ORDINANCE NO. 579.
AN ORDINANCE OF THE CITY COUNCIL OF' THE CITY OF ARCADIA
IjAKING A PERMANENT EXCEPTION TO CERTAIN PROVISIONS OF ORDINANCE NO.
439 OF SAID CITY OF ARCADIA, ADOPTED JUNE 28, 1940.

SECTION~ Petition of Mary Caroline Longley, having been
filed in the office of the Planning Commission of the City of Arcadia,
pursuant to the provisions of Ordinance No. 439 of said City, adopted
June 28, 1940, asking that an exception be made affecting the property
described in said petition, and setting forth, the specific reasons
therefor and the circumstances in
connection therewith, and
recommendation having been made by the Planning Commission to this
Council, and a full investi3ation and consideration of the facts
having been madl3 by this Council pertinent to this petition; this
Council determinl3s that there are exceptional or extraordinary
circumstances or conditions applicable to the property involved and
to the intended uses thereof that do not generally apply to the
property or clas:Jes of uses in the same zone or district in which
said property is located, and will not be inconsistent with the
general purposes of Ordinance No. 439, and that said property
should be exceptE.d from the provisions of the zone crea ted by said
Ordinance No. 43S affecting said property, but only insofar as here-
inafter set fortt.; and the requirements 0 f said Ordinance No. 439
pertaining to the consent of adjacent property owners having been
complied with;
This Council, therefore, excepts from the provisions of the
respective zone o.f Ordinance No. 439 of the City of Arcadia, the
property hereinafter described, but only insofar as such exception
is necessary to permit the following described property, to vat:
Lots 71-72-73-74, Tract 13188, as recorded in
Book 266,. pages 1-2-3 of Maps, in the office
of the County Recorder of Los Angeles County,
to be used for the purposes allowed in Zone C-l as defined in Section
7 of said Ordinance No. 439 of said City, except the fol10\nng uses,

to wit: Baseball parks; Dressed Poultry Stores; Tailor Shops;
Shoe repair shops; boot black shops; commercial garages; Gasoline
service stations; automobile tire repair and sales shops.
Th~s exception is granted upon the following conditions:
(a) That no building permit be granted for the construction,
alteration or erection of any building upon said property unless the
plans and specifications be first submitted to the Building Inspector
of the City of Arcadia, and that said plans and specifications and
said building shall in all particulars comply with the building
Ordinance and sanitary regulations of the City of Arcadia.
(b) That said property shall not at any time be used for
any purpose or purposes not allowed in Zone R-l of the City of
Arcadia except as provided in this Ordinance.
(c) That the plans for any building or buildings erected
upon any of said lots shall be similar in architecture to the
plans heretofore flled with the Planning Commission of the City of
Arcadia by the applicant, and shall be subject to the approval of
the Planning Comm1:3sion.
(d) That any building or buildings hereafter erected on
said property shall be completed within three (3) years from the
date of the granting of this variance.
(e) That the planted area in front of the buildings shall
continue to be owned and maintained by the ovmers of the property
affected by this v~lriance and no part thereof shall be used for BJJ.Y
other purpose or pt~poses.
(f) That any parking area used and maintained in connection
with the use of the property herein affected shall be paved with a
pavement conforming to Arcadia City standards for residential streets
and shall be maintained in good condition BJJ.d repair.
(g) That in case any of the provisions of this OrdinBJJ.ce
are violated, the property above described shall revert to Zone
R-l as defined in Ordinance No. 439, BJJ.d the rights and privileges
herein granted shall terminate and cease, in the event that any
such violation is not terminated within thirty days, or such further

time as the City Council may decide that the ovmers of said property.
in the exercise of due diligence, require to correct such violation
after the owners of said property have been given written notice by
the City Council of such violation.
SECTION 2.
The City Clerk shall certify to the adoption
of this Ordinance end prior to the expiration of fifteen (15) days
from the passage thereof, shall cause the same to be published once
in the Arcadia Tribune and Arcadia News, a newspaper of general
circulation, published and circulated in the City of Arcadia, and
thirty (30) days from and after the final pasaage thereof said
Ordinance shall take effect and be in force.
I hereby certify that the fore30ing Ordinance was adopted at an ad-
journodregular,mee'b1ng of the City Council of the City of Arcadia, held
on the 26th day of.' t1el'ch, 1946, by the affimative vote of at least
three Councilmen" to wit:
