ORDINANCE NO. 600
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA IMPOSING A LICENSE TAX UPON
DOGS AND REGULATING THE RUNNING AT LARGE, LICENS-
ING AND IMPOUNDING OF DOGS, PROVIDING FOR THE
CONTROL AND ERADICATION OF RABIES AND REGULAT-
ING THE ESTABLISHMENT AND MAINTENANCE OF KENNELS;
AND REPEALING ORDINANCES NOS. 485, 502 AND 581
OF SAID CITY OF ARCADIA.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN
AS FOLLOWS:
.SECTION.J.... The Poundmaster shall be appointed
by the Council of the City of Arcadia, and shall
serve for such period of time and shall receive
such compensation as shall be established by or-
dinance or by contract executed by the Council of
the City of Arcadia.
~ECTION 2. There shall be provided by the City
of Arcadia or by the Poundmaster upon such terms
and conditions as shall be named in a contract execu-
ted by and between the Poundmaster and the Council
of the City of Arcadia, a suitable building or en-
c1os~re to keep and safely hold all animals herein-
after enumerated which are subject to be impounded,
which shall be known and designat4d as the City
Pound provided, however, that the Council of the
City of Arcadia may enter into a written agreement
or agreements with any duly organized humane society
or societies which will undertake to carry out the
provisions of this ordinance and to maintain and
operate a pound to take up, impound and dispose of
animals and to carry out the duties of Poundmaster.
Any such humane society which shall have entered
into any such agreement shall take up and impound
each c,r any animal in the manner herein prescribed.
~ECTION 1. It shall be unlawful for any per-
son owning, having an interest in, harboring or

having the care, charge, control, custody or posses-
sion ot any dog, to allow or permit such dog to go
free or to run at large in or upon any street, alley
or public place within the City limits of the City
of Arcadia. That no such dog shall be taken upon
any street, alley or public place within the limits
of said City unless held in leash and lead by a
person of suitable size and age to be able to keep
such dog under full control. Provided, further,
that any resident of the City of Arcadia so taking
any such dog upon any such street, alley or public
place within the limits of said City shall have around
the neck of such dog a collar to which is attached a
tag bea:ring the number marked thereon by the Tax Col-
lector of said City of Arcadia.
~~TION 4. That it shall be unlawful for any
person, firm or corporation to keep more than three
(3) dogs, over the age of six (6) months each, in any
place in said City of Arcadia, within two hundred
fifty (2,0) feet of any dwelling, in use or occupied
by human beings, other than a dwelling in use or oc-
cupied by the owner of such dogs.
SECTION S. It shall be unlawful for any person,
firm or corporation, to carryon the business, in the
City of .~rcadia, of keeping dogs for breeding purposes
or for the purpose of medical treatment of dogs or
caring for dogs for hire, Without first obtaining a
permit from the City Council of said City of Arcadia
to keep or maintain a kennel and said City Council shall
have the right to grant or refuse such permit, in its

discretion, provided that if said City Council shall
grant such permit, said City Council may prescribe
such conditions as it may deem necessary or advisable
to prevent such. business becoming a nuisance.
SECTION 6. Itshall be unlawful for any person,

firm or corporation to keep four or more dogs, over
the age of six (6) months each, in said City of Arcadia
at any one place or in any premises in said City of
Arcadia, in the charge or control of any person and
over two hundred fifty feet from any dwelling, in use
or occupied by human beings, other than a dwelling in
use or occupied by the owner of such dogs, without
first obtaining a permit from said City Council to
keep or maintain a kennel and said City Council may
grant or refuse such permit, in its discretion, pro-
vided that if such permit is granted, said City Council
may prescribe such conditions as it may deem advisable
or necessary to,prevent the keeping of such dogs be-
coming a nuisance.
SEGTI.Q.N 7. It shall be unlawful for any person,
firm or corporation to own, harbor, or have the care,
charge}control, custody or possession of any dog over
the age of three months, within said City of Arcadia,
without paying the following license fees for such
animale
For, each male dog and every spayed female dog,
$2.00, per annum, and for every other female dog, the
sum of $4.00 per annum, provided however, that any person,
firm or corporation having a permit from the City Council
of the City of Arcadia, to keep or maintain any kennel,
shall pay in lieu of the above license fees for all dogs
over three months of age, kept or maintained in such
kennel, the following license feest

Ten or less dogs, the sum of $15.00 per annum:
eleven to thirty dogs, $25.00 per annum; thirty or
more dogs, $50.00 per annum. The owner or owners of
ever:r dog kennel in said City of Arcadia shall make
and file with the Tax Collector of said City of
Arcadia, on or before the 30th day of June of each
and every year, a sworn statement of each and every
dog bought, sold or kept in such kennel during the
fiscal year then terminating.
The Tax Collector is hereby authorized and
directed to procure each year on or before the first
day of July, such number of tags as may be sufficient
for use during the year. Said tags shall be effective
until the 30th day of June of the year next ensuing
and no longer.
]~very person owning, harboring or having the
care, charge, control, custody or possession of such
dog shall pay said license tax therefor to the Tax
Collector or to the Poundmaster of the City of
Arcadia on or before the first day of August of the
year f'or which said tag is issued, or within one
calendar month after the time when the dog for which
application is made was acquired by the applicant.
If application is made after August 1st of the year
for which such tag is issued and more than one calen-
dar month after the dog for which application is made,
was acquired by applicant, the fee therefor shall
be increased One ($1.00) Dollar.
Upon the payment of the fees aforesaid the Tax
Collector or the Pound Master shall issue to the

person owning, harboring, or having the care,
Charge, control, custody or possession of such
dog and making application for such license, a
tag which shall have stamped thereon the date
of the issuance and serial number of the license
and shall also issue a license containing a par-
ticular description of the animal for which
said. license and the corresponding tag is in-
tended and shall be for the same license period
as the tag. Both the license and the tag shall
be renewed annually.
If, during the period of time covered by
said license and tag, the tag issued should be
lost, then the owner of the dog for which said
lice:nse was issued shall be entitled to receive
a duplicate tag from the Tax Collector upon
filing a written statement that said tag is
lost, together with the payment of a fee of
twenty-five (2,~) cents to cover the cost of
the duplicate tag.
SECTION 8. (a) Notwithstanding the pre-
visions of Section 7 hereof, no dog license fee
shall be charged any person owning or harboring
or having the care, Charge, control, custody or
possession of any dog which has served in the
Military Forces of the United States in time of
war and which has receivea a discharge from such
service, provided satisfactory proof of such
Military service is furnished the Chief of Police
of the City of Arcadia and application for such

license is made on or before the list day of
August of the year for which said license tag
is issued or within one calendar month after
the date said dog is acquired by the applicant.
If application is made after August 1st of the
year. for_ which such tag is issued, or more than
one calendar month after the adquiring of the
dog for which application is made, a fee of One
($1.,00) Dollar shall be charged therefor.
(b) Any license tag issued
undE!r the provisions of Section 8 (a) shall
have stamped thereon in addition to the in-
formation required in Section 7 hereof, the
following: ItK_9n.
SECTION 9. It shall be the duty of the Pound-
master, his deputy or any police officer of said
City of Arcadia to take up any and every dog found
running at large within the city limits of the City
of Arcadia in violation of this ordinance and shall
cause the same to be impounded in a public pound.
, , SECTION 10. Said Pound Master shall keep

food and water, for three days, all dogs impounded
by h1~ and until said dog or dogs be redeemed by
the payment of $1. 50 Pound fee plus the sum of
fifty (50~) cents for each day after the first day
each said dog is so impounded. Said Pound Master

shall post a description of all dogs impounded by him
at the Pound designated by the City Council under the
provisions of this Ordinance and at the bulletin
board at the City Hall in the City of Arcadia
for a. period of not less than three days

and if any dog is not redeemed within three days
after the description has been so posted, said
dog shall be killed by the Pound Master in some
humane way.
SECTION 11. The word Odog" whenever used
in this Ordinance shall be deemed to include
female as well as male dogs.
SECTION 12. That it shall be unlawful for
any person, firm or corporation to imitate or
counterfeit the tags in this Ordinance provided
for or to use any imitation or counterfeit of such
tag..
SECTION 11. It shall be unlawful for any
person to rescue or attempt to rescue any animal
mentioned herein from the possession of the Pound
Master while engaged in conveying the same to the
POUI~ or after said animal is confined in said
POUIld.
SECTION 14. Said Tax Collector and the Pound
Master shall each pay over weekly to the City
Treasurer all sums collected by him as herein pro-
vided and make a monthly report to said City Council
of his proceedings hereunder.
SECTION 15. The terms "unenclosed lot or
premises" as used in this Ordinance, is hereby
defined as meaning any lot, land or premises not
enclosed in such manner as to prevent any dog

confined therein from escaping therefrom.
SECTION 16. All muzzles or apparatus tor
the muzzling of dogs shall be securely strapped
or fastened to the head of the dog and shall be
so made and applied that the same completely sur-
rounds the jaw and nose of the dog on which the
same is fastened and shall be so arranged as to
prevent the dog from biting any person or thing,
but so as to permit the opening of the mouth of
such animal, allowing it to breathe and drink
with freedom.
SECTION 17. The Chief of Police and his
deputies and the Pound Master or any other per-
son employed for that purpose by said City Council
shall be and they are hereby authorized and em-
powered to capture every dog not muzzled as
required by this Ordinance and found going free
or running at large in or upon any public road
or highway or any other public place or in or
upon any unenclosed lot or premises in said City
of Arcadia, or in case such officer or person
shall upon pursuit be unable to capture such dog,
such officer or person shall be authorized and
empowered to kill such dog.
SECTION 18. All dogs so captured by said
officer or person shall be examined by the City
Health Officer and it shall be the duty of such
City H~ealth Officer wh~en called upon to examine

al~ such dog, to ascertain whether or not such
dog is afflicted with rabies. Any dog found
by said City Health Officer upon examination to
be so aff1ictedsha11 be at once killed by the
person having possession thereof,and any dog
found not to be so afflicted upon examination,
aI~ after sufficient time for proper observation
thereof, shall be returned to the owner thereof
upon the payment of the expenses incurred in
impounding such dog, which shall not exceed
fifty (,0;) cents per day.
The City Health Officer is hereby authorized
to provide for the care of the dogs captured and
held pursuant to the progisions of this Ordinance,
and the expenses incurred thereby shall, in cases
where such dogs are not reclaimed, be paid by the
City of Arcadia not exceeding fifty (50;) cents
per day for each dog.
Every person who kills any dog, las herein
provided shall bury or destroy the same.
rf any dog is found not to be afflicted with
rabies and is not reclaimed by the owner thereof,
within ten (10) days after the capture thereof,
such dog shall be killed by the person capturing
the same, or given to such person as will pay the
expenses incurred in impounding such dog. All dogs
killed under the provisions of this Ordinance shall
be killed in some humane manner.
SECTION 19. Whenever it is shown that any
dog or other animal has bitten any person, it shall

be unlawful for the owner or person having the
care, control, custody or possession thereof,
upon order of the City Health Officer, to fail,
refuse or neglect to quarantine such dog and
keep it tied up or confined for a period of
three weeks or to fail, refuse, or neglect to
allow the City ~ealth Officer or his deputy
to make an inspection or examination thereof at

any time during said period. If it shall be
established to the satisfaction of the City
'Health Officer that any such dog or other animal
has rabies, the City Hvealth Officer shall cause
such dog or other animal to be humanely killed
forthwith.
SECTION 20. Whenever any animal shall be
bitte,n by another animal having rabies, it shall
be unlawful for the owner or person having the
care, control, custody or possession of the animal
so bitten, upon being informed thereof, to fail,
refuse or neglect to either kill such animal or
quarantine it, and keep it confined or tied up for
a period of six months, and the City Health Officer
or his deputy shall have the power, in his dis-
creti,:m, to kill or quarantine the animal so bit-
ten in case the owner or person having the custody
or possession thereof shall fail to do so immediatelY,
or in case the owner or person having the care, con-
trol, custody or possession thereof is not readily
accessible.
g.ECTION 21. It shall be unlawful for any per-
son tel bring any dog into the City of Arcadia from

any place in which rabies shall be II' esent or
shall have been known to be present within six
months, without permission of the City Health
Officer.
SECTION 22. That Sections 16 to 21, both
inclusive, of this Ordinance shall be operative
only when rabies exist in or near the City of
Arcadia. It shall be the duty of the City Hel4lth
Offl.cer to Mermine when rabies exist in or near
the City of Arcadia and his findings in the
matter shall be final and conclusive. Notice of
the finding of the City Health Officer as to
the existence of rabies and as to the termination
of the existence thereof in and near said City
of Arcadia shall be given by one publication in
such newspaper published and circulated within
said City as said City Council may designate.
SECTION 2~. The following Ordinances are
hereby specifically repealed: Ordinance No. 485,
passed and approved June 2, 1942. Ordinance No.
502, passed and approved, March 9, 1943. Ordinance
No. ~}81 passed and approved March 26, 1946.
SECTION 24. That any person, firm or cor-
poration violating any of the 'provisions of this
Ordinance shall be deemed guilty of a misdemeanor
and upon conviction thereof shall be punishable by
a fine not exceeding three hundred ($300.00) Dol-
lars, or by imprisonment in the City Jail of said
City of Arcadia, or in the County Jail of said

County of Los Angeles, State of California, at
the discretion of the Committing Magistrate, for
a period not exceeding three (3) months, or by
both such fine and imprisonment.
SECTION 2,. The City Clerk shall certify
to the adoption of this Ordinance and prior to
the expiration of fifteen (15) days from the
pas.sage thereof, sh",all cause the same to be
published once in the Arcadia Tribune and Arcadia
News, a newspaper of general circulation, published
and circulated in the City of Arcadia, and thirty
(30) days from and after the final passage thereof
said Ordinance shall take effect and be in force.

The Tax Collector Is hereby au-
thorized and directed to procure
each year on or before the first day
of July, such number of tags as may
be sufficient for use during the year.
Bald tags shaH be effective until the
30th day o.t June of the year next
ensuing and no longer.
Every person owning, harboring
or having the care, charge, control,
custody or possession of such dog
shaH pay said license tax therefor
to the Tax Collector or to the
Poundmaster of the City of Arca-
dia on or before the first day of
August of the year for which said
tag t., Issued, or within one calen-
dar month after the time when the
deg for which application is made
was acquired by the applicant. If
application Is made after August 1st
of the year for whIch such tal Is
Issued and more than one calendar
month after the dog for which ap-
plication Is made, was acquired by
applicant, the fee therefor shall
be Increased One ($1.00) Dollar.
Upon the payment of the fees
aforesaid the Tax Collector or the
Pound Master shall Issue to the per-
son owning, harboring, or having
the care, charge, control, custody
or posseSsion of such dog and m.ak-
log applicalon for such Ucense, a
tag which shall have stamped there-
on the date of the 1.s5uance and
serial number of the llcenae and
t.:ha.ll also issue a license containing
a partlcula.r description of the ani-
mal for which said license and the
corresponding tag 1s tntended and
shall be for the same license period
as the tag. Both the license and
the tag shall be renewed annually.
If, during the period of time cov-
ered by said license and tag, the
tag Issued should be lost. then the
owner of the dog for which said
license was Issued shall be entitled
to receive a duplicate tag from the
Tax Ccllector upon filing a. written
statement that sa.id tag is lost, to-
gether with the payment of a fee
of twenty-five (25c) cents to cover
the coot of the duplicate tag.
SECTION 8. (a) NotwIthstand-
Ing the provisions of Section 7
hereof, no dog license fee shall be
charged any person owning or har-
,bcring or having the care. charge,
control, custody or possession of any
dog which has served In the Mili-
tary Forces of the UnIted States In
time of war and which has received
a discharge frem such service, pro-
vided satisfactory proof of such
MUitary service 18 turnished the
Chief of Pollce of the Ci ty of Ar-
cad~ and s.pplicatlon for 8uch li-
cense Is made on or before the first
day of August of the year for which
said license tag Is issued or within
one calendar month after the date
said dog is acquired by the appli-
cant. If application Is made after
August 1st of the year for which
such tag is Issued, or more than
one calendar month a.i'tc, the ac-
quiring of the dog for which appli-
cation Is made. a fee of One ($1.00)

(b) Any license tag issued under
the provisions of section 8 (a) shall
have stamped thereon In addition

SECTION 9. It shall be the duty
of the Poun-dma.ster. his deputy or
any police officer of said City of
Arcadia to take up any and every
dcg found running at large within
the city limits of the City of Ar~
cadia in violation of this ordinance
and shall cause the same to be
impounded in a public poWld.
SECTION 10. SaId Pound Mas-
ter .shall keep conrlned in said
Pound, properly provided with food
and water, for three days, all dogs
impounded by him and until saId
dog or dogs be redeemed by the pay-
ment of $1.50 Pound fee plus the
sum cf fifty (SOC) cents for each day'

SECTION 11. The wcrd "dog"
whenever used in this Ordinance
shall be deemed to include female
as well as male dogs.
SECTION 12. That it shall be un-
lawful for any person, firm or cor~
poratIon to imitate or counterfeit
the tags in this Ordinance p:'ovided
for or to use any imitation or coun-
tcrf~i'; of liuch tag.
SECTION 13. It shall be unlaw-
ful fer any person to rescue or at-
tempt t::. r~CUe any animal men-
tioned here:n from the possession
of tt'.e Pound Master while engaged
in conveying the same to the P01..1nd

SECTION 14. Sald Tax collector

SECTION 15. The terms "un-

SECTION 17. The ChIef of P::lice
and his deputies and the Pound
Master or any o~her person employ-
ed for that purpose by said City
Council shall be and they are here-
by authorIzed and empowered to
c3.p~ure every dog not muzzled. as
required by this ordinance and
found going free or running at large
In or upon any public road Or high-
way cr any other public place or in
or upon any unenclosed lot or
premises in said City of Arcadia. or
in ca.se such officer or person shall
upon pursuit. be unable to capture
such dog, such oHicer or person
shall be authorIzed and empowered.

SECTION 18. AU dogs so cajJ-
tured by said ('.!ficer or person
shall be examined by the City
Health Officer a.nd it sha.ll be the
duty of such City Health Officer
when called upon to examine any
such dog, to ascertain whether or
not such dog is afmcted with rab-
hies. Any dog found by said City
Health Officer upon e~am~nat1cn to
be SO afflicted shall be at once
killed by the person having po5ses-
~ion thereof. and any dog found
not t.o be so arnlct~d upon exam-
ination, and after sufficient time
for proper observaticn thereof, shall
be returned to the owner thereof
upon the payment of the expenses
incurred in impounding such dog,
which shall n:t exceed fifty (50c)
cents per day.
The Ci~y Health Officer is hereby
a.uthorized to provide tor the care
of the dogs captured and held pur-
suant to the provisions of this Or-
dinance, and the expenses incurred
thereby shall, in cases where such
d ~ gs are not reclaimed. be paid by
the City of Arcadia not exceeding
fifty (5Oc) cents per day for each
dog.
Every pe:'son who kills any dog,
as herein provided shall bury or
des~roy the same.
If any d~g is found not to be af-
flIcted with rabies and Is not re-
claimed by the owner thereof, with-
in ten (10) days after the capture
thereof,' such dog shall be killed by
the person capturing the same, or
given to such perso!!- as will pay the
expenses Incur:ed In impounding
such d::g. All dogs kllled under the
provisions or this OrdInance shall
be killed in s::me humane manner.
SECTION 19. Whenever it Is
shown that any dog or other animal
has bitten any person. it shall be
unlawful fOT the c,wner or perton
having the care, control, custody or
possession thereof, upon order of
the City Health Officer. to fnil,
refuse or neglect to quarantine such
deg end keep it tied up or conttned
for a period ot three weeks or to
fail, refuse, or neglect to allow the

City Health Officer that any such
dog or other animal has rabies, the
City Health Officer shall cause such
dcg or other animal to be humanely
kUled forthwith.
SECTION 20. Whenever any ani-
mal shall be bitten by another ani-
mal having rabies, it shan be un-
lawful for the owner or person
having the care, control, custody or
possession of the animal so bitten,
upon being Infonned thereof. to
fall. refuse or neglect to either kill
such animal or Quarantine it. and
keep it confined or tied up for a
peried of six months, and the City
Health Officer or hLs deputy shall
have the powe.r, in his discretion, to
kill or quarantine the antrnal so
bitten in CPoSe the owner or person
having the custody or pClisession
thereof shall fail to do so imme-
diately, or in case the owner or
person having the care, contrel, cus-
tody or possession thereof is not
readily accessible.
SECTION 21. It shall be unlawful
for any person to bring any dog
into the City of Arcadia from pny
place in which rabies shaD be pres-
ent or shalt have been known to be
present within six months, without
permisBion of the City Health Of-
ficer.
SECTION 22. That Sections 16
to 21. both inclusive, of this Ordi-
nance shall be operative only when
rabies exist in or near the City cf
Arcadia. It shall be the duty of ~he
City Health Officer to determine
when rabies exist in or near the
City 01 A.rcadla and his flndlngs
in the matter shall be final and
conclusive. Notice ot the finding
of the City Health Officer as to the
existence c.t rabies Bnd as to the
termination of the existence thereof

SECTION 23. The following Or-
dinances are hereby specifically re-
pealed: Ordinance No. 485, passed
