the facts
havine; been made ~JY this Council pertinent to this petition; this
Council determines that there are exceptional or extraordinary
circumstances or conditions applicable to the property involved and
to the intended uses thereof that do not generally apply to the
property or classes of uses in the smile zone or district in which
said property is locded, and will not be inconsistent \"Ii th the
general purposes of Ordinance No. 439, and that said property
should be excepted from the provisions of the zone created by said
Ordinance No. 439 affecting said property, but only insofar as here-
inafter set forth; and the requirements of said Ordinance No. 439
pertaining to the consent of adjacent property owners having been
complied wi th;
This Council, therefore, excepts from the provisions of the
respective zone of Ordinance No. 439 of the City of Arcadia, the
p~op3rty hereinafter described, but only insofar as such exceytion
is necessary to pe~Jit the following described property, to \"lit:
Parcell. LJts 31 and 32 of Tract 2828 as recorded in Book
33 at page 63 of ;.laps, in the office of the Recorder of Los An "eles

Parcel 2. Commencing at the intersection of the east line of

Holly Avenue (60 feet wide) with the south line of the Southern
Pacific Railroad Company risht-of-~ay; thence south 128.69 feet;
thence north 810 east 631.52 feet; thence north 92.37 feet; thence
west 285.57 feet; thence west on the south line of said right-of-way
to the point of beginning; being a part of Lot 3, Tract No. 950 as
recorded in Book 17, at page 25 of Uaps, in the office of the Recorder
of Los AnGeles County;
Parcel 3. The abandoned right-of-~fay of the Southern Pacific
~ /
Railroad Company (40 feet wide) extending from the east line of
Holly Avenue to the southerly line of HuntinGton Boulevard; being a
part of Santa Anita R~1Cho as recorded in Book 1, at page 97 of Patents,
in the office of the Recorder of Los Angeles County;
Parcel 4. ~rhat portion of Lot 4, Tract No. 2409 as recorded in
Book 23 at page 2:3 of !.laps, in the office of the Recorder of Los
Angeles County, lying westerly of the northerly prolon::;ation of the
westerly line of Tract No. 11969, as recorded in Book 259 at pages
36 and 37 of uaps, in the office of the Recorder of Los Angeles County,
except the northerly 15 feet thereof,
to be used for the purpose of erectinG, conducting and maintaining
thereon a church emd parochial school of one or more buildings, school
auditoriums, fences, rest rooms, recreational buildinGs and apparatus,
school and church yards, and such additions, alterations, extonsions
and enlargements thereof which from time to time may be necessary.
This exception is granted upon the following conditions:
(a) That no building permit be granted for the construction,
alteration or erection of any building upon said property unless the
plans and specifications be firs t submi tted to the Buildin::; Inspec tor
of the City of Arcadia, and that said plans and specifications and
said buildin3 shall in all partic~lars comply with tho building
Ordinance and sani';ary reGulations of the City of Arcadia.
(b) That said property shall not at any time be used for any
purpose or purposeEi not allowed in Zone R-l of the City of Arcadia
except as provided in this Ordinance.
(c) That in case any of the provisions of this Ordinance

are violated, the property above described shall revert to Zone
R-l as defined in Ordinance No. 439, and the ri;:;hts and privileges
herein ~ranted shall terminate and cease, in the event that eny
such violation is not terlllinated rrithin thirty days, or such further
time as the City Council may decide that the owners of said property,
in the exercise of due dili:ence, require to correct such violation
after the o~~ers of said property have been Given written notice by
the City Council of such violation.
SECTION 2. The City Clerk shall certify to the adoption of
this Ordinance and prior to the expiration of fifteen (15) days from
the passa;:;e thereof, sh~ll cause the s~ne to be published once in
the Arcadia Tribune and Arcadia News, a neITspaper of general circulation,
published ~~d circulated in the City of Arcadia, and thirty (30)
days from and ro.'ter the final passage cDereof said Ordinance shall
take effect and be in force.
I hereby certify that the foregoinG Ordinance ~as adopted at
a re3ular meet .ng of the City Council of the City of Arcadia, held
on the 5th day of February, 1946, by the affirmative vote of at least
three Councilmen, to rrit:

DAIN AS FOLLOWS:
SECTION 1. Petition of The

This Council, therefore, excepts

Avenue (60 feet wide) with the
south Hne of the Southe. n Pa.cine
Railroad Company right-of-way;
thence south 128.69 feet; thence
north 810 east 631.52 feet; thence
north 92.37 feet; thence west 285.57
feet; thence west on the south Hne
of said right-of-way to the point
of beginning; being a part of Lot
