THE CITY COu1lCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOI'iS: SECTION 1. Petition of Walter E. Chisholm, having been filed in the office of the Planning Co@nission of the City of Arcadia, pur- suant to the provisions of Ordinance No. 439 of said City, adopted June 28, 1940, asking that an exception be made affecting the property described in said petition, and setting forth the specific reasons therefor and the circumstances in cop~ection therewith, and recommendation having been made by the Planning Commission to this Council, and a full investigation and consideration of the facts having been made by this Council pertinent to this petition; this Council determines that there are exceptional or extraordinary circumstances or conditions applicable to the property involved and to the intended uses thereof that do not generally apply to the property or classes of uses in the same zone or district in which said property is located, and will not be inconsistent with the general purposes of Ordinance No. 439, and that said property should be excepted from the provisions of the zone created by said Ordinance No. 439 affecting said property, but only so far as herein- af'ter set forth; and the requirements of said Ordinance No. 439 per- taining to the consent of adjacent property owners having been complied with; This Council, therefore, excepts from the provisions of the respective zone of Ordinance No. 439 of the City of Arcadia, the property hereinafter described, but only so far as such exception is necessary to permit the following described property, to-wit: Those portions of Lots 5 and 6, of Tract No. 949, in the City of Arcadia, County of Los Angeles, State of California, as shovm on map recorded in Book 17, Page 13, of Maps, on file in the office of the Recorder of said County described as follows: Beginning at the northwest corner of Lot 5, of said Tract No. 949, as the same is shown on County Surveyors Map. No.~420, on file in the office -1- , r21..L S~~ of the Surveyor of said County; thence along the north line of said Lot 5, as the same is shown on said County Surveyors Map No. 9420, North 89002117lf East, 444.06 feet, more or less, to its intersection with the centerline of proposed Baldwin Avenue, as shown on County Sl~veyors Map No. BIll-sheet 4, on file in the office of said Surveyor; thence South 32042155lf West along the centerline of said proposed Baldwin Avenue 627.48 feet to the beginning of a tangent curve therein concave to the East and having a radius of 1000 feet; thence southwesterly along said curve 99.46 feet to a point (a radial bearing to said point bears North 62059101" West); thence North o 71 13120" West, 130.43 feet to the beginning of a tangent curve con- cave to the South and having a radius of 1000 feet; thence Westerly along said curve 100 feet to a point (a radial bearing to said point bears North 13002154lf East); thence North 26000154" East, 347.87 feet to a point in the Westerly line of said Lot 5; thence North 2058125" East along the Westerly line of said Lot 5, 225 feet to the point of beginning. The above described parcel of land has a gross calculated area of 0 4.184 acres. Whereof 0.550 acres are within Lot 6 of said Tract No. 949, to be used and occupied for the following purposes, to-wit: The erecting, constructing, enlarging, altering and repairing of stables and corrals, and conducting the business of training, boarding and treating of horses on said property. This exception is granted upon the following conditions: (a) That no building permit be granted for the construction or erection of any building upon said property unless the plans and specifi- cations be first submitted to the Building Inspector of the City of Arcadia, and that said plans and specifications and said building shall in all particulars comply with the building Ordinance and sanit~ry regulations of the City of Arcadia. (b) That said property shall not at any time be used for any purpose or purpo ses no t spe cii'ied in this Ordinance. (c) That in case any 'of the prOVisions 0 f this Ordinance are -2- I"~ UAcl 6c:?~ violated, the property above described shall revert to Zone R-l as defined in Ordinance No. 439. and the rights and privileges herein granted shall terminate and cease, in the event that any such violation is not terminated vuthin thirty days. or such further time as the City Council may decide that the owner of said property, in the exercise of due diligence. requires to correct such violation, after the ovmer of said property has been given written notice by the City Council of such violation. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the saw.e to be published once in the Arcadia Tribune and Arcadia News. a newspaper of general circulation, pub- Ii shed and circulated in the City of Arcadia. and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. I hereby certify that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 17th day of October, 1944, by the affirmative vote of at least three Councilmen, to-wit: AYES: Councilmen.
