AN ORDINANCE OF THE CITY CO;'iNCIL OF THE CITY OF ARCADIA, CALIFORNIA, CHANGING THE SET BACK LINES ON PORTIONS OF LAS 'fUNAS DRIVE, BALDlHN AVENUE AND DUARTE ROAD, ALL BEING PUBLIC STREETS IN SAID CITY OF ARCADIA. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFOR!:IA, DOES ORDAIN AS FOLLO;'iS: SECTION 1. Pursuant to Resolution No. 1443 of said City, adopted on.the 5th day of February, 1946, and after a public hearing thereon, the City Council of the City of Arcadia, California, does hereby determine that the public peace, health, safety, interest and public welfare require, and it is hereby ordered that the set back linesbe changed on portions of Las Tunas Drive, Baldwin Avenue and Duarte Road, all being public streets in said City of Arcadia, as hereinafter desiGnated. SECTION 2. That it shall be unlawful for any person, firm or corporation to erect, construct or locate any building or other structure upon the easterly 70 feet of Lot 22, Tract No. 6641, of the City of Arcadia, County of Los Angeles, State of California, as recorded in Book 126, Page 67 of Maps, in the office of the County Recorder of said County, unless the same be set back to a line which is distant ten (10) feet northerly from and parallel with the northerly property line of Las Tunas Drive. SECTION 3. That it shall be unlawful for any person, firm or corporation to erel}t, construct or locate any building or other ~ructure upon Lot 21, Tract 6641, of the City of Arcadia, County of Los Angeles, State of California, as recorded in Book 126, Page 67 of Maps, in the office of the County Recorder of said County, unless the same be set back to a line which is distant ten (10) feet easterly from and parallel with the easterly property line of Baldwin Avenue. SECTION 4. That it shall be unlawful for any person, firm or corporation to erect, construct or locate any building or other structure upon any parcel of land fronting on the southerly side of said Duarte Road measured from the westerly property line of Holly Avenue, a pUblic street in said City, to a point 190.51 feet westerly therefrom, unless the same be set back to a line which is distant thirty (30) feet so~therly from and parallel with the southerly -l- /1 ( f'f~-' [/AL. .J property line of said Duarte Road. SECTION 5. That the set back lines on portions of Baldwin Avenue and Las TUQas Drive along and in front of Lot 22, Tract No. 6641, in the City of Arcadia, County of Los Angeles, State of Calif- ornia, as reco rded in Book 126, at Page 67 of Maps, in the office of the County ReCorder of said County, as established by the provisions of Ordinance No. 257 of said City of Arcadia, adopted on the 19th day of May , 19 31 be and the same are hereby abolished. SECTION 6. That all other portions of Ordinances in conflict herewith be and the same are hereby repealed; that this repealing clause is not intended to affect any other Ordinance or portion of Ordinance in the City of Arcadia not in conflict with this Ordinance. SECTION 7. That any person, firm or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not exceeding Three Hundred ($300.00) Dollars, or by imprisonment in the City Jail of said City of Arcadia, or in the County Jail of said County of Los Angeles, State of California, at the discretion of the Committing Magistrate, for a periOd not exceeding three (3) months, or by both such fine and imprisonment; and each such person, firm or corporation shall be deemed guilty of a separate offense for each day during any portion of vhich the violation of or failure, neglect or refusal to comply VIi th any of the provisions of this Ordinance is committed, continued or permitted. SECTION 8. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia, and thirty days from and after the final passage thereof said Ordinance shall take effect -2- {lrt. c/ ,5" f.~ and be in force.
