AN ORDINANCE OF THE CITY OF ARCADIA AMENDING ORDINANCE
NO. 323 OF SAID CITY: BY ADD:{:"NG THERETO A NEW SECTION RELATING TO
ABANDONED UNDERGROUND GASOLINE TANKS.

THE CITY COmiCIL OF THE CJ;':q OF ARC.AI)IA DOES ORDAIN AS
FOLLOWS:
SECTION 1. That Ord1nance No. 323 of the City of Arcadia,
entitled, If An Ordinance of the CitY.9ouncil of the City of Arcadia
relating' to fire protection and f.ire prevention, ',regulating 'the burning
of brush, rubbi;h or other materials, for the protection off1re hose,
fire' apparatus and the water system of said City .of 'Arcadia, prohibiting
the taking of water without perIDissioJ;l of an authorized officer of said
City, establishing an .'incinerator district" creating the.office. of
. ,
Chief of the Fire Departmen~, establis'hing a district north of Foothill
Boulevard as a Fire. hazard, providing for incinerators in residential
districts, :repealing. Ordinances Nos. 120, 154, 19.9 'and all Ordinances in
conflict herewith and providing. a pena'l ty for' the violation thereof. II,
adopted September 17, 1935, is herebyamende'd by adding thereto a new
. .
Section to be known aJ;ld.n~bered as Section' 44.2, wbich said Section
44.2 shall follow imniediately' after Section 44.1 of said Ordinance No.

323, and shall read as follows:
. SECTION 44.2.: Whenever any underground gasoline. storage
. tank shall. not hav.ebeen. in use for the dispensing of gasoline for a
period of thirty (30) days,' ",;;,1 the same shall' .be abandoned within
fifte~n (i5) days ~h~reafter a~ herein provid~d, unless prior to the
expiration of said fifteen '( 15) day periOd,. the Chief of the Fire
Department, upon good cause shown, grants an extension or extansions
of .time therefor..
For the. purpose of abandoning. such storage tank, the 0 wner,
lessee or other person, firm.or corRoration having. control or possession
thereof, shall. abandon such' storage tank by one of the following methods:
1. 'Remove. saId storage tank f'rom the earth, or
2/. S~id storage tank in t~e ground shall be completely
. . filled with earth, sand, concrete or other solid material
approved by the Chief of the Fire Department, or
3. Fill storage tank with water. If this method is used,

the storage tank shall. be.first em~tied of commodity
therein by the regular station p~p, so far as possible,
and water shall then be introduced into the fill pipe of
the tank, and . allowed to overflow the fill pipe. for a. time
. .
sufficient to wash away the remaining commodity. The
water level.shall at all .times remain high in the fill
pipe to insure that all parts of .the tank are filled with
water.' The p~p or p~ps attached to said storage tank
shall be securely locked or disconnected from said tank.
If the pump or pumps are removed the suction and return
lines shall be plugged or capped with ..standard pipe fittings,
or
4. By emptying said storage tank. If.this method is

used:
The commodity shall be p~ped from the tank until suction
is lost, allowing a'small quantity of commodity to remain
in the tank. The fill pipe sh.all be tightly capped with
standard. pipe fitting. The area around .the fill pipe shall
be backfilled with sand or earth to the' level of the
surrounding ground, or where fill pipes are recessed in
a box. the. box shall be backfilled with sand or earth to
the underside of such bo~ cover.
In the event auxiliary tanks are used in connection with
underground storage tanks, the auxiliary tanks. shall be
fil~ed to caJ.lacity with the commodity, and not less than
five (5) gallons of said commodity shall remain in the
. underground tank~"
In .the event pump~ are removed, suction and return

lines shall be disconnected below pump slab, and said
lines shall be plugged or capped with standard pipe
. . '
fittings. Pipe area way in p~p slabs shall be backfilled
with sand or earth to the level ofp~p slab.
Methods 3 or 4 above shall.constitute a temporary abandonment
and such method of abandonment shall not continue beyond a period of
six (6) months after cessation of present war hostilities.

. It shaihl be unlawful for: any oimer, Ie s see. or other person
firm or corporation havin~control or ~ossessio? of any abandoned
underground storage tank.to fail, refuse or neglect to abandon said
tank wi thin the t'imeand in. the manner' as herein provided.
SECTION 2. The City Clerk' shall certify to the adoption of

this Ordinance andprior'to ,the expiration.of fifteen.(15) days from,
the passage tbereof, shall. cause the s~e to be published once in the
Arcadia Tribune and Arcadia News, a newspaper of general circulation,
Published. and circulated.in the City of Arcadia, and thir~y (30) days
from and . after the. final passage thereof. said Ordinance' shall take
.effect and be in forc.e.
