AN ORDINANCE OF THE CITY OF ARCADIA PllilliNDING ORDINANCE NO. 343 OF SAID CITY ESTABLISHING BI-MONTHLY MINIMm~ WATER RATES, PROVIDING BI- MONTHLY BILLING, ESTABLISHING THE AMOUNT OF DEPOSIT FOR CERTAIN METERS, PROVIDInG FOR PENALTIES ON DELINQUENT WATER BILLS, AND REPEALING ORDINANCES NOS. 374 AND 381 OF SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: SECTION 1. That Sections 1, 9, 16, 17, 20 and Rule 12 of Section 34 of Ordinance No. 343 of the City of Arcadia entitled, "An Ordinance of the City Council of the City of Arcadia fixing the rates and compensation to be charged and collected by said City of Arcadia for supplying water for domestic, irrigation and other purposes to the inhabitants of said City, prescribing rules and regulations for the government of the water service and providing a penalty for the violation thereof, and repealing Ordinances Nos. 66,67, 69, 88,98, 113,119,120,135,164 and 165 of said City of Arcadia ,and all other Ordinances or parts of Ordinances of said City of Arcadia in conflict therewith." adopted November 4th, 1936, be and the same are hereby amended to read as follows: "Section 1. The follo\dng rates and compensation are hereby fixed and established as the bi-monthly minimum rates and compensation to be charged and collected by the Water Department of the City of Arcadia for water furnished by said Department: Size Meter in Inches 5/8" for first 2000 cubic feet or less, $2.00. 3/4" for first 2000 cubic feet or less, $2.00 1" for first 2000 cubic feet or less, $2.00. 1 1/2" for first 3000 cubic feet or less, $3.00. 2" for first 4000 cubic feet or Ie s s, $4.00. 3" for first 6000 cubic feet or less, $6.00. 4" for first 8000 cubic fee t or less, $8.00. 6" for first 12000 cubic feet or less, $12.00 8" for first 16000 cubic feet or less, $16.00. For all water used in excess of the bi-monthly minimum three(O.03) cents for each 100 cubic feet or portion thereof. For apar~nent houses, hotels, bungalow courts, automobile courts, ~.pll " V-tc:! For all water used in excess of the bi-monthly minimum, three (0.03) cents for each 100 cubic feet or portion thereof. In each fiscal year the first bi-monthly period shall begin on July 1st and end on August 31st next succeeding; each subsequent calendar period of two months shall compose a bi-monthly period." IISection 9. That where a meter fails to register during any period, a charge will be made, based upon an average of the water consumed during the same bi-monthly period of the previous year; in the event that a meter has not been installed for a period of one year, then an average daily consumption of such period as said meter shall have been registering, or the nearest bi- monthly period when the meter was registering." "Section 16. The Arcadia Water Department, as a condition to grant- Ing such application and furnishing water to said premises is authorized and $hall require a deposi t as follows: A. From tenants for single family domestic meters, $5.00; B. From rate payers of courts and flats, for each unit, $2.00; C. From tenants for irrigation meters for each acre of ground to be irrigated, $5.00. Deposit will be refunded when the services are discontinued, provided all charges to the applicant by the Water Department have been paid, other- wise applied on the account." "Section 17. Meter rates are due and payable on the 1st day of each bi-monthly period. Accounts for meter rates become delinquent on the 15th day of the calendar month following the bi-monthly period in which water is furnished and a penalty of ten per cent of the amount due shall be added to all meter rates then unpaid. If the amount due for water together with the amount of such penalty be not paid on or before the 20th day of the calendar month following the bi- monthly period in which water 1s furnished, notice in writing shall be served upon the said delinquent consumer personally or by mailing, postage prepaid, together with a statement of the amount due and delinquent, to his last known place of residence, to the effect that if said delinquent account is not paid before the first of the following month, the water will " ,,pYP -~- (/Ac! .5".'2/ be cut off without further notice. If the amount due together with such penalty 1s not paid on or before the first day of the following month, the water shall be shut off, until payment of the amount due is made, with the addition of $1.00 for the expense of turning the water off and on." "Section 20. When water bill is rendered for any period of time less than the regular bi-lilonthly period for water furnished at domestic or irrigation meter rates, the regular bi-lllonthly minimum charge shall be prorated, provided, however, that any period of time less than one-fourth (1/4) of the bi-monthly period shall be considered as one-fourth (1/4) of such bi-monthly period in making said charge." lIRule 12: Section 34. All meters shall be placed so as to measure all water passing through the tap or service pipe furnishing the water. All meters shall be read between the 1st and 26th days of the second calendar month of each and every bi-monthly period and a copy of the rea.d- ing shall appear on the consumer's bill. " SECTION 2. The following Ordinances are hereby repealed: Ordinance No. 374, adopted on the 4th day of January, 1938; Ordinance No. 381, adopted on the 6th day of September, 1938. SECTION 3. The City Clerk shall certify to the adoption of this Ordinance, and prior to the expiration of fifteen (15) days from the pass- age thereof, shall cause the same to be pUblished once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia, and thirty (30) days from and after the final passage thereof said Ordinance shall ta.ke effect and be in force.
