ORDINANCE NO. 518.
ORDINANCE OF THE CITY OF ARCADIA ADOPTING A BUILDING CODE
FOR THE CITY OF ARCADIA.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS:
SECTION 1. That a certain document, three (3) copies of which
are on file, for use and examination by the public, in the office of
the City Clerk of the City of Arcadia, being marked and designated as
IIUniform Building Code, 1943 Edition, published May 1, 1943, by Pacific
Coast Building Officials Conference," together with the appendix portion
of said Code, to be found on Pages 280 to 290, both inclusive; and
excepting the following provisions of said Code and appendix:
(1) Section 303, relating to an appeal fee to be found on pages
41 and 42 of said Code;

hereby expressly excluded from said Code and are not hereby adopted;
be and the same is hereby adopted as the Building Code of the City of
Arcadia for regulating the erecting, construction, enlargement, altera-
tion, repair, moving, removal, conversion, demolition, occupancy,
equipment, use, height, area, and maintenance of all buildings or
structures in the City of Arcadia; and each and all of the regulations,
provisions, penalties, conditions and terms of such "Uniform Building

Officials Conference", including such portions of the Appendix thereof,
heretofore referred to as being adopted, on file in the office of the

City Clerk, as aforesaid, are hereby referred to, adopted, and made a
part hereof as if fully set out in this Ordinancej provided, however,
that certain Sections of said Uniform Building Code, 1943 Edition, shall
be and the same are hereby amended as hereinafter set forth in Sections

SECTION 2. Any person whose application for a building permit
for the use of an alternate material or type of construction has been
refused by the Building Inspector or who may consider that the pro-
visions of this Code do not cover the point raised or that any particul~
prOVision would cause a manifest injury to be done may appeal to the
City Council by serving written notice on the Building Inspector in which
it shall be stated that the applicant desiring to use the alternate
materials or types of construction sRall guarantee payment of all ex-

penses for necessary tests made or ordered by the City Council. Such
notice shall be at once transmitted to the City Council, which City
Council shall arrange for a bearing on the particular point raised.
SECTION 3.
In order to determine the suitab~lity of alternate
materials and types of construction and to provide for reasonable in-
terpretations of the provision of this Code, tbe City Council shall con-
stitute a Board of Examiners and Appeals. The Board shall adopt rea-
sonable rules and regulations for conducting its investigations and shall

render all decisions and findings in writing to the Building
with a duplicate copy to the appellant.

provisions
of this Code to cover a special case, if it appears tbat the provisions
of this Code do not definitely cover the point raised or that a mani-
fest injustice might be done, prOVided that every such decision shall be
by unanimous vote of the Board of Examiners and Appeals. Decisions as
to the use of alternate materials and types of construction shall be by
majority vote and if not permitted by this Code shall become effective
only when authorized by an amendment to this Code.

as a building of Group:. A,B,C,D,E,F,G, or H, as defined in Chapters
6 to 13, inclusive of said Uniform Building Code, the Building In-
spector shall charge and collect a plan checking fee, based on the
total value or cost of the proposed building, structure or construc-
tion work, and the applicant filing such drawing, plan or specifica-
tion in the office of the Building Inspector shall pay such fee at the
time of the filing thereof.
Such plan checking fee shall be fifty (50) per cent of the
amount of the charge for a building permit as provided by Section 203
of said Uniform Building Code, and said plan checking charge shall be
in addition to said permit fee.
SECTION 6. Section 206 of said Uniform Building Code, 1943
Edition, is hereby amended to read as follows:
lISection 206. Certificate of Occupancy. No structure of
Group A to H inclusive, nor any part thereof shall be used
or occupied until a Certificate of Occupan~y has been issued
therefor by the Building Inspector; provided, however, that
no existing building or portion thereof shall require a

Certificate of Occupancy unless altered or changed, or unless

the occupancy housed therein is differenct from that for
which the original permit was issued. The Building Inspector
shall issue a Certificate of Occupancy for such structure, if
after inspection it is found that it oomplies vdth the pro-
visions of this Code. Such Certificate shall show the use

to which the structure may be put and any limitations of such
use. A temporary Certificate may be issued for the temporary
use of a portion of a structure prior to the completion of the
entire structure.
SECTION 7.
Section 207 of said Uniform Building Code, 1943
Edition, is hereby amended to read as follows:

of any structure shall not be changed to one which re-
quires a Certificate of Occupancy by Section 206 of this
Code until such Certificate of Occupancy permitting the
new use is issued by the Building Inspector. No such

Certificate of Occupancy shall be issued unless
the building shall comply with the requirements of
this Code. (See Section 104)1f.
SECTION 8. Section 704 of said Uniform Building Code, 1943
Edition, is hereby amended by adding thereto, at the end of said Section
704, the following two (2) additional exceptions, designated Nos. 5 and 6:
"Section 704.
5. In Assembly Rooms with capacity of 100 or less,
exit doors may be fastened against exit by latches operated
by door knobs or similar devices which can be opened readily
from the inside at any time without the use of keys.
6. Buildings or rooms seating less than 100 need
not be equipped with exit lights.1I
SECTION 9. Section 801 of said Uniform Building Code, 1943
Edition, is hereby amended to read as follows:

Group C
occupancies shall be:
Any building used for school purposes, involving assemblage
for instruction, education or recreation, provided, rooms
with a seating capacity of 300 or more shall be classed in
Group B and shall !neet all the requirements for such occupancy. II
For all occupancy separations, see Table No.5-BIf.
SECTION 10. Section 804 of said Uniform Building Code, 1943
Edition, is hereby amended by adding thereto, at the end of said Section
804 the following paragraph, to be designated Paragraph 21:

21. All exit and entrance doors or gates ahall
swing in the direction of exit travel, and if serving rooms
having a capacity greater than 100 and provided with latches
such latches shall be of the self-releasing type, such as
panic bolts or similar devices, which will pel~t the door
to open when pressed against.
In Assembly rooms with capacity of 100 or less, doors
if fastened against exit shall be fastened by latches operated
by a turn of a knob or similar device which can be readily

opened from the inside at any time without the use of keys.
All doors shall be installed so as not to decrease
the width of any opening, passageway or corridor in any way
whatsoever. No single door shall be more than four (4)
feet in width. II
SECTION 11. The first paragraph of subsection 2 of Section 1602
of said Uniform Building Code, 1943 Edition, is hereby amended to read
as follows:

112. Type IV. No building of Type IV construction
having an are~ greater than four hundred square feet (400
sq. ft.) exclusive of canopies that are open on at least
two sides, except gasoline service st~tions, not exceeding
1000sq. ft. in area, shall be erected, constructed in, or
moved into or within Fire Zone No. I".
The second paragraph of subsection (d) of Section 2 of
said Section 1602 of said Uniform Building Code, 1943 Edition, is here-
by amended to read as follows:
IINo building of Type IV construction in excess of four
hundred square feet (400 sq. ft.) in floor area, ,except
~gasoline service stations, not exceeding 1000 sq. ft. in
~V area, nor any building of Type V construction already erected
in Fire Zone No. 1 shall hereafter be altered, raised, en-

larged, added to or moved, except as follows:"
SECTION 12. The first paragraph of Section 2204 of said Uniform
Building Code, 1943 Edition, is hereby amended to read as follows:
IISec. 2204. Foundations. All exterior walls and
interior bearing walls of Type V buildings shall be
supported on continuous solid masonry or reinforced concrete
~..)iJ footings which shall be of sufficient size to support safely
the loads imposed as determined from the character of the
soil. Masonry foundation walls shall extend at least six
inches (611) above the finished grade adjacent to the wall
at all points. Mudsills shall be bolted to the foundation
or foundation wall with not less than one-half inch (!")
bolts, embedded at least seven inches (7") into the masonry

and spaced not more than six feet (61) apart. (See
appendix for table of minimum foundation requirements
for Type V buildings.) Except that the foundation walls
of one story private garages, sheds and outbuildings of
any area, having concrete floors shall extend not less

SECTION 13. The first paragraph of Section 2205 of said Uniform
Building Code, 1943 Edition, is hereby amended to read as follows:
"Sec. 2205. Exterior Walls and Wall Coverings.
(a) Construction. Exterior walls of all Type V
buildings, including additions, except stables, poultry
houses and similar accessory buildings, shall be con-
structed with studding not less than two inches by four

inches (2" x 4") spaced not more than sixteen inches (16")
on centers, or such walls may be constructed of not less
than four inch by four inch (4" x 4") posts spaced not
more than five feet (5') on centers or of larger members
designed as required in Chapter 25, or may be of post and
beam framing with plank sheathing not less than one and
one-half inches (l~") thick or may be of laminated construc-
tion not less than four inches (4") nominal in thickness
with the structural assembly properly designed to support
all loads."
SECTION 14. Paragraph (h) of Section 2524 of said Uniform
Building Code, 1943 Edition, is hereby amended to read as follows: ~
"~h) Chimney Space. Wood Isth, furring or framing shall
be placed not less than two inches (2") from any interior
chimney and not less than four inches (411) from the back
of any fireplace, and not less than I" from any exterior
chimney. "
SECTION 15. The 4th paragraph of Section 3105 of said Uniform
Building Code, 1943 Edition, is hereby amended to read as follows:

"Joists of other grades, other woods and other sizes
may be used, in which case they shall not be stressed to
exceed the maximum allowable fiber stress as specified in
Chapter 25, provided, that in all cases where floor joists
are used the m1nimum size of said floor joists shall be two
inches by six inches (2" x 6") and shall be spaced not more
than sixteen inches (16") center to center".
SECTION 16. Section 3206 of said Uniform Building Code, 1943
Edition, is hereby amended to read as follows:
"Section 3206. Roof Drainage. Storm and rain water
from the roof of all buildings which would flow by gravity

over a public sidewalk shall be carried by means of conductors
under the sidewalks and through the curb into the gutter.
Overflows shall be installed at each low point of the roof
to which the water drains.
EXCEPTION: Buildings of Group I or J, the walls of
which are ten feet (10') or more from the street property
line need not comply with the above."
SECTION 17. The last paragraph of Section 3706 of said Uniform
Building Code, 1943 Edition, is hereby amended to read as follows:
"No heater burning solid or liquid fuel shall be placed
in a fireplace which does not comply with the requirements
I of this Section. No such heaters shall be connected to a

',~.y gas vent flue. No wood shall be placed wi thin seven and one-
half inches (7~") of the jambs or top or arch of any fireplace

opening, and no part of the wood shall project from the plane
of the fireplace opening a distance greater than one third
(1/3) the shortest distance from that part to the nearest
edge of the fireplace opening."
SECTION 18. The second paragraph of Section 3711 of said Uniform
Building Code, 1943 Edition, is hereby amended to read as follows:
"In the kitchen of every building hereafter erected there

or vent, when approved by the Building Inspector, there may

be installed in the wall or ceiling approximately over
the gas outlet, a ventilating opening with an area of
not less than six inches by eight inches (611 x 8"), con-
nected to a ventilating duct leading to the outside air,
such duct for each kitchen to be not less than thirty-
six square inches (36 sq. in.) in cross sectional area.
An approved system of forced draft ventilation may be
substituted for the natural draft ventilating system.11
SECTION 19. Paragraph 10 of Subsection (d) of Section 4305 of
said Uniform Building Code, 1943 Edition, is hereby amended to read as
follows:

Wood shingles shall not be used on roofs which slope
less than three inches (3") in twelve inches (12").
Roof Sheathing for wood shingles shall be one inch
(1") boards spaced according to shingle exposure.
All wood shingles shall be nailed firmly with copper,
zinc, zinc-coated or commercially pure iron nails of at least
14 B. and S. gauge and not less than one and one-fourth inch
(It") long. Each shingle shall be nailed with two nails
driven substantially into the supporting roof construction,
and shall be laid with a side lap of at least one and one-
half (l!") inches in any three successive courses with at
least two courses of solid wood protecting each side joint,
and wi th grain of wood parallel to pitch of roof.
Wood shingles bearing the label of any recognized in-
spection agency, certifying compliance with Commercial
Standard CS 31-38 of the United States Department of Commerce

Bureau of Standards may be accepted as meeting the
requirements of this Code."
SECTION 20. Chapter 45 of said Uniform Building Code, 1943,
Edition, is hereby amended by adding thereto a new Section to be known
as Section 4508, and which shall read as follows~
"Sec. 4508.
Canopies. Canopies extending from a building
to a point not closer than one foot six inches (116") from

the curb may be constructed anywhere within the City, pro-
vided, however, that no permit therefor shall be issued by
the Building Inspector without the consent and approval of
the Council of said City.
The Building Inspector shall submit to the City Council
the plans and specifications for the construction~ such
canopy, and the contemplated location thereof, and before
granting such consent and approval, the Council may impose
such terms, conditions and restrictions upon the location
and construction of such canopy as said Council may deem
necessary or expedient to protect the safety or welfare of
said City and its inhabitants, and said Council shall have
the right to refuse its consent to the construction of such
canopy if in the judgment of the said Council the construction
of such canopy, at the location contemplated vall impede ped-
estrian travel.
The frame of such canopy shall be constructed entirely
of metal and shall be designed for a wind load of fifteen
(15) pounds per square foot acting on the entire surface

of the structure and in any direction. No part of the frame
shall be less than eight feet (8') above the level of the
sidewalk immediately below and no part of the fringe or
border shall be less than seven feet (7') above such sidewalk~
SECTION 21. Paragraph 2 of Section entitled "Refer to Section
2529", to be found on page 288 of the Appendix of said Uniform Building
Code, 1943 Edition, is hereby amended to read as follows:

112. The exterior walls of, and all wood posts
supporting girders in wood frame buildings shall be
placed on masonry or concrete foundation walls or piers."
Paragraph 6 of the same Section of said Appendix is
hereby amended to read as follows:
"6. All wood sills, including mudsills and sole
plates, which'are placed directly on masonry or concrete
foundations, shall be of the grade and kind of lumber
specified in paragraph No. (9)."
Paragraph 8 of the same section of said Appendix is
hereby amended to read as follows:
"8. All wood members used to support permanently
a load of any kind, shall be of the grade and kind of
lumber specified in paragraph (9) when any part of such member
is placed within eighteen inches (18") of any earth, either
natural ground or earth fill."
SECTION 22. If shall be unlawful for any person, firm or cor-
poration to erect, construct, enlarge, alter, repair, move, remove,
demolish, convert, equip, use or occupy or maintain any building and
structure or any portion of any building and structure in the City of
Arcadia contrary to or in violation of any provision of this Code or
to cause, permit or suffer the same to be done.
Any person, firm or corporation violating any of the provisions
of this Code shall be deemed guilty of a misdemeanor and each such person
shall be deemed guilty of a separate offense for each and every day or
portion thereof, during which any violation of any of the provisions of
this Code is committed, continued or permitted, and upon the conviction
of any such violation such person shall be punishable by a fine of not
more than $300.00, or by imprisonment in the City Jailor in the County
Jail of the County of Los Angeles, for not more than three months, or
by both such fine and imprisonment.
SECTION 23. Ordinance No. 464 of the City of Arcadia, adopted
on the 21st day of October, 1941, and all other ordinances, or parts
of ordinances, in conflict herewith, are hereby repealed; provided, that
any such repeal shall not affect or prevent the prosecution and punish-

ment of any person for any act heretofore done or committed in violation
of any ordinance which is repealed hereby.
SECTION 24. The City Clerk shall certify to the adoption of
this Ordinance and prior to the expiration of fifteen (15) days from
the passage thereof, shall cause the same to be published once in the
Arcadia Tribune and Arcadia News, a newspaper of general circulation,
published and circulated in the City of Arcadia, and thirty (30) days
from and after the final passage thereof said Ordinance shall take
effect and be in force.
