"\ AN ORDINANCE OF THE CITY OF ARCADIA REGULATING THE COLLECTION
OF GARBAGE IN THE CITY OF ARCADIA.
ORDINANCE NO. 524.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLO~S:
SEC'l'ION 1. For the purpose of this Ordinance the IVord "garbage"
is defined to be every refuse accumulation of animal, fruit or vegetable
matter that attends the preparation, cons,@ption, decay, dealing in or
storage of meats, fish, fowls, fruits or vegetables.
SECTION 2. It shall be unlawful for any person, firm or corporation
to gather, or collect, or cause or permit to be gathered or collected
any garbage within the City of Arcadia; provided, however, that the pro-
visions of this Section shall not apply to any person in the employ of
the City of Arcadia who shall be assigned by the City Council of the

q~\ said City, or to any person, fi~n or corporation with whom the City of
Arcadia has entered into or may hereafter enter into a contract for the
collection or gathering and removal of garbage, or to any employee of
such contractor during the time such contract shall be in force.
SECTION 3. The City of Arcadia, its agents, employees, or the
person, firm or corporation with whom the City of ArcaJia has entered
into or may hereafter enter into a contract for the collection and
removal of garbage shall, at the request of the manager, tenant, occupant
or lessee of any property in the City of Arcadia, collect and remove all
garbage accumulated at the following intervals, to-wit:
(a) Semi-weekly, at regular intervals, from any private dwelling
house or residence.
(b) Daily, (Sundays and holidays excepted) from any hotel, board-
ing house, apartment house, or place of business.
SECTION 4. Every person, firm or corporation from whom garbage
is collected and removed, as provided in this Ordinance, shall pay a fee

to the collector of such garbage for such collection and removal thereof,
said fee to be fixed and computed as follows:
A. For each private dwelling house or residence, a fee of Fifty

B. For any hotel, boarding house, apartment house, or place of

business, a fee computed upon the average daily volume of garbage
collected and removed during the month for which said fee is charged,
and shall be at the following rates, to-wit:
(1) Two and 50/100 ($2.50) Dollars per month for a volume of
ten (10) gallons or less per day,
(2) Five and nO/lOO ($5.00) Dollars per month for a volume over
ten (10) gallons but not over twenty-five (25) sallons, per
day,
(3) Nine and no/lOO ($9.00) Dollars per month for a volume over
twenty-five (25) gallons but not over fifty (50) gallons,
per day,
(4) Twelve and nO/lOO ($12.00) Dollars per month for a volume
over fifty (50) gallons but not over seventy-five (75)
gallons, per day,
(5) Fifteen and nO/lOa ($15.00) Dollars per month for a volume
over seventy-five (75) gallons but not over one-hundred (100)
gallons, per day,

(6) For any volume totaling over one-hlli~dred (100) gallons but
not over two-hundred (200) gallons per day, the sum of
Fifteen and nO/lOO ($15.00) Dollars per month plus Two and
50/100 ($2.50) Dollars per month for each twenty-five (25)
gallons or fraction thereof over one-hundred (100) gallons
per day,
(7) For any volume totaling over two-hundred (200) gallons per
day, the sum of Twenty Five and no/lOO ($25.00) Dollars per
month plus Two and 50/100 ($2.50) Dollars per month for each
one-hundred (100) gallons or fraction thereof over two-
hundred (200) gallons per day.
SECTION 5. Every person, firm or corporation having garbage
collected in the City of Arcadia, as provided herein, shall be billed
each and every month for the charges incurred for the collection of
garbage the preceding month. Should such person, firm or corporation
fail, refuse, or neglect to pay said bill within fifteen (15) days after
the same is rendered, the collector of garbage may refuse to collect

garbage from the premises of such person, firm or corporation until said
bill is paid.
./ SECTION 6. Any garbage vessel, can or receptacle which leaks and
is not water tight shall be replaced by the person from whom garbage is
collected, within ten (10) days after notice from the collector of
garbage stating the condition of such vessel, can or receptacle. Such
notice from the garbage collector shall be made by attaching a tag to
such vessel, can or receptacle, and indicating thereon the defective
condition thereof.
SECTION 7. Every person, firm or corporation desiring to have
garbage collected from a private dwelling house or residence shall place
such garbage vessel, can or receptacle on the curb in front of the
premises; and every person, firm or corporation desiring to have garbage
collected from any hotel, boarding house, apartment house, or place of
business shall place such garbage vessel, can or receptacle within five
(5') feet of the alley in the rear of such premises where there is an
alley other than a blind alley. And if there be no alley, other than a
blind alley in the rear of such premises, then such vessel, can or

C'!>U ',,", receptacle shall be placed at some convenient location on the premises,

I to be designated by the collector. All garbage to be collected as
provided in this Section shall be placed at the locations designated
herein prior to the hours fixed for the collection of garbage.
SECTION 8. Garbage vessels, cans or receptacles from which garbage
is collected at any private dwelling house or residence shall be so con-
structed as to contain not less than three (3) or more than sixteen (16)
gallons. Garbage vessels, cans or receptacles from which garbage is
collected at any hotel, boarding house, apartment house, or place of
business shall be so constructed as to contain not less than three (3)
nor more than thirty (30) gallons.
All vessels, cans or receptacles mentioned in this Section shall
be constructed of metal and shall be provided with a handle or handles
on the outside thereof and with a tight fitting metal cover. Such cover
shall not be removed except when necessary to place garbage therein or
to take garbage therefrom.

SECTION 9. The hours of collection of garbage shall be from
6:00 o'clock, A.M. to 4:00 o'clock, P.M., on days designated by the
collector of garbage.
SECTION 10. Any person, firm or corporation violating any of
the provisions of this Ordinance shall be deemed guilty of a misdemeanor,
and upon conviction thereof shall be punishable by a fine of not more
than Three Hundred (~300.00) Dollars, or by impriso~ment in the City Jail
of said City of Arcadia, or in the County Jail of the COlmty of Los
Angeles, State of California, at the discretion of the Comrnitiing Ma~istrate
for a period not exceedins three (3) months or by both such fine and
imprisonment.
SECTION 11.

The City Clerk shall certify to the adoption of

passa~e thereof, shall cause the same to be published once in the Arcadia
Tribune and Arcadia News, a newspaper of general circulation, published
and circulated in the City of Arcadia, and at ~~dni6ht on December 31,
1944, next succeeding thirty (30) days from and after the final passage
thereof said Ordinance shall take effect and be in force.
I hereby certify that the foregoing Ordinance TIas adopted at
a regular meeting of the City Council of the City of Arcadia, held on the
2Ist day of November, 1944, by the affirmative vote of at least three
Councilmen, to-wit:
